1 WIIEREAS, Department of Safety and Inspections has requested the City Council to

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before April 2, 2007, the
following aze the now known interested or responsible parties for the Subject Property: Sason
Mortgage Services, INC, 4708 Mercantile Drive, Fort Worth, TX 76137; Benjamin V Hanf, 340
S. 4�' St, Bayport, MN 55003; First Franklin Financial Corp, 2150 N 1 St, San Jose, CA 95131;

WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated November 6, 2007; and
WI3EREAS, this order informed the then lrnown interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this arder informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by December 6, 2007; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties haue been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Councii on Tuesday, February 26 and March 11, 2008 to hear testimony and evidence,
and after receiving testimony and evidence, made the recommendation to approve the request to

order the interested or responsible parties to make the Subject Property safe and not detrimental
to the pubiic peace, health, safety and welfare and remove its blighting influence on the
community by rehabilitating this structure in accordance with all applicable codes and
ordinances, or in the alternative by demolishing and removing the structure in accordance with
all applicable codes and ordinances. The rehabilitarion or demolition of the structure to be
completed within fifteen (1� days after the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday
March 19, 2008 and the testunony and evidence including the acrion taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 164 ROBIE STREET WEST.

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollass ($5,000.00).
That there now exists and has existed multiple Housing ar Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Deparhnent of Safety and

That the laiown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fixlfilled.

ff the above conective action is not completed within this period of time Depariment of
Safety and Inspections is hereby authorized to take whatever steps aze necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is fiirther ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The property was re-inspected on December 14, 2007. There was no compliance and the
nuisance condition remains unabated, the community continues to suffer the blighting influence
of this property. It is the recommendation of the Department of Safety and Inspections that the
City Council pass a zesolurion ordering the responsible parties to either repair, or demolish and
remove this building in a timely manner, and failing that, authorize the Department of Safety and
Inspec5ons to proceed to demolition and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taces.

The building is a two-story, wood frame, duplex on a lot of 5,227 square feet.
According to our files, it has been a vacant building since June 18, 2007.
The current property owner is Saxon Mortgage Services, Inc., per AMANDA and Ramsey
county property records.
I he city has had to board this building to secure it from trespass.
I here have been eight (6) SUMMARY ABATEMENT NOTICES since 2007.
There have been six (6) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of tall grass and weeds
- Removal of snow and ice
On October 17, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An OKDER TO
ABATE A NUISANCE BUILDING was posted on November 6, 2007 with a compliance date of
December 6, 2007. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
1'he Vacant Building registration fees are delinquent in Yhe amount of $250.00.
Taxation has placed an estimated market value of $47,400 on the land and $192,300 on the
building.
As of February 25, 2008, a Code Compliance inspection has not been completed.
As of February 25, 2008, the $5,000.00 performance bond has not been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $80,000 to $90,000. The
estimated cost to Demolish is $11,900 to $15,900.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution autharizes
the Division of Code Enforcement to demolish and assess the costs to the property.

The Vacant/Nuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enfarcement, hereby declares the premises located at:

and legally described as follows, to wit:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code,
Chapter 45.02, and subject to demolition under authority of Chapter 45.11.
On October 17, 2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of de�ciencies is not necessarily all the deficiencies present at this
time. As first remedial action, a Code Compliance Inspection must be
obtained from the Building Inspection and Design Section, S Fourth Street
East, Suite 200, Commerce Building (651)266-9090. That inspection will
identify specific defects, necessary repairs and legal requirements to
correct this nuisance condition. You may also be required to post a five
thousand dollar ($5,000.00) performance bond with the Building
Inspection and Design Office before any permits are issued, except for a
demolition permit.

This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter
33.03 and shall not again be used for occupancy until such time as a Certificate
of Compliance or a Certificate of Occupancy has been issued.
This is a two story, wood frame duplex.
1. The bathroom floor covering is deteriorated ar inadequate. Provide
floor covering which is impervious to water and easily cleanable
throughout the bathroom and seal around the edges and fixtures.
2. The chimney is defective, deteriorated or in a state of disrepair. Replace
all missing or defective bricks, tuckpoint as needed to restore the
chimney to a professional state of maintenance and repair. Permit may
be required.
3. Lack of Electricity. Immediately restore elecTrical service. Failure to
provide proper electrical service will result in these premises being
declared Unfit for Human Habitation and ordered vacated for lack of
this basic facility. Use of candles, fuel operated lighting or extension
cord wiring is not permitted while the power is off.
4. The foundation is deteriorated, defective or in a state of disrepair.
Repair all foundation defects in a professional manner to a
weather-tight, water-tight and rodent-proof condition. Permit may be
required.
5. FURNACB: Have a licensed heating contractor service and clean the
furnace or boiler and make any necessary repairs. Perform a C/O test on
the heating plant. Then, send the attached form back to the Inspector.
Repair of gas fired appliances requires a permit.
6. Lack of Natural Gas Service. Immediately restore natural gas service.
Failure to provide natural gas service will result in these premises being
declazed Unfit for Human Habitation and ordered vacated for lack of
this basic facility.
7. G.F.C.I.: The bathroom is lacking an elecTrical G.F.C.I. outlet. Permit
May Be Required.
8. The stairs have missing or defective handrails. Provide all interior and
exteriar stairways and steps of more that three (3) risers with handrails
which are grippable and installed 34" to 38" above the nose of the stair
treads.
9. The interior ceilings are defective. Repair all ceiling defects and finish
in a professional manner.

10. The interior walls are defective. Repair all wall defects and finish in a
professional manner.
I 1. There is evidence of a rodent infestation. Immediately exterminate and
eliminate all rodents from the entire building. Remove rodent
hazborages in the yazd areas. Tuckpoint the foundation if necessary to
rodent-proof the building to prevent re-infestation. Immediately remove
any dead rodents from the premises.
12. The roof is deteriorated, defective, or in a state of disrepair. Repair or
replace the roof covering to a sound, tight and water impervious
condition. Permit may be required.
13. Smoke Detector: Lack of properly installed and operab]e smoke
detector. Provide functioning smoke detectors in accordance with the
attached requirement, within 24 hours.
14. The structure is a registered vacant building and must have a Code
Compliance Certi�cate before the structure may be occupied.
Immediately vacate the structure or obtain a Code Compliance
Certificate from L.I.E.P. You may contact Jim Seeger at L.LE.P. for
code compliance inspection, permits, and issuance of Code Compliance
Certificate. Under Chapter 33.03 of the Saint Paul Legislative Code,
failure to obtain a Code Compliance Certificate or to vacate the
sh may result in issuance of criminal summonses.
15. The structure is a registered vacant building and must have a Certificate
of Occupancy before the structure may be occupied. Immediately
vacate the structure or obtain a Certificate of Occupancy from the Fire
Deparhnent, Fire Prevention. You may contact Pat Fish for team
inspection and issuance of Certificate of Occupancy.
16. The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for a11 openable
windows and doors. Screens must be tight-fitting and securely fastened
to the frames.
17. The windows and/or storm windows are in a state of disrepair. Replace
all missing or broken window glass. Make all necessary repairs to
frames, sashes, hardware and associated trim in a professional manner.
Permit may be reqtrired.
18. There is improper gas piping to the water heater and furnace. Properly
install gas piping. Permit required.
19. There are unlevel, water damaged, warped floors. Repair floors in a
worlananlike manner. Permit required.

20. The interior is partially gutted resultin� in open and/or missing
plumbing lines and fixtures, open, exposed electrical wiring and/or
fixtures, uncapped gas line, open heating vents. This work was done
without permits. Obtain a code compliance inspection report and a
certificate of occupancy inspection report (for rental properties) and
make all necessary repairs under required permits. (see deficiency
number 14 and 15)
As owner, agent or responsible party, you are hereby notified that if these deficiencies and
the resulting nuisance condition is not conected by December 6, 2007 the Departinent of
Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement
process to demolish and remove the building(s). The costs of this action, including
administrative costs and demolition costs will be assessed against the property taxes as a
special assessment in accoxdance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce
Building (651)266-9090. This inspection will identify specific defects, necessary repairs
and legal requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
discloswe of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners. If you sell, transfer, or convey in any manner, the
ownership or responsibility for this property, you must within seven (7) days, notify the
Enforcement Officer with the names and adciresses of any new owners or responsible
parties.
The Enforcement Officer is required by law to post a placard on this property which
declares it to be a"nuisance condition", subject to demolition and removal by the City.
This placard shall not be removed without the written authority of the Department of
Safety and Inspections, Aivision of Code Enforcement. The department is further
required to file a copy of this "Order to Abate° with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement
Officer will notify the City Council that abatement action is necessary. The City Clerk
will then schedule dates for Public Hearings before the City Council at which time
testimony will be heard from interested parties. After this hearing the City Council will
adopt a resolution stating what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take
the abatement action or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul L,egislative Code and
provide that if correcrive action is not Yaken wittvn the specified time, the Ciry shall abate
this nuisance. The costs of this action, including administrative costs will be assessed
against the property as a special assessment in accordance with law.

1. Install landing to code at east entry.
2. Install handrail and guardrail to code at front door.
3. Install proper storm window over front doar and inside lights to meet code.
4. Repair all siding and trim that is coming loose and install trim around roof edge at
fascia.
5. Totally gut first floar and jack up house center beam to straighten structure, properly
support all load points to code with proper center beam and post and footings.
6. Install common area for electric panels or move second floor electric panel to second
floor area.
7. Second floor unit off limits to basement unless basement is one hour fire rated.
8. Rear lower roof needs replacement.
9. Repair and relevel stair landing to second floor (sloping).
10. Insure basement cellar floor is even, is cleanable, and all holes are filled.
11. Install provide hand and guardrails on all stairways and steps as per attachment.
12. Strap or support top of stair stringers.
13. Install plinth blocks under posts in basement.
14. Tuck Point interior/exterior foundation.
15. Install floor covering in the bathroom and kitchen that is impervious to water.
16. Install twenty minute fire-rated doors, with a self-closing device, between common
azeas and individual units.
17. Provide thumb type dead bolts for all entry doars. Remove any surface bolts.
18. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty
etc. as necessary.
19. Provide storms and screens complete and in good repair for all door and window

7. Ordering the owner to remove or repair the buiiding(s) at 164 Robie Street West within
fifteen {15) days from adoprion oFresolution.
The property owner of record, Sason Mortgage Services, Inc., did not appear. Benjanun Hanf
appeared and stated that he owned the pmperty and had a purchase agreement with a potential
buyer.
Mr. Magner stated tYie building was a two-story, woad frame, duplex on a lot of 5,227 squaze feet
and had been vacant since 7une 18, 2007. A code compliance inspection had been done on
February 22, 2008. The vacant buildin� registration fees were delinquent in the amount of $250
and the $5,000 performance bond had not been posted. On October 17, 2007, an inspection of the
building was done and a list of deficiencies which constitute a nuisance condition was developed.
An order to abate a nuisance building was posted on November 5, 2007 with a compliance date of
December 6, 2007. To date, the property remained in a condition which comprised a nuisance as
defined by the Legislative Code. Ramsey County Taxarion estimated the market value of the land
to be approxirnately $47,400 and the building to be $192,300. Real estate taxes ware current. Code
Enforcement estimates the cost to repair the building to be approximately $80,000 to $90,000. The
cost for demolition was estimated to be approximately $11,900 to $15,900. There had aiso been six
surmvary abatements issued to this pmperty since 2007, six of which went to work order: to secure
the,building and the City had to boazd the building to secure it from trespass, remove improperly
stared refuse, cut tall grass and weeds, and remove snow and ice. Code Enfarcement recommends
the building be repaired or removed within 15 days. Mr. Magner stated ttiat he had na contact with
any owner on this property and according to the inspector, the building was again open to access. A
work order had also been sent to Parks at the beginning of February to ciean the sidewalk and it was
apparent that the property was not being maintained. He presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was buiit in
1895 and the property next to it appeazed to be on the same parcel. According to the permits, the
same builder and owner had built both properties. There had been many alterations to the building
since 2006, including the removai of the porch without a permit, which lead to a loss of historic
integrity to the exterior of the building.
Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner stated that
the Fire inspector for this area referred this property to the Vacant Buildings Program. At that time,
the utilities were off and the building was vacant.
Mt. Hanf said that the sheriff sale for the second lender occurred at the end of 2007 and he believed
the redemprion period would expire in April. He was in the process of negotiating with the two
lenders to accept the bid he had received to purchase the property. He presented a copy af the
purchase agreement. He stated that the code compliance inspection report was done last week and
the buyer was aware of the repairs that would be necessary to bring the property up to code. He
wanted to know what the Ciry would require in order for the new buyer to be able to rehabilitate the
building. The closing date, however, had not been scheduled as he was still negotiating with the
lenders.
Mr. Magner stated that he had concern that the new owner understands the conditions that are
required in arder to rehabilitate the property. He suggested the hearing be continued for the new
owner to attend. He stated that it was up to the second lender to acquiesce to the sale of the

property or whether they wished to proceed with the foreciosure on the property.

Ms. Moermond stated that she would reqnire the following: 1) the vacant building fees would need
to be paid and the regisiration form filled out; 2) the performance bond would need to be paid; 3}
the praperty needs to be maintained; 4) an appmved work plan must be received; and 5) financial
documentation indicating the ability to complete the rehabilitation. Ms. Moermond stated that she
would also need the ciosing documents or a purchase ageement.

The following appeared: James Yacoub, Weichert Realtors; Matthew Boulos, purchaser; and
Daniel Seidel, purchaser.
The following neighbors appeared:
Sasha Aslanian, 126 Robie Street West;
Dennis O'Hare, 157 Robie Street West; and
Brad Schleeter, 163 Robie 3treet West.
Mr. Magner stated that at the last hearing, he indicated to Mr. Hanf that the rear window was broken
on the house which needed to be boarded. He was unsure whether this had been resoived. Mr.
O'Hare responded that the window had not yet been boarded.
Mr. Magner and Ms. Spong read reports into the record from the February 26 Legislative Hearing.
Mr. Boulos presented a purchase agreement, letter of finance, a work pian, and financiai
documentation. He stated that the closing was contingent upon the granting of time to complete the
rehab to the property. He said that after going through the house, it was their intention to convert it
back to a single-family dwelling. The interior had been totally gutted and new electrical, plumbing,
and mechanicals would need to be done. He had talked to 7im Seeger concerning the issue with the
foundation and Mr. Seeger indicated to him that if would need to be re-leveled. He believed that
when the rehab was complete, it would be a nice, single-family home and would be an asset to the
neighborhood.
Ms. Moermond stated that in reviewing the documents, it appeared that there was adequate funding,
which had been escrowed, to complete the rehab. She asked Mr. Magner to review the documents.
Mr. Magner stated tYtat the cost estimate was not too far off from the City's estiinated cost of the
repairs. However, the code compliance indicates that major re-leveling was necessary and couid be
more costly depending upon the alterations that need to be made. He said that he would need
additionai time to review all of the documents.
Mr. Schleeter stated that his house was across the street from this property whicl� he had moved into
in July, 2007. Since that time, it had been vacant and the property was not being maintained. His
concern was that the new buyer would bet the property rehabbed in accordance with the code in a
timely manner.
Mr. O'Hare presented pictures of the property. He stated that he lived across the street from this
property and had lived there since 1991. This had been a rental property ever since he had maved
in and every owner had said they wouid do something and they hadn't. It was his information that
there were no bedrooms on the first floar and he was happy to hear that the new buyer intended to
convert the building into a single-family dwelling. He was concerned that the new buyer would be
able to complete the repairs. He had friends who were in the rehab business who looked at the
honse and had refused to buy it because of the foundation work that was required. The property had
been abandoned since the siumner, 2007, and the owner, Ben Hanf, never retumed any of his phone
calls.

Ms. Asianian stated that she lived down the street from this property and it was her opinion that this
house was an eyesore. She sai@ that she was skeptical that a new buyer would make the invesiment
into rehabbing the property given the amount of repairs that were necessary. She had taIked to one
of the neighbors who lived next door to this properiy, Jill Berchel, who had four small children. Jill
had indicated to her that the house had again been broken into w}uch had been a repeated problem.
Jill told her that she was concerned about work being dona without permits when the porch was
pulled aff the house which caused a gas leak and forced her to evacnate her house.
Mr. Boulos responded that he understood the neighbors concerns as they didn't irnow him or his
reputation of doing this type of rehabilitation to properties. He said that they had rehabbed seveial
properties in St. Paul and understood the code compliance process in completing the rehab. He said
that if they didn't believe it was worth the investment to bring this building up to code, they
wouldn't be willing to do the rehab. It was his opinion that if the rehab were done properly and the
property was maintained properly, if would be an asset to the neighborhood.
Mr. O'Hare asked what the plans were for the front of the house and when they planned to have the
work done. Mr. Boulos responded that they intended to do major landscaping to the property to
keep the water out offhe basement. He believed they would have the rehab completed by the
beginning ofMay.
Ms. Moermond stated that she had concern with the foundation work that would need to be done.
Mr. Boulos responded that the there was a large post that went up through the middle of the house
and it appeared that the house had settled around the middle of the house. In lus conversation with
Mr. Seeger, he believed that the foundation was in good condition and that what would be required
was to re-level the house. It was his understanding that there had been a double-decker porch on the
front of the house that had been removed. It was theix intention to put an open, front porch on the
house; however, iY would not be a double-decker porch.
Mr. Magner suggested that Mr. Boulos work with Ms. Spong to see what type of porch had been on
the front of'the building so that they could restoxe it to a similar sryle.
Ms. Moermond stated that in order to grant fhe fime to complete the rehab, the following conditions
wouid need to be met: 1) the vacant building fees must be paid; 2) the registration must be
completed; 3) the performance bond needed to be posted; and 4) the property must be maintained.
She stated that the financing to complete the work was in escrow wluch she would accept and the
work plan would need to be reviewed before she would accept it. If the conditions were met, she
wonld recommend granting 180 days to complete the rehabilitarion.
Recommendation is forthcoming.

On February 19�' residents with properry in close proximiry to 164 W. Robie St.
addressed the West Side Citizens Organization (WSCO) Buiiding aud Land Use (BLL�
Committee. And requested support urging the City of St. Paul move fonvard with the
process to condemn and demolish the vacant property. Discussion with residents
xequesting support for demolition determined the following:
• There have been several owners.
• The condition of the property has prompted nei�hhbors to report it to the Dept. of
Heaith for rentai violations.
• It has remained vacant for an extensive amount of time.
• Post foreclosure two contractors have backed ont of purchasing the properiy after
inspecting it.
• The last habitants to rent tfie properly were undocumentecl workers, and had to be
removed due to health and sanitation reasons.
• Members of the BLU Committee have looked at the property, and are of the
unqualified opinion the property is uni�abitable.
• It has been determined by the City of SY. Paul to be abandoned since Juae 2" ,
2007
• There were no residents speaking against demoliuon of the properry.
Accordiug Brad Schleeter, one of the residents peti6oning the committee, fhere was
communication with yau in January, and informed a letter was sent to the owner
regarding an upcoming legislative heazing to determine the future of the property. The
BLU agreed with the residen#s, and vofed in favor of the condemnaiion and demolition of
the property at 154 W. Robie St. We aze urging o�ciats of the Legislative Hearing to

come to the same conclusion, and place tha property on the slate for demolition as soon
as possible.
