In the matter of condemnin� and taking an easement in the land necessary for the slopes,
cuts and fills, including right of removal of lateral support from subject land or
remainde�r thereof, occasioned by excavations thereof or construction of slopes in
grading and surfacing wi:th bituminous material the alley in Block 21 , West End
Addition from Elway Street to Montreal:Avenue
under Preliminary Order 203705 , approver� August 31 , 1961 �
Intermediary Order 204002 , approved September 19, 1961 �
' A public hearing having been had upon the above improvement upon due notice, and the Council having
heard all pereone, objections and recommendatione relative thereto, and having fully coneidered the eame;
therefore, be it
'� �RESOLVED, By the Council of the G�ty of Saint Paul that the preciee nature, extent and kind of im-
provement to be made by the said City ie
condemning and taking an easement in the land necessary for the slopes,
cuts and fills, �including right of removal of lateral support from sub�ject land or
remainder, thereof, occasioned by excavations thereof or construction of slopes in
grading and surfacing with bituminous material the alley in Block 21, West End �r
Addition from Elway Street to Montreal Avenue

and the Council hereby orders eaid improvements to be made.
RESOLVED FIIRTHER, that the following land, lands or easemente therein be and the eame are
hereby ordered to be taken, appropriated and condemned for the purpoae of making eaid improvemente, vis.t
For slopes, cuts and fills, including right of removal of lateral
support. from subject land or "remainder the�eof, occasioned by excavations thereof
or construction of slopes in grading and surfacing with bituminous material the
alley in,Block 21, West End Addition from Elway Street to Montreal Avenue to the
extent shown on the plan on file in the office of the Commissioner of Public Works.
' RESOLVED FIIRTHER, That the Commiseioner of Public Works be and ia hereby inetructed and .
directed to prepsre plane and specificatione for said improvement, a,nd the proper city officials are hereby
suthorised and directed to proceed with the making of said improvement in accordance therewith.
