1 WHEREAS, Department of Safety and Inspecrions has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecidng
3 and removal of a two and one-half story, wood frame, single family dwelling with a detached
4 two stall gazage located on property hereinafter referred to as the "Subject Property" and
5 commonly laiown as 815 FULLER AVENUE. This property is legally described as follows, to

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or before March 31, 2007, the
following are the now known interested ar responsible parties for the Subject Property: Purlieus
Properties Inc, 1401 Texas Ave S., St. I,ouis Park, MN 55426; Century Capital Group of
Minnesota, 3201 North 3 St., Suite 203, Minneapolis, MN 55412; Berry Rohweder, 3201 North
3 St., Minneapolis, MN 55412.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated August 13, 2007; and
WHEREAS, this arder informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by September 12, 2007; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WF3EREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WIlEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, February 12, 2008 to hear tesrimony and evidence, and after
receiving testimony and evidence, made the recommendation to approve the request to order the

interested or responsible parties to make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
rehabilitating this structure in accordance with all applicable codes and ordinances, or in the
alternative by demolishing and removing the structure in accordance with ail applicable codes
and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen
(1� days after the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
March 5, 2008 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 815 FLJLLER AVENUE.
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subj ect Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition ha�e not been corrected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this buildang has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the lrnown interested parties and owners aze as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subj ect Property
safe and not detrimental to the public peace, health, safety and welfare and remove its
blighting influence on the community by rehabilitating this siructure and correcting all

deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitafion or demolition and removal of the structure must be completed within
�`���.� ninetv (90) days after the date of the Council Hearing.
2. If the above conective acrion is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps aze necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.

In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The Deparhnent of Safety and Inspections has declared this building(s) to constitute a
"nuisance" as defined by Legislarive Code, Chapter 45. The Department of Safety and
Inspections has issued an order to the then known responsible parties to eliminate this
nuisance condition by correcting the deficiencies or by razing and removing this
building(s).
The property was re-inspected on September 25, 2007. There was no compliance and the
nuisance condition remains unabated, the community continues to suffer the blighting
influence of this property. It is the recommendation of the Deparhnent of Safety and
Inspections that the City Council pass a resolution ordering the responsible parties to
either repair, or demolisl� and remove this building in a timely manner, and failing that,
authorize the Department of Safety and Inspections to proceed to demolition and removal,
and to assess the costs incurred against the real estate as a special assessment to be
collected in the same manner as tases.

The building is a two and one-half story, wood frame, single-family dwelling with a detached,
two-stall garage on a lot of 4,792 square feet.
According to our files, it has been a vacant building since Januar}� 5, 2007.
The current property owner is Pwlieus Properties Inc., per AMANDA and Ramsey county
property records.
The city has had to board this building to secure it from trespass.
There have been ten (10) SUMMARY ABATEMENT NOTICES since 2007.
There have been six (6) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of tall grass and weeds
- Removal of junk and debris from ground
On August 2, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on August 13, 2007 with a compliance date of
September 12, 2007. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid.
Taxation has placed an estimated market value of $48,000 on the land and $104,900 on the
building.
As of November 1, 2007, a Code Compliance inspection has been completed.
As of December 19, 2007, the $5,000.00 performance bond has been posted.
Real Estate taxes for the year 2007 are delinquent in the amount of $919.01 plus penalty and
interest.
Code Enforcement Officers estimate the cost to repair this structure is $80,000 to $90,000. The
estimated cost to Demolish is $11,245 to $15,245.
NHPI, Division of Code Enforcement Resolution submitted for consideration orders the property

The Vacant/Nuisance Buiidings Unit, Department of the Department of SafeTy and
Inspections, Division of Code Enforcement, hereby declares the premises located at:
815 FULLER AVE
and legally described as follows, to wit:
BUTTERFIELD SYNDICATE ADDITION NO. 1 LOT 11 BLK 4
to comprise a nuisance condition in violation of the Saint Paul Legislative Code,
Chapter 45.02, and subject to demolition under authority of Chapter 45.11.
On August 02, 2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. As
first remedial action, a Code Compliance Inspection must be obtained from the
Building Inspection and Design Section, 8 Fourth Street East, Suite 200, Commerce
Building (651)266-9090. That inspection will idenfify specific defects, necessary
repairs and legal requirements to correct this nuisance condition. You may also be
required to post a five thousand dollar ($5,000.00) performance bond with the
Building Inspection and Design Office before any permits are issued, except for a
demolition permit.

This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and
shall not again be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued.
This is a two and half story, wood frame, single family dwelling with a detached, two-stall
gazage.
1. This is a fire damaged, partially gutted dweliing that lacks pluxnbing,
heating, electrical and mechanical systems, kitchen and bathroom
facilities, has damaged or missing walls and ceilings.
2. Lack of Electricity. Immediately restore electrical service. Failure to
provide proper electrical service will result in these premises being
declared Unfit for Human Habitation and ordered vacated for lack of
this basic facility. Use of candles, fuel operated lighting or extension
cord wiring is not permitted while the power is off.
3. Lack of Natural Gas Service. Immediately restore natural gas service.
Failure to provide natural gas service will result in these premises being
declared Unfit for Human Habitation and ordered vacated for lack of
this basic facility.
4. Lack of Water Service. Immediately restore water service. Failure to
provide water service will result in these premises being declared Unfit
for Human Habitarion and ordered vacated for lack of this basic facility.
5. The eaves and soffits are in a state of disrepair or deterioration. Repair
all defects, holes, breaks, loose or rotting boards, to a professional state
of maintenance. Permit may be required.
6. The exterior walls and/or trim of the house and/or gazage has defecrive,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
FURNACE: Have a licensed heating contractor service and clean the
furnace or boiler and make any necessary repairs. Perform a GO test on
the heating plant. Then, send the attached form back to the Inspector.
Repair of gas fired appliances requires a permit.
8. G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Permit
May Be Required.
9. The roof is deteriorated, defective, ar in a state of disrepair. Repair or
replace the roof covering to a sound, fight and water impervious
condifion. Permit may be required.

1Q. Smoke Detector: Lack of properly installed and operable smoke
detector. Provide functioning smoke detectors in accordance with the
attached requirement, within 24 hours.
ll. The exterior walls of the house and/or garage are defective. Repair all
holes, breaks, loose or rotting siding, to a professional state of
maintenance.
12. The structure is a registered vacant building and must have a Code
Compliance Certificate before the structure may be occupied.
Isnmediately vacate the structure or obtain a Code Compliance
Certificate from L.I.E.P. You may contact Jim Seeger at L.I.E.P. for
code compliance inspection, permits, and issuance of Code Compliance
Certificate. Under Chapter 33.03 of the Saint Paul Legislative Code,
failure to obtain a Code Compliance Certificate or to vacate the
structure may result in issuance of criminal summonses.
13. The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable
windows and doors. Screens must be right-fitting and securely fastened
to the fraznes.
14. The windows and/or storm windows are in a state of disrepair. Replace
all missing or broken window glass. Make all necessary repairs to
frames, sashes, hardwaze and associated trim in a professional manner.
Permit may be required.
15. The stairs haue missing or defective handrails. Provide ali interior and
exterior stairways and steps of more that three (3) risers with handrails
which are grippable and installed 34" to 38" above the nose of the stair
treads.
As owner, agent or responsible party, you aze hereby notified that if these deficiencies and
the resulting nuisance condition is not conected by SeQtember 12, 2007 the Department
of Safety and Inspections, Division of Code Enforcement, will begin a substantial
abatement process to demolish and remove the building(s). The costs of this action,
including administra6ve wsts and demolition costs will be assessed against the property
taxes as a special assessment in accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Tnspecfion and Design Secrion, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspection will idenrify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners.

If you sell, transfer, or convey in any manner, the ownership or responsibility for this
property, you must within seven (7) days, notify the Enforcement Officer with the names
and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which
declares it to be a"nuisance condirion", subject to demolition and removal by the City.
This placard shall not be removed without the written authority of the Department of
Safety and Inspections, Division of Code Enforcement. The department is further
required to file a copy of this "Order to Abate" with t1�e City Clerk's Office.
Tf correcfive action is not taken within the tune specified in this order, the Enforcement
O�cer will norify the City Council that abatement action is necessary. The City Clerk
will then schedule dates for Public Hearings before the City Council at which time
testimony will be heard from interested parties. After this hearing the City Council will
adopt a resolution stating what action if any, it deems appropriate.
If the resolution ca11s for abatement action the Council may either order the City to take
the abatement action or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if corrective action is not taken within the specified rime, the City shali abate
this nuisance. The costs of this action, including administrative costs will be assessed
against the property as a special assessment in accordance with law.

5. Ordering the owner to remove ar repair the building(s) at 815 Fuller Avenue within fifteen
(15) days from adoption of resolution.
The property owner of record, Barry Rohweder appeazed on behalf of the property owner, Purlieus
Properties Inc. No other parties of interest appeazed.
Mr. Magner stated the building was a two and one-half story, wood frame, single-family dwelling
with a detached two-stall garage on a Iot of 4,792 square feet and had been vacant since 7anuary 5,
2007. A code compliance inspection had been done on November I, 2007. The vacant building
registration fees were current and the $5,000 performance bond was posted on December 19, 2007.
On August 2, 2007, an inspection of the building was done and a list of deficiencies which
constitute a nuisance condition was developed. An order to abate a nuisance building was posted on
August 13, 2007 with a compliance date of September 12, 2007. To date, the property remained in
a condition wYuch comprised a nuisance as defined by the I.egisiative Code. Ramsey County
Taatation estimated the market value of the land to be approximately $48,000 and the building to be
$104,900. Real estate taxes for 2007 were delinquent in the amount of $919.01, plus penalty and
interest. Code Enfarcement estimates the cost to repair the building to be approximately $80,000 to
$90,000. The cost for demolition was estimated to be approximately $11,245 to $15,245. There
had also been 10 sumxnary abatements issued to this property since 2007, six of which went to work
order: to secure the building and the City had to board the building to secure i[ from trespass,
remove improperly stored refuse, cut tall grass and weeds, and remove junk and debris from the
ground. Code Enforcement recommends the building be repaired or removed within 15 days. Mr.
Magner also noted that the building had extensive fire damage. He presented photographs of the
property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was buiit in
1913 and was a Queen Anne style. She noted that it had flared eaves which was an interesting
architectural detail; however, there were very few historical details left to the building and it had not
been surveyed.
Ms. Moermond asked Mr. Rohweder what his plans were for the building. Mr. Rohweder
responded that it was his intention to complete the rehab. He explained that he purchased the
property in 2007 and had pulled a demolition permit for the building. He didn't obtain the building
permit to do the rehab until June, 2007. He claimed that he would have been done with the repairs
if the building had not been changed to a Category III building which halted the rehab process and
the building had been "red tagged." He then had to post the bond which he was unable to obtain
and instead, he posted the $5,000 in cash which he did not do until December.
Ms. Moermond asked Mr. Mager when the fire had occurred and the category status on the
building. Mr. Magner responded that the vacant building file was opened on January 4, 200� after
the fire which occurred on 7anuary 3, 2007. Concerning the permits, a building permit was issued
to Advance Restorarion Services on February 20, 2007, and an electricai permit was puiled on
January 31, 2007 and expired after six months. Once the buiiding was completely gutted, a code
compliance inspection or fire inspection would be necessary. He stated that on July 26, 2007, the
building category was changed from a Category I to a Category III because the repairs had not
started within the 90 day tuneframe from the fire and which building status was only allowed under
the original ownership of the property. Ae noted that the building category did not change until six
months after the fire had occurred.

Mr. Rohweder stated that it was his intention to complete the rehab: the siding was done; the roof
was done; the windows were in; mechanicais, plumbing, heating, and electrical were done; and the
electrical still needed to be inspected. He believed he could have the rehab completed in
approximately 60 days. He claimed that he had rehabbed 38 other buildings and that four were
presently under conshuction.
Ms. Moermond asked Mr. Magner about the 10 suimnary abatement orders which had been issued
since 2007. Mr. Magner responded that the history of the summary abatement orders issued were as
follows: January, 2007; Apri12, 2007; April 16, 2007; May 31, 2007; July 25, 2007; August 30,
2007; October 1 S, 2007; and January, 2008.
Ms. Moermond stated that since the City had to issue ten s�ammary abatements, six of which went to
work arder where the City had to go out and do the work, was not a good indication that he could
maintain his property. The delinquent ta�ces far 2007 was also not a good indication that he had was
in controi of this property. Ms. Moermond asked Mr. Magner about the City's estimated cost of the
rehab.
Mr. Magner stated that the original loss to the structure firom the fire was $190,000.
Mr. Rohweder stated that he esfimated the cost the he had put into the repair of the building to be
approximately $70,000.
Ms. Moermond stated that the following must be provided by the end of business on February 29:
1) the property must be maintained; 2) the tases needed to be paid; 3) an approved work plan; and
4) financial documentation. If these conditions were met, she would recommend to the City
Council that they grant 90 days to complete the rehabilitation.
