Wf�REAS, The Commissioner of Public Utilities has reported, in accordance
with Section 53 of the City Charter, the existence of an emergency
during the period from September l, 1961 to September 15, 1961
inclusive which rendered necessary the employment of certain employees
of the Department of Public Utilities for more than eight hours per
day or forty hours per week in doing the following works
Making emergency repairs to street lighting circuits,
and
WE�REAS, this emergency arose by reason of �the following facts and circum-
stancess
Overtime night work required to restore street
lighting service immediately for public safety,
therefore� be it
RESOLVED,that the proper city officers are hereby authorized to pay the
employees who performed such work in accordance with the pro-
visions of the Council•s Salary ordinance, Ordinance No. 644b.

the City Architect concerniag the appeal of Max Bix requesting permfasion to

and to relax the provision of Chapter 60.25 of the Legislative Zo�iing Code

rec�uest of the applicant in that he was uot preseat at the time of the ori-
ginal hesring.
At that time, the City Council referred the natter back to the Plaaning Board
offica aad the City Architect's office for �he purpose of �rorkiag out a suit-
abie agreement between the applic�nt, the City Architect and the Planniag

I am requesting a rehearing of a zoning petition concerning
a lot on E. Ivy, because of a misunderstanding on my part of the
date of the hearing by the Council. I appeared on the l�th of Aug-
ust, instead of the 3rd of August when the petition was acted up-
on, and refused.
Coucilman Peterson suggested that I request the rehearing.I
believe that I have information that should be considered be-
fore a final decision is made, and I respectfullp request the
members of the Council for a very few moments, so that I may pre-
sent this informa�aion in person.

• This is in the matter of the appeal of Max Bix to permit the construction
of a single-family residence on a lot of insufficient width and area, and .
to relax the provisions of Cliapter 60.25 of the Legislative Zoning Code on
property located on the north side of E. Ivy Avenae at Van Dyke. The pro-
perty is described as Lot 43, Block 16, Hayden Heights Addition. The
zoning is "A" residence.
This property is presently vacant and part of the yard area of the ad�oin-
ing lot to the east which is developed with a single-family residence and �
two-,car garage. The applicant proposes to separate this lot f rom the ad-
�oining lot to tbe east for the purpose of developing same with a single-
•family residence. Lot 43 was originally platted having a frontage of
40 feet and a depth of 125.7 feet, resulting in an area of 5,028 square
feet. However, in 1921, when the residence on the ad�oining lot (Lot 44)
was built, a side yard set back of only 1� feet was maintained, thereby re-
quiring 2� feet to be taken from Lot 43 so that the residential use would continue
in conformance with the side yard requirements of the Bui�lding Code. This
reduces the size of Lot 43 to a width of 37� feet, and an area of 4,714
square feet. The surrounding area uses are predominantly single-family
residences. Field ittvestigation discloses that it would be proper to main-
tain a minimum lot f rontage of 40 3eet as provided by other residences in
the block.
The Board of Zoning considered tbis matter at its regular meeting on
July 13, 1961, and it is its opinion that the relaxation of the minimum
lot width and area would establish an undesirable precedent with respect
to the lot width and area requirements of the Zoning Code. Therefore,
the Board of Zoning recommends the denial of the above described appeal.
