WHES.EAS, the City of Saint Paul, by its Ordinance
No. 11905, bearing Council File No. 200�31, duly enacted by
its Council and approved by its Mayor February 2, 1967., pro-
vided therefor and authorized the issuance and sa7.e bp, said
City of the bonds of said City in the par value amoun.t of
Seven Million Three Hundred Fifty Thousand Dollars (�7,350,000.00) ,
. authorized by Chapter �;38, 'Session Laws �of Minnesota, for 1959, .
for the purpose of the procurement by said City of funds in the
. amount of Seven Millio.n Three Hundred Fifty Thousand Dollars
��7,350,000.00) ," for 'the. payment of said City's advances to the
• ' State of Minnesota, the latter acting in the premises by and
through its Commissioner of Highways, therefor and not to exceed

purposes under and pursuant to several Agreements made by and
between them, suthorized thereby and in. accordance with the
provisions, terms, and conditions of said Chapter 538, Session

WHEgEAS, Chapter 538, Session Laws of Minnesota for
1959, according to its p ertinent terms, became operative u.pon its
approval by ma�ority vote of the.Coun.cil of the City, evidenced
� by said Council's $esolution, Council File No. �192221, ado�ted
and approved the 7th day of May, 1959, .and the C'ertificate of
Yhe City Clerk of the City incorporating a Certif ied Copy of said
gesolution, the printer's affidavit of its official p�blica_
tion, and, all other_requisite data, filed with the Secretary of
State of the State of Minnesota on the 21st day of May, 1959,
in accordance with all provisions of the Statutes of said State
in such cases made and provided; and - •

of any State Trunk Highway, within the corporate limits of
the City, suthorized an agreement by and between the State
and the City whereunder and whereby the City shall agree,
in consideration of the undertaking of any such sub�ect State
Highway Project, by the State, at a time specified in such
' agreement, to advance cash or eng'ineering services, or both,
to the State in an amount not to exceed that part of the cost
of such State Trunk Highway Project which is to be borne by
the State, and. whereunder and wh�r'eby the State shall agree to
undertake and complete such State Trunk Hi�hway Pro�ect, and
to repay to the City the principal. amount of such advance,
' without •interest, from the State's Trunk Highway Fund, in cash
or by the issusnce and sale of bonds, by the State, under the
provisions of Article XVI, Section 7.2 of its Constitution, in
the amount of such advance to the 'State, in consideration of

WHEHEAS, said State, acting by and through its
Commissioner of Highways, and said City, under and by authority
of said Chapter �38, Session Laws of Minnesota for 1959, made
and e.ntered into that certain origin.al Agreement dated
January 25, 1960, and that certain Supplemental Agreement
amendatory of said original Agreement, dated November 29, 1960,
by and between said State and said City, mentioried in said
Ordinance No. 11905, whereunder and whereby said State did
� agree to undertake and complete two separate proposed State
-" Trunk Highway Pro�ects within said corporate limits, and to
make repayment to said City of the principal amount of all ad-
• vances thereby agreed to be made by said City to said State,
equivalent in a mount to that part of t he estimated cost of said
two separate proposed State Trunk Highway Projects, required
to be borne by said State and representative of fifty per cent
(50�) of such estimated cost, and to make such repayment to_
said_City by the issusnce and delivery to said City of said
bond.s of said State authorized under the provisions of Article
XVI, Section 12, of its Constitution; such advances by said
City being thereby provided to be made solely from the proceeds
of said City's issuance and sale of its bonds, suthorized to
be issued and sold for the purposes of such advances, under
and by the provisions of said Chapter 538, Session Laws of
, Minnesota for 1959, in the aggregate par value amount of
Seven Million Three Hun.dred Fifty Thonsand Dollars (�7,350,000.00) ,
representative of that part of the. estimated cost of, said pro- �

WHEBEAS, Heretofore necessary provisions were made
. therefor and said City duly issned and sold �1,250,000�00
par value of such authorized bonds, in the aggregate, for
the procurement of�necessary �,funds in said amoun.t for payment
by said City on account of the aforesaid advances by said
City to said State for said public purposes under and �ursuant
to said original Agreement as' amended by said Supplemental - -
Agreement, and. it is necessary that additional provisions be
made� for the issuance and sale, at this time � of an ad;ditional
Three Million Five Hundred Thousand Dollars �.�3,500,000.00) par
value of such suthorized bonds, by said City, . for the procure-
ment of necessary fun.ds in said amount by said City, for pay-
ment by said City oa account of the aforesaid advances by said
� City to said State for said public purposes under and pursuant
to said original Agreement as� amended by said Supplemental
Agreement, by -and between them, which contemplates and pro-
vides, among other things, for eligibility of each aforesaid
State Trunk Highway Project therefor and the grant of addi-
tional financing for the defrayment of the estimated "cost of

cost, by the Federal Government to the State, by authority and
pursuant to Chapter 1, Sectians 101 to 131 inclusive, Title 23,

said bonds shall bear a rate of interest. not to exceed five

that said bonds shall bear date the lst day-of October, �1961;
that said bonds shall be in the form of serial bonds, a por-
tion of which shall become payable each year after issue com-
mencing October l, 1964�; that the first installment of said
bonds shall come due three years from the date of the� same
and the last installment of said bonds shall come due in not
more than thirty (30) years from such date; that no annnal
- installment of principal of any of said bonds payable in any
calendar year after the date of the same shall exceed five
times the amount of the smallest prior in.stallment thereof
payable in any calendar year after the second calendar year;
