1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wreclang
3 and removal of a rivo story, wood frame dwelling with a one stall, detached garage located on
4 property hereinafter refened to as the "Subject Property" and commonly lrnown as 98 GEORGE

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Depariment of Safety and Inspections on or before April 2, 2007, the
following are the now known interested or responsible parties for the Subject Property: Lasalle
Bank Nat Assoc Trustee/Co Chase Home Finance, 10790 Rancho Bernardo Rd, San Diego, CA
92127; Andrea Lee/Frank Mauricio, 98 Georg St. E., St. Paul, MN 55107; Peterson, Fram, &
Bergman PA, 50 E. 5` St, #300, St. Paul, MN 55101; West Side Citizens Organization.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated November 6, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
shucture located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
ar demolish the structure located on the Subject Property by December 6, 2007; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspecrions requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served norice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, February 26 and March 11, 2008 to heaz testimony and evidence,
and after receiving testimony and evidence, made the recommendation to approve the request to

order the interested or responsible parties to make the Subject Property safe and not detrimental
to the public peace, health, safety and welfaze and remove its blighting influence on the
community by rehabilitating this structure in accordance with all applicable codes and
ordinances, or in the alternative by demolishing and removing the structure in accordance with
all applicable codes and ordinances. The rehabilitation or demolition of the structure to be
completed within fdteen (15) days after the date of the Council Hearing; and
WI�REAS, a hearing was held before the Saint Paul City Council on Wednesday
March 19, 2008 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 98 GEORGE STREET EAST.

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollazs ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subj ect Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
That the laiown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighring influence on the community by rehabilitating this structure and correcting all

deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
*���� one hundred-ei¢htv (180) days after the date of the Council Hearing.
If the above corrective action is not completed within this period of tune Department of
Safety and Inspections is hereby authorized to take whatever steps aze necessary to
demolish and remove tlus structure, fill the site and chazge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The Department of Safety and Inspections has declazed this building(s) to constitute a"nuisance"
as defined by Legislative Code, Chapter 45. The Department of Safety and Inspections has
issued an order to the then known responsible parties to eliminate this nuisance condition by
correcting the deficiencies or by razing and removing this building(s).
The property was re-inspected on December 6, 2007. There was no compliance and the nuisance
condifion remains unabated, the community conrinues to suffer the blighting influence of this
property. It is the recommendation of the Department of Safety and Inspections that the City
Council pass a resolufion ordering the responsible parties to either repair, or demolish and
remove this building in a timely manner, and failing that, authorize the Department of Safety and
Inspections to proceed to demolition and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taxes.

The building is a two-story, wood frame, single-family dwelling with a detached one-stall garage
on a lot of 6,098 square feet.
According to our files, it has been a vacant building since January 10, 2007.
The current property owner is LaSalle Bank NA c/o Chase Home Finance, per AMANDA and
Ramsey county property records.
I�he city has had to board this building to secure it from trespass.
There have been six (6) SUMMARY ABATEMENT NOTICES since 2007.
There have been four (4) WORK ORDERS issued for:
- Removal of improperly stored refuse and debris
- Removal of snow and ice
On October 11, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on November 6, 2007 with a compliance date of
December 6, 2007. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid.

On October 11, 2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this
time. As first remedial action, a Code Compliance Inspection must be
obtained from the Building Inspection and Design Section, 8 Fourth Street
East, Suite 200, Commerce Building (651)266-9090. That inspection will
identify specific defects, necessary repairs and legal requirements to
correct this nuisance condition. You may also be required to post a�ve
thousand dollar ($5,000.00) performance bond with the Building
Inspection and Design Office before any permits are issued, except for a
demolition permit.

33.03 and shali not again be used for occupancy until such time as a Certificate
of Compliance ar a Certificate of Occupancy has been issued.
This is a tv✓o-story, wood frame dwelling with a one stall, detached garage.
This is a category 3 registered vacant building with a pending code compliance
inspecrion report. Please see the attached for a complete list of deficiencies.
BUILDING
1. Insure basement cellaz floar is even, is cleanable, and all holes are filled.
2. Install Provide hand and guardrails on all stairways and steps as per attachment.
3. Strap or support top of stair stringers.
4. Install plinth blocks under posts in basement as needed and replace decoyed
post.
5. Tuck Point interiosfexterior foundation.
6. Install floor covering in the bathroom and kitchen that is impervious to water.
7. Install tempered glass in window on stair landing.
8. Install tempered glass in window over bathtub.
9. Provide thumb type dead bolts for all entry doors. Remove any surface bolts.
10. Repair or replace any deteriorated window sash, broken glass, sash holders, re-
putty etc. as necessary.
11. Provide storms and screens complete and in good repair for all door and
window openangs.
12. Repair walls and ceilings throughout, as necessary. Re-level structure as much
as is practical.
13. Where wall and ceiling covering is removed, attic, replace doors and windows,
(insulation, glass, weather stripping, etc.) shall meet new energy code
standards.
14. Prepare and paint interior and exterior as necessazy (take the necessary
precautions if lead base paint is present).
15. Habitable rooms with new usage, replaced windows shall have glass area equal
to 8% of floor area, or a minimum of 8 sq. ft., one-half of which shall operate
and all bedroom windows shall meet emergency egress requirements (20" wide
minimum, 24" high minimum but not less than 5.7 sq. ft. overall).

As owner, agent or responsible party, you are hereby notified that if these deficiencies and
the resulting nuisance condition is not corrected by December 6, 2007 the Deparhnent of
Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement
process to demolish and remove the building(s). The costs of this action, including
administrative costs and demolition costs will be assessed against the property t�es as a
special assessment in accordance with law.

2. Ordering the owner to remove or repair the building(s) at 98 Georee Street East within
fifteen (15) days from adoption ofresolution.
The property owner of record, LaSalle Bank NA c/o Chase Home Finance, did not appeaz. No
other parties of interest appeared.
Mr. Magner stated the building was a two-story, wood frame, singIe-family dwelling with a
detached one-stall gazage on a lot of 6,098 square feet and had been vacant since January 10, 2007.
A code compliance inspection had been done on 7uly 27, 2007. The vacant building registrarion
fees were current and the $5,000 performance bond was posted on February 14, 2008. On October
11, 2007, an inspection of the building was @one and a list of deficiencies which constihzte a
nuisance condition was developed. An order to abate a nuisance building was posted ou November
6, 2007 with a compliance date of December 6, 2007. To date, the property remained in a condition
which comprised a nuisance as defined by the Legislative Code. Ramsey County Taacation
estimated the muket value of the land to be approximately $53,700 and the building to be
$128,900. Real estate taxes were current. Code Enforcement estimates the cost to repair the
building to be approximately $65,000 to $75,000. The cost for demolition was estimated to be
approximately $9,500 to $12,500. There had also been six summary abatements issued to this
property since 2007, four of which went to work order: to secure the building and the City had to
board the building to secure it from trespass, remove improperly stored refuse, and remove snow
and ice. Code Enforcement recommends the building be repaired ar removed within 15 days. Mr.
Magner stated that he had talked to the new property owner, Rolando Aguilar Estrada, twice and
told him that it was imperative that he attend this hearing. He was aware that permits had been
pulled He went by the property the previous day and there was a dumpster and it appeated Mr.
Estrada was in the process of rehabilitating the structure. Mr. Magner presented photographs of the
property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was an
1886 Victorian-era house designed by architects Telts and Joy. She stated that Chasles 7oy was a
prominent architect who designed many homes in the Dayton's Bluff Neighborhood and possibly a
few in the Hill District. She noted that this building was a few blocks from the Riverview Library
which was a designated historic struchue in addition to 1 George Street. There were some
predominant Victorian-era houses along George Street, including several double houses. The
property had been inventoried given the status of the azchitect and the form done in 1983 states that
"it was once an omate Victorian house; butchered through remodeling." Unless this building went
through a restaration as opposed to remodeling, this house would not meet the local or national
historic criteria
Mr. Magner stated that it was imperarive Mr. Estrada attend a hearing to present a work plan and
financial documentation. He stated he had indicated this to him in his conversation that he needed
to present this documentation.
Ms. Moermond recommended laying this over to March ll Legislafive Hearing.

Rolando Aguilar Estrada, property owner, presented financial documentation and a work plan.
Ms. Moerxnond and Mr. Magner reviewed the documents. Ms. Moermond stated that in reviewing
the financial documentation, she would need to see a written commiUnent that this amount of
financing was being dedicated for this project. She said that this could be in the form of an affidavit
or setting the funding aside in an escrow account. In reviewing the letter from the accountant, he
indicated that the information was mcomplete as it was lacking full disclosure and it was her
preference that he set aside the financing in an escrow account. If he intended to provide an
affidauit dedicating the funding, she would also require that he provide signed contracts with the
subcontractars. She stated that she and Mr. Magner would need additional time to review the work
plan and would need to get back to him if they needed additional information. She said that she
recalled Mr. Estrada had attended a previous hearing on a property that he was rehabbing. She
asked hitn the address and where he was in completing that project.
Mr. Estrada responded that he was working on 898 Albemarle and the project was almost complete.
It was his intention to have the landscaping to the exterior completed within the next three to four
weeks.
Recommendation is forthcoming.
