1NHEREAS, in the matter of the Grading and Paving of East
Seventh Street from Johnson Parkway to Voh.ite Bear Avenue
and the construction of a Storm Sewer in East Seventh Street
from Etna Street to Germa.in Street, ComptrollerTS Contract
L-6202-A, �9shbach Construction Company, contractor, the
specified date of completion is November 1, 1960, and
WHEREAS, the contraetor has prosecuted the work diligently, but
due to tk� extra work of constructing a sewer connection at
Etna Street and E. Seventh Street, the completion of the
asphalt surface, �rae delayed with the result that the Seal-coat
could not be placed until 1961, and theref ore it was not
possible to complete the contract by said date of completion,
tha re f ore , be it
RESOLVED, that the proper City Officials be and they are h�meby
authorized and direeted to egecute an amend.ment to said contract
extsnding the time of completion to AUGIIST 25, 1961, provided,
howeve� , that this Resolution shall have no force or effe ct.
unless tha Sureties on the Contractor� s Bond consent th�e to
and file such consent in writing with� the Ci�r Comptroller,
and be it

cla im for liquidated damages and tha.t no engineering and
inspection costs on this Pro�ect will be charged by tlae City
