This substitution eliminates the easterly hatf of Elm Street and. the easterly ends of �pring Street and �,oretto Street from the vacation proceedings. . . The matter of the compensation to be paid by the .,Authority for this vacation was discussed �rith staff inembers, together �rith other obliga- tions of the City and ;Quthority in connection with the Marion Street Improvement in the '6Jestern Redevelopment �,rea and the dedication of lands "lie i,ridening of Jackson Street in the Eastern Redevelopment . As a result, it is proposed that the sum to be paid by the Hoising Authority as its share of the vacation proceediqgs is to be �12,000, Which sum may be paid i.n cash or by the filing of an agreement that said amount be credited against the sum which the City would normally p�y to the �uthority for the land required for the.Nidening of Jackson Street. , , In addition, we ha.ve� contacted the Public Utilities Department and have been advised by Mr. Thompson that a11 w ater department mains, Y�ydrants, and appurtenanc�s within the Upper F.evee �lddition ha,ve been re,moved. The original plan submitted with the petition indicated that the portion of �iilkin Street to be vacated wou].d terminate at a point 112.45 feet north of a monument located at the southwest corner of Section 6, Town- ship 28, Range 22, which point is approxi.mately 8 feet south of the point used in the current negotiation with the Atithority with reference to lands being exchanged with the City ia connection with the �ridening of Shepard Road ar� involves the acquisition by the Authority of appro- ximately 900 square feet in the exchange proceedings. The Department of Public Works has indicated that they would have no interest in re- taining the ownership of the portion of Wilkin Street lying between the extended northwesterly line of Shepard Road at�d the line shown in the original plan attached to the petition, and the vacation of Wilkin Street as described herein is in line with the Public Works� recommendations. i�ith reference to se�rers in the streets and alleys, we have been ad- vised that a main interceptor sewer is�located in the portions of �iilkin Street and Spring �treet to be vacated and that a suitable per- manent easement 20_feet wide paralleling the center line of the seWer . ia Wilkin Street and a permanent easement cavering all of Spring Street should be retained. � storm sewer exists in Spring Street.from Elm � Street to the extended center line of the a11ey west.of �.ot 79, Upper - �.evee ,Addition. There is also a storm sewer in the westQrly 20 feet of E1m Street and in the a11ey adjacent to �,o�s 30 asid 1�2, Upper �.zvee • -3- IAddition, which sewers should be protected in the present proceedings with the stipulation that, should the site development require the el3mination of the storm sewer in the a11ey adjacent to �ots 30 and �2, Upper �.etiree .Addition, such elimination may be accomplished by the con- struction of a manhole within the project boundary northwesterly of Shepard Road. In addition to the sewers above noted, sanitary and storm sewers exist in the streets and alleys to be vacated. Inasmuch as these sewers serve only the pro�ject area, the Department of I�vbl ic �iorks has no in- terest in t,heir retention, and the terms of Ordinance No. 3391� provides for the reservation of easements to protect the Cityts interests. Since the retaining of these easements could hinder and possibly prevent the development as an assembled site, Z believe that the reservation con- tained in the ordinance should be waived.
