THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning.Code, Chapters 60 to
64, inclusive of the 'Saint Paul -Legislative Code, pertain-
ing to Use Districts, Height Districts_, and Rezoning of '
certain properties in the City of Saint Paul, as amended,
be and the same is hereby further amended so as to rezone
the following described property from "All Residence District
to Commercial District, to -wit:.
Lots 13 to 24 inclusive, Block 15, "Merrill?§
Division of Rice Streets Villas ", according,
to the plat thereof on file and of record
in the office of the Register of Deeds in and
for Ramsey County, - Minnesota, being located on
north side of Arlington Avenue between Park
and Sylvan Streets.
Section 2. This ordinance is hereby declared to-be
an emergency ordinance rendered necessary for the preserva-
tion of the public peace, health and safety.
Section 3. This ordinance shall take effect and
be in force upon its passage, approval and publication.

Dear Madam:
This is in the matter of the petition of Richard J. Schrier to rezone from
"A" residence to a commercial district property located on the north side
of Arlington Avenue between Park and Sylvan Streets. The property is de-
scribed as Lots 13 to 24 inclusive, Block 15, Merrills Division of Rice
Street Villas.
On September 25, 1961, the Commissioner of Finance reported the petition
sufficient with the owners of 11 of a possible 11 (100%) tracts of land
within the prescribed 100 foot radius having signed the petition. The
property is presently developed in part with a single - family residence
which fronts on Arlington Avenue, the remaining part of the site is vacant.
The petitioner proposes to develop the property with a commercial store
building, but detailed plans are not available at this time. The property
has a frontage of 502.2 feet on Arlington Avenue and 126 feet on Park and
Sylvan Streets, resulting in an area of approximately 63,293 square feet.
West and across Park Street is vacant land classified in the commercial dis-
trict; north and across-an unimproved public alley is the site of the pro-
posed Target Discount Store Inc.; east and across Sylvan Street is vacant
land; south and across Arlington Avenue is one single - family residence, the
balance of the land is vacant, farther south are a few scattered residences
which front on Park Street and Mayre Street.
Field investigation discloses no basic objection to the proposed rezoning.
The proposed land use plan indicates the highest and best use of this land
to be for commercial purposes. The commercial zoning of this property would
complete the commercial zoning of the immediate area lying between Arlington
Avenue on the south, Montana Avenue on the north, Rice Street on the west,
and the railroad right -of -way to the east.
In consideration of the above factors,
