' WHEREAS, The Board of Water Commissioners by its resolutioz� adop�ed
6 September 1961 apprqved and directed the execution of a Quit Claim
Deed to the City of Saint Paul for an aasement 100 feet in width for
th.e purpose of opening, widening and extending of Cook Avenue, i�.
Hillsdale, St. Faul, over and across the Board=s Phalea Main right of ,
way, said strfp of land having been condemned and appropriated for said
purpose according to the Council's File Number 202677 approved June 21,
1961,. a certi,fied copp o£ said rasolution being annexed hereto and by
this reference madE part hereof the same as if set forth herei�, verbatim,

RESOLOID� By the Council of the City of Saint Paul, that said actioz� of
the Board o£ Water Commissioners be and the same hereby is approved and
ratified, and the propar city officerS are hereby authorized to �aq the
award of damage made by condemnation proceedin.gs in the sum of $300.00
to the Board of Water Commi.ssioners of St. Paul, Minnesota.

WHSREAS, The Advance Construction Company heretafore has requested permi.asion for
a public road crossing over the Phalen Main Right of Way at Cook Avenue in Hillsdale,
St. Paul; and
WHSREAS, Tlte Board of Water Commissioners by its action of 11 January 1961 approved
aaid reqnest and the Council of the City of Saint Paul by its Preliminarq Order
200933 approved 21 Februarq 1961, Intermediary Order 201574 approved 13 April 1961
and Final Order 201998 approved 9 May 1961 has condemned and appropriated a 100 feet
wide atrip og land over and across said Right of Way for the purpose of opening,
widening and extending of Cook A��enue to accomplish the establiahing of aaid public
road over st�id right of Way and haa set_f300.00 as the consideration or award to be
paid to the Board for an easement to sa�d 100 foot wide strip of land for said
public road over snd acrosa said right of way; and
WA�tFAS, The Generel Manager Leonard N. Thompson has presented a form 6t Quit Claim
Deed providing for the grent of said easement, as requested by the City Comptroller,
NOGI, THPREFORE, B$ iT
&$SOLVED, By the Board of Water Commissioners, that said form of Quft Claim Deed be
and it hereby is approved in all things and that fihe proper ofPicers of the Board
ahall be and they hereby are authorized and directed to execute said Deed fQr end
in behalf of the Board� and BE IT F(JRTHER
RESOLVED, That th� honorable Cfty Council be requeated to approve and ratffy this
action of the Board of Water Commissioners and to authorize and direct the execution
of �aid Deed for and in behalf of the City of Saint Paul.
