2 WFIEREAS, a request has been received from Lang Griffin W W, LLC and Capital City Properties, for the
3 release of utiliry easements within the property located between Johnson Pazkway and Phalen Boulevard,
4 Saint Paul described as:
6 Copley and Ames Avenues as vacated by Council File 206256 and approved March 7, 1962, and also fzled
7 with Ramsey County as document number 1560259; and
9 WI3EREAS, the easement rights requested to be released aze depicted in Exhibit "A" attached; and now,
lo therefore be it

12 RESOLVED, that with the accompanying Certificates of Intended Non-Use, filed voluntarily on behalf of:
13 Comcast, a Pennsylvania corporation; Northern States Power d/b/a Xcel Energy — Gas Aivision, a
14 public utility; Northern States Power d/b/a Xcel Energ,y — Electric Division, a public utility; Ever-
15 Green Energy, LLC for District Energy Saint Paul, a limited liability company; City of Saint Paul —
16 Public Works, a municipal corporation; and Saint Paul Regional Water Services, a municipal
17 corporation; Qwest, a Colorado corporaHon; made a part hereof by this reference and filed in the o�ce
18 of the City Clerk of Saint Paul, the City, for itself and on behalf of these corporations and depariments,
19 waives the rights to the utility easements in the vacated area, described above; and be it further
20
21 RESOLVED, that upon passage of this resolution and the City's receipt of a$300.00 adtninistrative
22 processing fee said easement rights are released and the proper city officials aze hereby authorized and
23 directed to record a copy of said resolution in the office of the Ramsey County Recorder, and that the City
24 Clerk shall maintain on file a copy of the Certificates of Intended Non-Use referenced in this resolution.

Dear Ms. Borgen;
I am writing in response to your letter of February 13, 2008, wherein you requested
that Xcel Energy ("Xce1") comment on the referenced matter.
Please be advised that Xcel has no electric facilities currently located within those
portions of vacated Copley and Ames Avenues referred to in your letter and cross-
hatched on the map attached hereto.
Therefore, Xcel will be releasing easement rights retained in its favor in document
number 1560259. That process, however, will take 3-4 weeks.
I hope this letter will serve as sufficient assurance to your City Council.
