This properiy is legally described as follows, to wit: OAK VILLE PARK LOT 4 BLK 22 WHEREAS, based upon the records in the Ramsey County Recorder's Office and inforxnation obtained by Department of Safety and Inspections on or before March 31, 2008, the following are the now known interested or responsible parties for the Subject Property: Paul White, 724 7essamine Ave E, St. Paul, MN 55106; Paul White, PO Box 4184, St. Paul, MN 55104; Argent Mortgage Co, LLC, 2550 Go1f Rd, East Tower, 10` Floor, Rolling Meadows, IL 60008; Beneficial Loan and Thrift Co, 395 N. Robert St, #102, St. Paul, MN 55101; Payne Phalen District 5 Planning Council. WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated November 1, 2007; and WI3EREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair ar demolish the structure located on the Sub}ect Property by December 3, 2007; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspecfions requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Lea slarive Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislafive Hearing Qfficer of the Saint Paul City Council on Tuesday, February 12, 20U8 to hear testnnony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the � - �3S 41 42 43 44 45 46 47 4& 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 6� 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 interested or responsible parties to make the Subject Property safe and not detrimental to the pubiic peace, health, safety and welfare and remove its blighting influence on the community by rehabilitating this structure in accordance with all applicable codes and ordinances, or in the alternafive by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within fdteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, March 5, 2008 and the testunony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore Bfi IT RE50LVED, that based upon the testimony and evidence presented at the above referenced pubfic hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 724 JESSAMINE AVENUE EAST. 1. �� 3. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. � E:� That the deficiencies causing this nuisance condition have not been conected. That Department of Safety and Inspections has posted a placard on the Subject Property which declazes it to be a nuisance condition subject to demolition. That this building has been routinely monitared by Deparhnent of Safety and Inspections, Vacant/Nuisance Buildings. That the knawn interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. ••� • The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfaze and remove its blighting influence on the community by rehabilitaring this structure and correcting all � _ � e� 88 89 90 91 92 93 94 95 96 97 98 99 100 101 102 103 104 105 106 deficiencies as prescribed in the above referenced Ozder to Abate Nuisance Building(s) in accordance with all applicable codes and ordinances, or in the alternarive by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitarion or demolition and removal of the shucture must be completed within '���-'�� s' 60 days after the date of the Council Hearing. 2. If the above correcrive acrion is not completed within this period of tnne Department of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. 3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul sha11 remove and dispose of such properiy as provided by law. 4. It is fiirther ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. According to our files, it has been a vacant building since 7une 25, 2002. The current property owner is Paul White, per AMANDA and Ramsey county property records. There have been ten (10) SUMMARY ABATEMENT NOTICES since 2002. There have been five (5} WORIC ORDERS issued for: - Removal of tall grass and weeds - Removal of improperly stored refuse On June 15, 2007, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and ghotographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on November I, 2007 with a compliance date of December 3, 2007. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. Taxation has placed an estimated market value of $43,700 on the land and $106,000 on the building. As of January 22, 2003, a Code Compliance inspeation has been eompleted. As of November 30, 2007, the $5,000.00 performance bond has been posted. Real Estate taxes are cunent. Code Enforcement Officers estimate the cost to repair this structure is $30,000 to $40,000. The estimated cost to Demolish is $8,400 to $11,400. Prepare and paint interior and exterior as necessary (take the necessary precautions if lead base paint is present). 23. Any framing members that do not meet code (where wall and ceiling covering is removed, members that are aver-spanned, over-spaced, not being carraed properly, door and window openings that are not headered, etc.) are to be reconstructed as per code. 24. Habitable rooms with new usage, replaced windows shall have glass area equal to 10% of floor area, or a minimum of 10 sq. ft., one-half of which shall operate and all bedroom windows shall meet emergency egress requirements (20" wide minimum, 24" high minimum but not less than 5.7 sq. ft. ovexall). This property was inspected as being a single family residence. o ��z35 As owner, agent ar responsible party, you are hereby notified that if these deficiencies and the resulting nuisance condition is not corrected by December 3, 2007 the Department of Safety and Inspections, Davision of Code Enfozcement, will begin a substantial abatement process to demolish and remove the building(s). The costs of this action, including administrative costs and demolition costs will be assessed against the property taxes as a special assessment in accordance with law. As first remedial action, a Code Compliance Inspection Report must be obtained from the $uilding Inspection and Design Secfion, 8 Fourth Street, Suite #200, Commerce $uilding, (651)266-9090. This inspection will identify specific defects, necessary repairs and legal requirements to correct this nuisance condition. As an owner or responsible party, you aze required by law to provide full and complete disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and any subsequent owners. If you sell, h or convey in any manner, the ownership or responsibility for this property, you must within seven (7) days, notify the Enforcement Officer with the names and addresses of any new owners or responsible parties. The Enforcement Officer is required by law to post a placard on ttais property which declares it to be a'huisance condition", subject to demolition and removal by the City. This placard shall not be removed without the written authority of the Deparhnent of Safety and Inspections, Division of Code Enforcement. The department is further requ�ed to fi1e a copy of this "Order to Abate" with the Gity C1erk's Office. If conective action is not taken within the time specified in this order, the Enforcement Of&cer will notify the City Council that abatement action is necessazy. If the resolution calls for abatement action the Council may either order the City to take the abatement action or fix a time within which this nuisance must be abated in accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action is not taken within the specified time, the City shall abate this nuisance. The property owner of record, Paul White, appeared. Mr. Magner stated the building was a two-story, wood frame, single-family dwelling on a lot of 4,792 square feet and had been vacant since June 25, 2002. A code compliance inspection had been done on January 22, 2003. The vacant building registration fees were current and the $5,000 performance bond had been posted on November 30, 2007. On 7une 15, 2007, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on November 1, 2007 with a compliance date of December 3, 2007. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxarion estimated the muket value of the land to be approximately $43,700 and the building to be $106,000. Real estate taxes were current. Code Enfarcement estimates the cost to repair the building to be approximately $30,000 to $4Q000. The cost for demolition was estimated to be approximately $8,400 to $11,400. There had also been 10 summary abatements issued to this property since 2002, five of which went to work order: remove improperly stored refuse, and to cut tall grass and weeds. Mr. Magner stated that it was his understanding from Mr. White that the repairs would be completed or close to completion by the City Council Public Hearing date on March 5. Mr. Magner presented photographs of the property. NLs. Moermond asked for a report from Ms. Spong. Ms. Spong stated that there were no photographs of the property and there was no PED 106 form in the file. The building was built in 1884 on a contiguous block of houses and the building did have some integrity intact. Mr. White stated that he purchased the property, which was a vacant building, in January, 2003 and many of the suu�mary abatement arders that had been issued were prior to his ownership. It was his intention at the time to repair the building and then sell it. He now intended to make the rest of the repairs and live at the property. He explained that the work had been going slow as he had to eam the money to put into the repairs. The work that remained was as follows: lay rile on the bathroom floor; hang fixtures on the walls; the staircase banister needed to installed; the pluxnbing needed to be inspected; and there was some trim on the back of the exterior of the house that needed to be done. Ms. Moermond stated that she would require Mr. White to go back to the code compliance inspection report and indicate which items had been signed off and which items needed to be signed off yet.
