1 WHEREAS, Department of Safety and Inspecrions has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a one story, wood frame, single family dwelling with a detached, oversized, one
4 stall, wood frame garage located on property hereinafter referred to as the "Subject Property" and
5 commonly known as 1867 STILLWATER AVE . This property is legally described as follows,

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Tnspections on or before March 31, 2007, the
following are the now known interested or responsible parties for the Subject Property: Wells
Fargo Bank Nat Assoc/Co Premiere Asset Services, 7495 New Horizon Way, Frederick, MD
21702; Stephenson & Sanford, PLC, 1905 E. Wayzata Blvd, #220, Wayzata, MN 5539I, Jeff

WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated September 5, 2007; and
WHEREAS, this order informed the then lrnown interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure locaYed on the Subject Property by October 5, 2007; an8
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and

WIIEREAS, a hearing was held before he Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, December 11, 200 o hear testimony and evidence, and after
receiving testimony and evidence, made the recommendation to approve the request to order the
interested or responsible parties to make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by

interested or responsible parties to make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
rehabilitating this structure in accordance with all applicable codes and ordinances, or in the
alternative by demolishing and removing the structure in accordance with all applicable codes
and ordinances. The rehabilitation or demolition of the structure to be completed within one-
hundred eighty (180) days after the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
January 2, 2008 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1867 STILLWATER AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lmown
responsible parties to correct the deficiencies or to demolisb and remove the
building(s).
5. That Yhe deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
ProperCy which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within one-
hundred eighty (180) days after the date of the Council Hearing.
If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

"nuisance" as defined by Legislative Code, Chapter 45. The Deparhnent of 5afety and
Inspections has issued an order to the then known responsible parties to eliminate this
nuisance condition by correcting the deficiencies or by razing and removing this
building(s).
The property was re-inspected on October 5, 2007. There was no compliance and the
nuisance condition remains unabated, the community continues to suffer the blighting
influence of this property. It is the recommendation of the Department of Safety and
Inspecrions that the City Council pass a resolution ordering the responsible parties to
either repair, or demolish and remove this building in a timely manner, and failing that,
authorize the Deparhnent of Safety as�d Inspections to proceed to demolition and xemoval,
and to assess the costs incurred against the real estate as a special assessment to be
collected in the same manner as tases.

The building is a one story, wood frame, single family dwelling with a detached, oversized 1-
stall garage on a lot of 6,098 square feet.
According to our files, it has been a vacant building since November 20, 2006.
The current property owner is Welis Fargo Bank N.A. c/o Premiere Asset Services, per AMANDA
and Ramsey county property recards.
The city has had to board this building to secure it from trespass.
There have been six (6) SUMMARY ABATEMENT NOTICES since 2006.
There have been seven (7) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of tall grass and weeds
On August 22, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NiJISANCE BUILDING was posted on September 5, 2007 with a compliance date of

The Vacant/Nuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:

and legally described as follows, to wit:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code,
Chapter 45.02, and subject to demolition under authority of Chapter 45.11.
On August 22, 2007, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. As
first remedial action, a Code Compliance Inspection must be obtained from the
Buitding Inspection and Design Section, 8 Fourth Street East, Suite 200, Commerce
Building (651)266-9090. That inspection will identify specific defects, necessary
repairs and legal requirements to correct this nuisance condition. You may also be
required to post a five thousand dollar ($5,000.00) performance bond with the
Building Inspection and Design Office before any permits are issued, except for a
demolition permit.

shall not again be used for occupancy until such tune as a Certificate of Compliance or a
Certificate of Occupancy has been issued.
This is a one-story, wood frame, single family dwelling with a detached, oversized, one-
stall, wood frame garage.
Interior
1. Lacking deadbolt door locks. Provide one-inch throw deadbolt locks for
all enhy doors to dwelling unit(s).
2. FURNACE: Have a licensed heating contractor service and clean the
furnace or boiler and make any necessary repairs. Perform a C/O test on
the heating plant. Then, send the attached form back to the Inspector.
Repair of gas fired appliances requires a permit.
3. G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Pemut
May Be Required.
4. The stairs haue missing or defective han�ails. Provide all interior and
exterior stairways and steps of more that three (3) risers with handrails
which are grippable and installed 34" to 3 S" above the nose of the stair
treads.
5. The interior ceilings ue defective. Repair all ceiling defects and finish
in a professional manner.
6. The interior walls are defective. Repair all wall defects and fuush in a
professional manner.
7. Smoke Detector: Lack of properly installed and operable smoke
detectar. Provide functioning smoke detectors in accordance with the
attached requirement, within 24 hours.
8. Lack of Water Service. Immediately restore water service. Failure to
provide water service will result in these premises being declared Unfit
for Human Habitation and ordered vacated for lack of this basic facility.
9. The window and/or door screens aze missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable
windows and doors. Screens must be tight-fitting and securely fastened
to the frames.

10. The chimney is defective, deteriorated or in a state of disrepair. Replace
all missing or defective bricks, tuckpoint as needed to restore the
chimney to a professional state of maintenance and repair. Permit may
be required.
11. The eaves and soffits aze in a state of disrepair or deterioration. Repair
all defects, holes, breaks, loose or rotting boazds, to a professional state
of maintenance. Pemut may be required.
12. The exterior walls and/or trim of the garage has defective, peeled,
flaked, scaled or chalking paint or has unpainted wood surfaces. Scrape
and repaint to effect a sound condition in a professional manner.
13. The exterior walls and/or trim of the house has defective, peeled, flaked,
scaled or chalking paint or has unpainted wood surfaces. Scrape and
repaint to effect a sound condition in a professional manner.
14. The foundation is deteriorated, defective or in a state of disrepair.
Repair all foundation defects in a professional manner to a
weather-tight, water-tight and rodent-proof condition. Permit may be
required.
15. The roof is deteriorated, defective, or in a state of disrepair. Repair or
replace the roof covering to a sound, tight and water impervious
condition. Permit may be required.
16. The exterior walls of the house are defective. Repair all holes, breaks,
loose or rotting siding, to a professional state of maintenance.
17. Lack of Water Service. Immediately restore water service. Failure to
provide water service will result in these premises being declared Unfit
for Human Habitation and ordered vacated for lack of this basic facility.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and
the resulting nuisance condition is not corrected by October O5, 2007 the Department of
Safety and Inspections, Division of Code Enforcement, will begin a substanfial abatement
process to demolish and remove the building(s). The costs of this action, including
administrative costs and demolition costs will be assessed against the property taxes as a
special assessment in accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspecrion and Design Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9�90. This inspection will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.

As an owner or responsible party, you aze required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners. If you sell, transfer, or convey in any manner, the
ownership or responsibility for this property, you must within seven (7) days, notify the
Enforcement Officer with the names and addresses of any new owners or responsible
parties.
The Enforcement Officer is required by law to post a placard on this property which
declazes it to be a'huisance condition", subj ect to demolition and removal by the City.
This placazd shall not be removed without the written authority of the Department of
Safety and Inspections, Division of Code Enforcement. The deparhnent is further
required to file a copy of this "Order to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement
Officer will notify the City Council that abatement action is necessary. The City Clerk
will then schedule dates for Public Hearings before the City Council at which time
testimony will be heard from interested parties. After this hearing the City Council will
adopt a resolution stating what action if any, it deems appropriate.
if the resolution cails for abatement action the Council may either order the City to take
the abatement acrion or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if corrective action is not taken wittun the specified time, the City shall abate
this nuisance. The costs of this action, including administrarive costs will be assessed
against the property as a special assessment in accordance with law.

Repair walls and ceilings throughout, as necessary.
Re-level shucture as much as is pracrical.
Where wall and ceiling covering is removed, attic, replace doors and windows,
(insulation, glass, weather shipping, etc.) shall meet new energy code standards.
Prepare and paint interior and exterior as necessary (take the necessary precaurions if
lead base paintis present).
Any framing members that do not meet code (where wall and ceiling covering is
removed, members that are over-spanned, over-spaced, not being carried properly,
door and window openings that are not headered, etc.) are to be reconstructed as per
code.
i l. All charred members will have to be scraped or sandblasted completely clean and any
water warped members replaced. A determinafion as to necessary corrective
measures will have to be made by this department or a registered structural engineer
as to replacement, repairs, etc. All smoked or charred members are to be sealed and
deodorized.
12. Provide general clean-up of premise.
13. Provide smoke detectors as per the Minnesota State Building Code.

Jeff Detloff appeared on behalf of the property owner of record, Wells Fargo Bank N.A., Premiere
Asset Services, the REO for the property.
Mr. Magner stated the building was a one-sTory, wood frame, single-family dwelling with a
detached, oversized, one-stall garage on a lot of 6,098 square feet and had been vacant since
November 20, 2006. A code compliance inspecrion had been done on September 6, 2007. The
vacant building registration fees were current; however, the $5,000 the performance bond had not
been posted. On August 22, 2007, an inspecfion of the building was done and a Iist of deficiencies
which constitute a nuisance condirion was developed. An order to abate a nuisance building was
posted on September 5, 2007 with a compliance date of October 5, 2007. To date, the property
remained in a condirion which comprised a nuisance as defined by the Legislative Code. Ramsey
County Taxation estimated the mazket value of the land to be approximately $49,600 and the
building to be $88,900. Real estate tases were current. Code Enforcement estimates the cost to
repair the building to be approximately $40,000 to $60,000. The cost for demolition was estimated
to be approximately $8,800 to $11,800. There had also been six summary abatements issued to this
property, seven of which went to wark arder: to secure the building and the City had to board the
building to secure it from trespass, remove improperly stored refuse, and remove tall grass and
weeds. Code Enforcement recommends the building be repaired or removed within 15 days. Mr.
Magner presented photographs of the property.
Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner stated that a
Code Enforcement inspector referred the property to the Vacant Buildings Program as the property
was unoccupied; the electricaI service was hanging too low; there were numerous exterior
violations; and the garage was open to entry. He stated that the last time a suimnary abatement
order was issued to this property was in June, 2007.
Mr. Detloff stated that he had only been involved with this property since the beginning of
September, 2007 when he was assigned to be the REO. The property had been on the mazket and as
of December 8, he had a signed purchase agreement and the closing was scheduled for December
28. The Bank had not yet reviewed the bid; however, the buyers offered $22,000 for the property
and he believed the Bank would accapt the bid. He also believed the house was too small to be used
as a rental property as it only had two bedrooms.
Mr. Magner stated that the buyers had several options available including tearing down the current
house and rebuilding something larger. The question was whether it was economically feasible for
the buyers to rehab the house.
Ms. Moermond stated the buyers would need to decide whether they desired to rehab the property
ar tear down the house. She asked Mr. Detloff to notify the buyers that the $5,000 performance
bond would need to be posted, they would need to submit a work plan, and they would need to
show that they had $40,000 to $60,000 in available financing in order to rehabilitate the property if
that was their desire. She recommended laying this matter over to the December 18 Legislative
Hearing and asked Mr. Detloff to convey this to the buyers.

Mr. Magner stated that at the last hearing, this matter was continued to allow the prospecrive buyer
to come to a hearing to present a work plan, provide financial credentials and be able to post the
$5,000 performance bond.
Steve Schwartz appeared and stated that Mr. Detloff had indicated to him what he would need to do
in order to rehab the properiy. He read a statement into the record concerning his personal
background and his financial status. He was purchasing the property with Tom Turner who worked
for Arcade Elechic. He presented documentation to Ms. Moermond.
Ms. Moermond asked Mr. Schwartz whether he was a licensed general contractor. Mr. Schwartz
responded that he was not.
Mr. Magner reviewed the work plan which showed timelines and cost estimates for the rehab of the
property into the record. Ms. Moermond stated that staff had estimated the cost of the repairs to be
between $40,000 to $60,000. Mr. Schwartz' cost estimate was approximately $27,000 which was
far below what staff had estimated the cost of the repairs to be.
Mr. Schwartz responded that he didn't understand how they could estimate the cost of the repairs to
be so high since the house was rather small and a new furnace and duct work had recently been
installed. He believed the major expense would be the plumbing and the electrical work.
Mr. Magner asked Mr. Schwartz who would be doing the electrical work. Mr. Schwartz responded
that he believed Arcade Electric would do the electrical work and the plumbing would be done by
Spies Plumbing. He stated that he did not include the cost of his or Mr. Turner's labor in his work
plan estimate.
Mr. Magner stated that he believed the work plan should be revised to include the cost estimate or
equity of the labor Mr. Schwartz and Mr. Turner were going to do.
Ms. Moermond refened to the bank statement Mr. Schwartz had presented. She asked whether Mr.
Schwartz planned to use this account to purchase the house. Mr. Schwartz responded that he
planned to pay cash, $22,000, from his TCF account for the purchase of the house. He would likely
use the money in his Rydex Investment account for the rehabilitation. His partner, Mr. Tumer, was
expected to receive in excess of $80,000 at the end of the month as ordered in his divorce decree.
He also pointed out that he had an excellent credit rating.
Ms. Moermond recommended granting 180 days to make the repairs provided the following is
submitted by Friday, December 21: 1) the vacant building registration form must be submitted; 2)
provide a copy of the Purchase Agreement; and 3) provide a revised work plan. The $5,000
performance must be posted by Friday, December 28. If Mr. Schwartz completed all of this, she
would recommend to the City Council at the Public Hearing to grant 180 days to rehabilitate the
property.

the last 20 years. All rentaLs, when purchased, with the exceplion of one, were vacaut and in
disrepair. I currently have three Section 8 tenants and have dealt with Section 8 for over 20
