WHEREAS, in the matter of Comptroller L- 6232 -A for
the Grading and Sewer in Winona Street from Robert Street east to
Cul -de -sac, J. R. Walker Company, contractor, the specified date of
completion is August 15, 1961, and
WHEREAS, there were no extenuating circumstances for the delay
completing this Project, and the Inspection and Survey Crew Costs
incurred by the City of St. Paul because of the delay in completing
the work, are to be charged to the contractor, and
WHEREAS, the City of St. Paul waives all claim for liquidated
except additional actual costs incurred for engineering and survey
by the Department of Public Works, therefor be it
RESOLVED, that the proper City Officials be and they are hereby
authorized and directed to execute an amendment to said contract,
extending the time of completion to October 5, 1961, provided however
that this Resolution shall have no force or effect unless the Suretie
on the Contractorts Bond consent thereto in writing and file such
consent with the City Comptroller.
