WHEREAS, DeparLment of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of two residential structures the front structure a two story, wood frame, single
family dwelling, the reaz structure a one and one-half story, wood frame single family dwelling
located on property hereinafter referred to as the "Subject Property" and commonly laiown as
586-586 %z VAN BUREN AVENUE. This property is legally described as follows, to wit:
MICHEL'S SUBDIVISION OF BLOCK 4, STINSON'S DIVISION E 30 FT OF LOT 7 BLK
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Depariment of Safety and Inspections on or before Apri12, 2007, the
following are the now lrnown interested or responsible parties for the Subject Property: US Bank
NA as Trustee Strct Asst Sects Coxp Mtg Pass-Thr Cert 2006-EQl, c/o America's Servicing,
3476 Stateview Blvd, Fort Mill, SC; Alexzey Z Moskvin, 12005 41 Ave N, Plyxnouth, MN
55441, Reiter & Schiller, PA, 25 North Dale Street, 2" Floor, St. Paul, MN 55102; Thomas Dale
District 7 Planning Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul I,egislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated November 6, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested ar responsible parties that they must repair
or demolish the structure located on the Subject Property by December 6, 2007; and
WHEREAS, the enforcement officer has posted a placazd on the Subj ect Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WI3EREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paui Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, February 26, 2008 to hear testimony and evidence, and after
receiving testimony and evidence, made the recommendation to approve the request to order the

interested or responsible parties to make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The demolition of the shucture to be completed within fdteen (15) days after the date of the
Councii Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday
March 19, 2008 and the testunony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 586-586 %: VAN BUREI�T AVENiJE.

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing ar Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the lmown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

blighting influence on the community by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The demolition and removal of the
structure must be completed within fdteen (1� days after the date of the Council
Hearing.
2. If the above corrective action is not completed within this period of rime Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolirion and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
104 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
105 parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

as defined by Legislative Code, Chapter 45. The Aepartment of Safety and Inspections has
issued an order to the then known responsible parties to eliminate this nuisance condition by
correcting the deficiencies or by razing and removing this building(s).
The property was re-inspected on December 6, 2007. There was no compliance and the nuisance
condition remains unabated, the community continues to suffer the blighting influence of this
property. It is the recommendation of the Deparhnent of Safety and Inspections that the City
Council pass a resolution ordering the responsible parties to either repair, or demolish and
remove this building in a timely manner, and failing that, authorize the Department of Safety and
Inspections to proceed to demolition and removal, and to assess the costs incurred against the

The front building is a two-story, wood frame, single-family dwelling. The back building is a
one and one-half story single-family dwelling, both of which are on a lot of 3,920 square feet.
According to our files, it has been a vacant building since August 9, 2006.
The current property owner is US Bank NA, per AMANDA and Ramse}� county property
records.
I'he city has had to board this building to secure it from trespass.
1"here have been six (6) SUMMARY ABATEMENT NOTICES since 2006.
There have been six (6) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of tall grass and weeds
- Removal of snow and ice
On October 22, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on November 6, 2007 with a compliance date of
December 6, 2007. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are delinquent in the amount of $625.00.

nuisance condition. You may also be required to post a five thousand dollar ($5,000.00)
performance bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.

This building(s) is subject to the restricrions of Saint Paul Ordinance Chapter 33.03 and shall not
again be used for occupancy until such time as a Certificate of Compliance or a Certificate of
Occupancy has been issued.
This is a two story, wood frame, single family dweliing.
1. The exterior walls of the house and/or gazage are defecfive. Repair all holes, breaks, loose or
rotting siding, to a professional state of maintenance.
2. The exterior walls andlor trim of the house andlor garage has defective, peeled, flaked, scaled
or chalking paint or has unpainted wood surfaces. Scrape and repaint to effect a sound
condition in a professional manner.
3. Smoke detectar: Lack of properly installed and operable smoke detector.
4. The windows and/or storm windows are in a state of disrepair. Replace all missing or broken
window glass. Make all necessary repairs to frames, sashes, hardwaze and associated him in a
professional manner. Permit may be required.
5. The window andlor door screens are missing, defective or in a state of disrepair. Provide
proper window and door screens for all openable windows and doors. Screens must be
tight-fitting and securely fastened to the frames.
6. The eaves and soffits are in a state of disrepair or deterioration. Repair all defects, holes,
breaks, loose or rotting boards, to a professional state of maintenance. Permit may be
required.
7. The interiar walls are defective. Repair all wall defects and finish in a professional manner.
8. The interior ceilings are defective. Repair all ceiling defects and finish in a professional
manner.
9. The bathroom floor covering is deteriorated or inadequate. Provide floor covering which is
impervious to water and easily cleanable throughout the bathroom and seal around the edges
and fixtures.
10. SANITATION: Immediately remove improperly stored or accumulated refuse including;
gubage, rubbish, junk, etc., from interior.
11. FURNACE: Have a licensed heating contractor service and clean the furnace or boiler and
make any necessary repairs. Perform a C/O test on the heating plant. Then, send the attached
form back to the Inspector. Repair of gas fired appliances requires a permit.
12. Exposed electrical wiring. Repair.
13. Numerous defective outlets and/or outlet covers. Repair/replace

8. Improper gas connection to stove. Repair.
9. The bathroom floor covering is deteriorated or inadequate. Provide floor covering which is
impervious to water and easily cleanable throughout the bathroom and seal around tl�e edges
and fixtures.

10. FURNACE: Have a licensed heating contractor service and clean the fumace or boiler and
make any necessary repairs. Perform a CIO test on the heatin� plant. Then, send the attached
form back to the Inspector. Repair of gas fired appliances requires a permit.
As owner, agent or responsible parry, you are hereby notified that if these deficiencies and
the resulting nuisance condition is not corrected by December 6, 2007 the Deparhnent of
Safety and Lnspecrions, Division of Code Enforcement, will begin a substantial abatement
process to demolish and remove the building(s). The costs of this action, including
administrative costs and demolition costs will be assessed against the property taxes as a
special assessment in accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce
Building, (651)266-9090. This inspection will identify specific defects, necessary repairs
and legal requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners. If you sell, transfer, ar convey in any manner, the
ownership or responsibility for this property, you must wathin seven (7) days, notify the
Enforcement Offacer with the names and addresses of any new owners or responsible
parties.
The Enfarcement Officer is required by law to post a placard on this property which
declares it to be a"nuisance condition", subject to demolition and removal by the City.
This placard shall not be removed without the written authority of the Department of
Safety and Inspections, Division of Code Enforcement. The department is £urther
required to file a copy of this "Order to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement
Officer will notify the City Council that abatement action is necessary. The City Clerk
will then schedule dates for Public Hearings before the City Council at which time
testimony will be heard from interested parties. After this hearing the City Council will
adopt a resolution stating what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either arder the City to take
the abatement action or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if corrective action is not taken within the specified time, the City shall abate
this nuisance. The costs of this acrion, including administrative costs will be assessed
against the property as a special assessment in accordance with law.

Ordering the owner to remove or repair the building(s) at 586-586 1/2 Van Buren Avenue
within fifteen (15) days from adoption of resolution.
The property owner ofrecord, US Bank NA, did not appeaz.
Mr. Magner stated there were rivo building on this parcel. The front building was a rivo-story,
wood frame, single-fanuly dwelling. The back building was a one and one-half story, single-fanuly
dwelling and both on a lot of 3,920 square feet which had been vacant since August 9, 2006. A
code compliance inspection had not been done, the vacant building registration fees were delinquent
in the amount of $625 and the $5,000 perfomlauce bond had not been posted. On October 22,
2007, an inspection of the building was done and a list of deficiencies which constitute a nuisance
condition was developed. An order to abate a nuisance building was posted on November 6, 2007
with a compliance date of Aecember 6, 2007. To date, the property remained in a condition which
comprised a nuisance as defined by the Legislative Code. Ramsey County Taacation estimated the
market value of the land to be approximately $40,800 and the building to be $188,200. Real estate
tases were current. Code Enforcement estimates the cost to repair the building to be approximately
$40,000 to $50,000 for each structure. The cost for demolition was estimated to be approximately
$11,670 to $15,670 for both structures. There had also been six summary abatements issued to this
property since 2006, six of which went to work order: to secure the building and the City had to
board the building to secure it from trespass, remove improperly stored refuse, cut tail grass and
weeds, and remove snow and ice. Code Enforcement recommends the building be repaired or
removed within 15 days. Mr. Magner presented photographs of the property.
Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner stated the
inspector for the area referred this property to the Vacant Building Program based on the exterior
conditions of the property.
Ms. Moermond asked whether US Bank had been maintaining this property. Mr. Magner stated
that the City had been maintaining the property. It had recently been inspected and a work order
was sent to Parks to clear the sidewalk of snow and ice.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that tlus building had not
been surveyed during the 1983 inventory process; however, it was near a cluster of potential
properties that had been inventoried, 548 Van Buren, and a few on other streets in the area.
According to her records, the first building was bualt in 1880 and there was an addition that was
built in 1896, perhaps which was the second building; however, the records were uxtclear. She
categorized the buildings as bungalow, workers-cottage style houses and the integrity was in fair to
good condition on the front building. She did not have photos of the back building.
Tait Danielson Castillo, District 7 Planning Council, appeared with three neighbors who wanted to
see this building demolished. He stated that District 7 did not have a formal meeting conceming
this property; however, over the past eight years that he had worked for District 7, it was the first
time he had received six phone calls on one property wanting to see the building demolished.
Larry Paulson, 581 Blair Avenue, stated that he lived across the alley from this property and had
lived there for the past 40+ years. This property has had different owners over the years and it had
always been a rental property. Over the past three years, he had left messages for the property
owner concerning the conditions at the property and the owner never returned any of his calls. He

said that the City had been providing garbage service at the property and the tenants would toss the
garbage along side the containers. He said that the property was a blight to the neighborhood and
there had been many Police calls on people breaking into the buildings. He believed that the back
house had been vacant since 2006; however, the tenants in the front building had only recently
vacated the property about three months ago. He wanted to see the buildings demolished.

Ms. Moermond recommended the building be removed within 15 days with no option for repair.
