WHEREAS, it is mutually desirable and beneficial to both �
cities that Saint Paul and West St. Paul enter into a cooperative
financing agreemerit relative to the Riverview Storm Water Relief
S.}��tem; and
WHEREAS, in connection with the negotiation of said f inancing •
agreement several proposals have been exchanged between West Saint Paul
and Saint P�aul, said proposals representing progress toward a mutuaZly
satisfactory understanding and agreement; and
WREREAS�, the proposal of West Saint Paul by resolution on
October 11, 1961, is in most matters agreeable to Saint Paul, now,
theref ore, be it
RESO�.VED, That the Saint Paul proposal ��uansmitted to West
Saint Paul on October 3, 1961, be amended as f ollows :
' That by January 15, 1962, West Saint l�aul will pay to Saint
Paul $554,202.00 and that West Saint Paults share of Phase I shall
be 31.1� of actual cost up to a maximum of 15% over the estimated
cost as shown on Exhibit "A" of the agreement drafted by Saint Paul.
Final payment on Phase I shall be made by West Saint Paul within
sixty days after all costs of �?hase I have been determined.

That West Saint Paul will pay as its share of Phase II of
� said pro�ect, 31.1� of actual cost up to $88,324.00. The time of
payment of West Saint Paul to Saint Paul of said $88,324.00 for
Phase II will be at the tirne of Saint Paulfs advertising fc� bids
on the contract f or said work,
That completion of the Oakdale �and Livingston extensions
of the storm sewer within West �aint Paul be completed by West Saint
Paul by December 31, 1964. In consideration of this deferred completion
date f or work to be perf ormed by West Sa int Paul, the City of Sa int
Faul shall be permitted the right if found necessary to extend the
completion date of the Oakdale and Livingston extensions within Saint
��� Paul to the same December 31, 1964.

of West Saint Paul into the Robert Street sewer be 6.46 million
gallons per day.
That the completion date by Saint Paul of the def erred
Phase II of the project be December 31, 1968, and be it
FURTHER. RESOLVED, That the Corporat�on Counsel of Saint Faul,
in consultation with the Corporation Counsel of West Sain�t Paul, pro-
ceed immediately to redraft the proposed agreement with a view toward
completing the execution by the respective cities as soon as possible,
andbeit
FURTHER RESOLVED, That the City Clerk transmit a copy of this
resolution forthwith to the West Saint Paul City Council with the
request that the West S'aint Paul City Council instruct the West Saint
Paul Corporation Counsel to meet immediately with the Saint Paul
Corporation Counsel to complete the agreement in its�final f orm.
