DELANEY Saint Paul, Minnesota Gentlemen and Madam: , � Several transactions between the City of Saint Paul and the Housing and Redevelop- ment Authority have been matters of discussion between Mr. Eltor Dehn and Mr. Louis Sheahan and the members of the Housing Authority staff. The City has pro- posed as a part of the program for improvement of Louis-Marion Street to levy assessments estimated at an amount of $3,500.00 against Parcel One (1) and Three (3), Western Redevelopment Area, which assessments would ulfima.tely be paid by the Authority. The City has further proposed in connection with the vacation of streets and alleys in the Upper Levee Renewal Project to condition said vacation upon the payment by the Authority of approxi.mately $12,000.00 as the value of the vacated streets. In the event the Authority would pay these sums, no part of them would be eligible project costs or non-cash grants-in-aid of the local one- third (1/3) share of net project cost. Indeed, in the case of the assessments the amount assessed would have to be deducted from the amount otherwise eligible as a non-cash grant-in-aid. Both amounts would be paid from the Tax Levy Fund and would be in effect, a transfer of money from local tax funds to another. We would point out that all monies available in the Authority Tax�Levy Fund are available as the City's one-third (1/3) share of future urban renewal pro- jects and to the extent that this fu�d. is depleted $1.00, $2.00 of Federal matching funds can be considered to have been lost. In order to conclude the various transactions abovementioned to the mutual � advantage of the City and the Authority, the Authority ma.kes the following proposal: That. in consideration of the City agreeing to the land exchange in the Upper Levee at raw land cost and in consideration of the City con= sidering the $3,500.00 assessment in the Western Area and the $12,000.00 assessment in the Upper Levee as being a part of the purchase price for the land in the Eastern Area, the Authority would agree to se1:1 the Eastern Area " land to the City at fair value rather than actual cost. Tlie following com- putation will make this proposal somewhat more clear. The Authority would sell the Eastern Area land at $23,194.00 which represents fair value rather than at $77,850.00 which represents actual cost. In return for the savings to the City of this approxima.te $54,000.00 the City would forego collection of $3,500.00 assessment in the Western Area, $12,000.00 for vacation of streets in Upper Levee Area and would accept the sum of $3,795.59 as the net payment in the Upper Levee Area land exchange rather than the sum of $19,110.60 which represents actual cost. In that effect, the City would forego collection of $31,500.00 from the Authority. The Authority would forego receipt of $54,000.00 for a net savings to the City of $22,500.00. These ma.tters have been fully discussed with Mr. Dehn and Mr. _ Sheahan and I believe they are in a position to make their recommendations. The parcels of land which are the sub�ect of the proposed exchange are located witYiin Upper Levee Renewal Pro�ect Area and the other , parcels of land which are the sub�ect of said pr.oposed sale and transfer are located r�ithin Ea.stern Redevelopment Area. Such parcels of land which are the sub�ect of said proposed exchange are described in the said Council ' s Resolution, Council � File No. 2011�0, approved March 9, 1961, wherein additional provisions are made for the aforesaid proposed exchange. Said Resolution, by reference, is incorporated here�in and made a part of this report. Such other parcels of land which are the sub�ect of said proposed sale and transfer are described as Lot �+, Block l, and Lot 2, Block 2, Eastern Area Addition, Saint Paul, Minnesota. �� Such proposed exchange affects and includes parcels of land representing an aggre�ate area of �+2,6g6 square feet acquired and held by said City for transfer to said Authority and additional parcels of land representing an aggregate area of 29,369 square feet acquired and held by said Authority for transfer to said City. Reference is made to the attached document entitled "Land Exchange with City of St. Paul Upper Levee Renewal Pro�ect No. Minn. R-3 August 22, 1961", which contains an exposition of facts material for consideration in connection wi�li .said proposed exchange of parcels of land within said Upper Levee Renewal Pro�ect Area. Said Resolution, Council File No. 2011�0, additional to other provisions, contains a provision for the payment of $19,110.60 upon such proposed f exchange of lands ky said Authority to said City as additional consideration. Said additional consideration represents the difference between said City's actual cost for acquisition and clearance of its lands to be the sub�ect of said exchange and the �actual cost incurred by said Authority for its acquisition and clearance of this land to be the sub�ect of said exchange. Said Authority has contended that the purchase price to become payable to it by said City for said Authority' s proposed sale and transfer to said City of said parcels of land in the Eastern � Redevelopment Area should be equivalent to said Authority� s actual cost incurred in its aequisition and clearance of the same. Such last mentioned actual cost, ; as computed and allocated by said Authority, amounts to $77,850.00. Such contention, by said Authority, is sought to be based upon certain recitals of the Redevelopment Plan and Part 1 of the Application for Loan and Grant for said Ea.stern Redevelopment Area Pro�ect, approved by your Honorable Body. Said City, in such connection, has contended for a stipulated purchase price representative of the fair use value of the sub�ject parcels of land amountin$ to �23,1g�+.00. Said City and said Authority contemplate that �he sub�ject of such sale and transfer, said Lot �F, Block l, and said Lot 2, Block 2, Eastern Area Addition, Saint Paul, Minnesota, shall be dedicated by said City to public atreet purposes, to-wit: to the proposed opening, widening and extension of Jackson Street. The �� Authority has submitted said proposal with the admonition that it is the most favorable proposal in regard to the City�s involved interests, obtainable in the situation. There is an apparent urgent need for the final settle- ment and disposition cf these ma.tters. The acceptance or re�ection of said Proposal in the C.ity' s behalf, involves questions for determination by the Council, in the exercise of its sound ,�udgment and discretion direc�ed to the promotion . and protection of the City's best interests. The determina- tion by the Council to accept said Proposal, upon the disclosed facts and circumstances, would be deemed manifestly reasonable and valid. _ The urgent need for the final ad�ustment and disposition of these matters is apparent. The acceptance or re�ection of said proposal by the City is for determination by your honorable body in the exercise of its �udgnent and discretion directed to the service of the public interests. The determination of the Council to accept said proposal would conatitute a reasonable and valid exercise of its �udgment arid discretion upon the history, facts and circumstances of the aforesai matters.
