BE IT RESOLVED that, upon the petition of River Run Properties, LLC, as documented in
Public Works Technical Services, Vacation File Number O1-2008, the public property hereinafter
described, as follows and on attached map Exhibit A, is hereby vacated and discontinued as
public property:
Mechanic Avenue from a line from the southwest corner of lot 3, block 2,
Ames Outlots, Ramsey County, Minnesota, to the northwest corner of lot 3,
block 3, said Ames Outiots, east to the west line of Barclay Street;
and be it further
RESOLVED that, subject to the herein stated exceptions and with the accompanying Certificates
of Intended Non-Use, filed voluntarily on behalf of: District EnergylDistrict Cooling St. Paul,
a private, non-profit Minnesota corporation; Saint Paul Regional Water Services, a
municipal corporarion; Northern States Power Coffipany dba Xcel Energy (gas), a
Minnesota corporation; Qwest, a Colorado corporation; made a part hereof by this reference
and filed in the office of the City Clerk of Saint Paul, the City, for itself and on behalf of these
corporations and departments, waives the right to the utility easements in the vacated area
described above.
This vacation shall also be subject to the terms and condition of Chapter 130, codified March 1,
1981, of the Saint Pau1 Legislative Code as amended, and to the following condifions:
1. That the petitioners, their successors and assigns shail pay $1200.00 as an administrative
fee for this vacation which is due and payable within 60 days of the effective date of this
resolution.
2. On behalf of the City of Saint Paul Department of Public Works storm and sanitary sewer
easements must remain, subject to the following condifions:
That a permanent utility easement shall be retained on, over, under and across the vacated
area on behalf of the City of Saint Paul, Department of Public Works to reserve the right of
the City to maintain and operate any sewer in or upon said easement and to enter upon said
easement or any portion thereof at any time and from time to time, for the purposes of

future construction, reconstruction, inspecriott, maintenance, or repair of the same or any
part thereof. Said utility easement shall be subject to the following conditions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or
any other objects wluch may prohibit normal access to utility facilities for
maintenance purposes wiil be pernutted within the easement azea.
b. Improvements in or upon the above described easement that do not prohibit the City
from exercising its reserved rights may be allowed by obtaining written permission
from the Department of Public Works Sewer Division with the understanding that the
restoration and costs of such improvements shall be the sole responsibiliry of the
petitioner, its successors and assigns in the event the CiTy exercises its reserved
easement rights.
c. Should it be necessary that the petirioner's works or improvements be removed or
damaged as a result of the Department of Public Works operations, a11 removal,
replacement or modification costs shall be borne solely by the petitioner.

No change from the existing grade within the easement azea shall be permitted
without written permission from the Department of Public Works Sewer Division.
No change in surfacing within the easement area shall be permitted without written
permission from the Department of Public Works Sewer Division.
f. The petifioner, its successors and assigns shall fully indemnify, defend, and save
harniless the City of Saint Paul, its officers, agents, employees, and servants from all
suits, actions, or claims which shall arise from any injuries or damages received or
sustained by any break in any service pipe or connection in said reserved easement
arising out of or resulting from any action or negligence of the peritioner, its
employees, agents, or business invitees.
3. The City of Saint Paul Public Works also imposes the restriction that if the homes at 1457
and 1471 Mechanic Avenue remain in place, it is required that their addresses change,
since Mechanic Avenue will no longer exist adjacent to the parcels.
4. On behalf of Ramsey-Washington Metro Watershed District sewer easements must
remain.
5. That an easement shall be retained on behalf of Comcast, a Pennsylvania Corporation, for
existing facilities. The petitioner or its successar shail provide new easements.if required
and the petitionez or its successor shall assume all costs of relocating facilities to the new
easements.
6. That an easement shall be retained on behalf of Xcel Energy (electric} for its existing
facilities. The petitioner or its successor sha11 provide new easements if required and the
petitioner or its successor shall assume all costs of relocating facili6es to the new
easements.

That the petitioner, their successors and assigns agree to indemnify, defend and save
harmless the City of Saint Paul, its officers and employees from all suits, actions or clauns
of any character brought as a result of injuries or damages received or sustained by any
person, persons or property on account of this vacation, or the petitioners' use of this
properiy, including but not lunited to, a claim brought because of any act of omission,
neglect, or misconduct of said pefitioners or because of any claims or liability arising from
any violation of any law or regulation made in accordance with the law, whether by the
petitioners or any of their agents or employees.
8. That the petitioners, their successors and assigns shall, within 60 days of the effective date
of this resolution, file with Public Works, City Real Estate, an acceptance in writing of the
conditions of this resolution and shall, within the period specified in the terms and
conditions of this resolufion, comply in all respects with these terms and conditions.

Right-of-Way, and the City owns 2 sanitary sewers also contained within the Right-of-

I don`t think DSL has any issues. But..
I wa�t to point out one thing that may be more of a planning issue. The lo� on the south side oF Mxhanic are very deep (over
300'?). These lots also have frontage on the south on Ames. So each of these lots could be split into two more normal size lots if
Mechanic was ever e�ctended east in front of them. So I think it makes sense to hang onto the Mechanic right of way so that these
lotr on be sp{it in the futwe.
My comments might be different iP we had a specific proposal for the property, but I don't think that �is is the case.
I am curious why this area was never developed (bad soils, topo or ???)

property that is owned on both szdes of Mechanic Avenue and adding to it the proposed
vacated portion of the street. We believe it is an important piece to the overall area of
this site 5 development.
River Run Properties and LTRW are the developers of Phalen Crossing. Several
years ago an overall look at the azeas adjoining Phalen Crossing were looked at
conceptually for additional phases of development of the neighborhood with people from
the City of St. Paul. This area was looked at and labeled as site 5 of an overall
development picture for the Phalen azea. LTRW and River Run Properties purchased
pazcels of land with the city's encouragement with the idea of future development. We
are now combining all of the pieces to market one site for future housing. This will
include all of the following or portions of the foliowing pieces:

I recommend a public hearing before the City Councii be held on March 5, 2008, to
consider the petition of River Run Properties, LLC.
This petition is to vacate street rights in part of unimproved Mechanic Avenue east of
Barclay Sireet.
The purpose of this vacation is to consolidate property for redevelopment. There is
no building allowed within the vacated area.
This property is located in Ci1y Council Ward 6, Planning District Z.
