The property is described as Lot 8 and the southeasterly 10 feet of Lot 7, Block 2, Point Douglas Addition. The zoning is 'W' residence. The site is developed with a single - family residence and the applican proposes to construct a 16 x 22 foot garage within five feet of Point Douglas Road. This is a triangularly shaped tract of land having a f age of 111.8 feet on Point Douglas Road and a depth of 120 feet along north property line resulting in a total area of approximately 6,708 feet. Northwest and adjoining are single- family.residences fronting Point Douglas Road, all set back 30 feet; northeast across said street a vacant tract; south and. across a public alley is a single - family re fronting on Burns Avenue and a commercial building used as an automob body shop which fronts on Point Douglas Road and Burns Avenue. Chapter 62 of the Zoning Code requires a minimum set back of 24 feet this block. In order to deviate from this, it is necessary for the cant to secure special council authorization. Field investigation d that the proposed garage can be built on this property and still wai the 24 foot set back requirement.. This can be accomplished by erect the garage so that the applicantcan drive in directly off Point Doug Road, or off the public alley adjoining his property. It is the opi of the Board that a hafdship does not exist and that the relaxation building line-to five feet as requested would be contrary to the int and purpose of the set back requirement, and would be detrimental to residences in the block.
