This property is legally described as follows, to wit: MILTON ADDITION LOT 30 BLK 4 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Deparhnent of Safety and Inspecrions on or before April 2, 2007, the following are the now known interested or responsible parties for the Subject Property: Bank Of New York Trust Co/Co Homecomings Fin LLC, 9350 Waxie Way, San Diego, CA 92123; Shapiro, Nordmeyer & Zielke, LLP, 7300 Metro Blvd, Suite 390, Edina, MN 55439; West Side Citizens Organization. WAEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated November 6, 2007; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subj ect Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by December 6, 2007; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings befare the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties haue been served notice in accardance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, February 26, 2008 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Subject Property safe and not detrimental to the �•, � � 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 public peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure in accordance with all applicable codes and ordinances, or in the alternarive by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen (1� days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday March 19, 2008 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testunony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 861 ST ANTHONY AVENUE. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. 3. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). � 7 That the deficiencies causing this nuisance condition have not been corrected. That Deparhnent of Safety and Inspections has posted a placard on the Subject Property which declazes it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buildings. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal propefty is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. FURNACE: Have a licensed heating contractor service and clean the furnace or boiler and make any necessary repairs. Perform a C/O test on the heating plant. The stairs have missing or defective handrails. Properly install and maintain all light fixtures. 19. The toilet in bathroom on 2" floor is broken. Replace toilet. 20. The water heater has a rusted vent and particulates around the top of the unit. Have unit serviced and checked for back-drafting and replace the vent. 21. There is improper plumbing trap under the kitchen sink. Replace trap. 22. The cabinet for the kitchen sink has water and rot damaged. Replace cabinet. As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by December 6, 2007 the Department of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the building(s). Ordering the owner to remove or repair the building(s) at 861 St. Anthony Avenue within fifteen (15) days from adoption of resolution. The property owner of record, Bank of I3ew York Trust Co, did not appear. Karen Gray and Nora Hall appeared and stated that they had purchased the property at auction and closed on the purchase on January 23, 2008. Mr. Magner stated the building was a two-story, wood frame, single-family dwelling on a lot of 4,356 squaze feet and had been vacant since June 12, 2007. A code compliance inspection had been done on February 22, 2008, the vacant building registration fees were current, and the $5,000 performance bond was posted on February 22, 2008. On October 3, 2007, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on November 6, 2007 with a compliance date of December 6, 2007. To date, the property remained in a condition which comprised a nuisance as defined by the Legisiative Code. Ramsey County Tasation estimated the market value of the land to be approximately $36,500 and the building to be $113,400. Real estate taYes were current. Code Enforcement estimates the cost to repair the building to be approximately $70,000 to $80,000. The cost for demolition was estimated to be approximately $8,745 to $11,745. There had also been five summary abatements issued to this property since 2007, two of which went to work order: to secure the building and the City had to boazd the building to secure it from trespass, remove improperly stored refuse, and remove snow and ice. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner stated that he had conversations with the new owners and they have indicated that they intend to rehabilitate the building. He presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building had not been inventoried as it was north of I94. According to her records, the building was built in 1889; however, there was a permit lisring 1885, and was a worker-cottage style building. There was a loss of integrity to the exterior of the building and there was no significant architectural features. Ms. Hall stated that they received a copy of the code compliance inspection report on February 22 and paid the performance bond at that time. They had meetings scheduled with contractars this week to get bids on getting the work done. Once they have those bids, they planned to apply for a construction loan with Wells Fargo. Once they had the loan, they planned to rehab the building and rent it out. She explained that when they bought it at auction, they did not have the opportunity to go into the building and were unaware of the extensive damage to the interior. They were also unaware that the building was listed as a Categary III vacant building and what work would be involved to bring it up to code. Ms. Moermond asked that when they closed on the purchase, whether they were made awaze that there was an arder to abate a nuisance building for this property and that the City intended to demolish the building if someone did not bring forward plans to repair. Ms. Gray stated that they saw the sigis posted on the building; however, no one informed them of the orders on the building until after the closing. Mr. Magner stated that when the order to abate a nuisance building is mailed out, they placard the building which states that the building was subject to demolition. February 26, 2008 Legislative Hearing Minutes � 36 � Page 7 Ms. Moermond stated that it is incumbent upon the seller to provide the information that the building was subject to demolirion and it was not the City's responsibility to let them know. She stated that she would require a work plan, to be done in accordance with the code compliance inspection report, and they would also need to provide financial documentation indicating that they had dedicated funds available to complete the project. Ms. Hall stated that they were going to give their coniractors a copy of the code compliance report and ask that they write their bids in accordance to the report. They would then go to Wells Fargo to apply for the construction loan. She stated that they had rehabilitated other properties; however, they had never done a Category III building before. Ms. Moermond asked what properties they had done. Ms. Gray responded that they had rehabbed 1213 Summit Avenue which is a duplex and they have their business at the property. Ms. Moermond stated that the following must be submitted by Wednesday, Much 12: 1) an approved work plan; and 2) financial documentation.
