RESOLUTION
WHEREAS, Department of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a two-story, wood frame, single family dwelling with a detached, two stall, wood
frame garage located on property hereinafter referred to as the "Subject Property" and commonly
known as 763 FULLER AVENUE. This property is legally described as follows, to wit:

9 WHEREAS, based upon the records in the Ramsey County Recorder's Office and
10 information obtained by Department of Safety and Inspections on or before March 31, 2007, the
11 following are the now known interested or responsible parties for the Subject Property: Mishelle

WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated August 29, 2007; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Properiy is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by September 28, 2007; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and

WHEREAS, a hearing was held before �he Legislative Hearing Officer of the Saint Paul

interested or responsible parties to make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The demolition of the structure to be completed within fifteen (15) days after the date of the
Council Hearing; and
WHEREAS, a heazing was held before the Saint Paul City Council on Wednesday,
January 2, 2008 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 763 FULLER AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parCies to correct tbe deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by DeparCment of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by rehabilitating this structure and correctin� all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Buildine(sl in
accordance with all applicable codes and ordinances or in the altemative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
demolition and removal of the structure must be completed within :�r,�t�°°�.,7 one-
hundred twentv (120) days after the date of the Council Hearing.
If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject PropeRy pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is furtber ordered, that a copy of this resolution be mailed to the owners and interesYed
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

Inspections has issued an order to the then known responsible parties to eliminate this
nuisance condition by correcting the deficiencies or by razing and removing this
building(s).
The property was re-inspected on September 28, 2007. There was no compliance and the
nuisance condition remains unabated, the community continues to suffer the blighting
influence of this property. It is the recommendation of the Deparhnent of Safety and
Inspections that the City Council pass a resolution ardering the responsible parties to
either repair, or demolish and remove this building in a timely manner, and failing that,
authorize the Department of Safety and Inspections to proceed to demolition and removal,
and to assess the costs incurred against the real estate as a special assessment to be
collected in the same manner as taxes.

The building is a two story, wood frame, single family dwelling with a detached 2-stall gazage on
a lot of 4,356 square feet.
According to our files, it has been a vacant building since November 20, 2006.
The current property owners are Mishelle and Bob Pilz, per AMANDA and Ramsey county
property records.
There have been ten (10) SUMMARY ABATEMENT NOTICES since 2006.
There have been ten (10) WORK ORDERS issued for:
- Removal of improperly stored refuse
- Removal of tall grass and weeds
Removal of snow and ice
On August 21, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NiJISANCE BUILDING was posted on August 29, 2007 with a compliance date of
September 28, 2007. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid.
Taxation has placed an estimated market value of $45,100 on the land and $106,900 on the

The VacanUNuisance Buildings Unit, Department of the Department of Safety and Inspections,
Division of Code Enforcement, hereby declares the premises located at:

and legally described as follows, to wit:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter 45.02,
and subject to demolition under authority of Chapter 45.11.
On August 21, 2007, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. As first
remedial action, a Code Compliance Inspection must be obtained from the Building Inspection
and Design Section, 8 Fourth Street East, Suite 200, Commerce Building (651)266-9090. That
inspection will identify speciFc defects, necessary repairs and legal requirements to correct this
nuisance condition. You may also be required to post a five thousand dollar ($5,000.00)
performance bond with the Building Inspecfion and Design Office before any permits are
issued, except for a demolition permit.

This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and shall not
again be used for occupancy until such time as a Certificate of Compliance or a Certificate of
Occupancy has been issued.
This is a two-story, wood, single famiJy dwelling with a detached, two-stall, wood frazne garage.
1. The exterior wa11s of the house and/or gazage aze defective. Repair all holes, bzeaks, loose or
rotting siding, to a professional state of maintenance.
2. The chimney is defective, deteriorated or in a state of disrepair. Replace all missing or
defective bricks, tuckpoint as needed to restare the chimney to a professional state of
maintenance and repair. Pemut may be required.
The eaves and soffits are in a state of disrepair or deteriorafion. Repair all defects, holes,
breaks, loose or rotting boazds, to a professional state of maintenance. Permit may be
required.
4. Lack of Electricity. Immediately restore electrical service. Failure to provide proper
electrical service will result in these premises being declared Unfit for Human Habitation and
ordered vacated for lack of this basic facility. Use of candles, fuel operated lighring or
extension cord wiring is not permitted while the power is off.
5. Lack of Natural Gas Service. Immediately restore natural gas service. Failure to provide
natural gas service will result in these premises being declared Unfit for Human Habitation
and ordered vacated for lack of this basic facility.
Lack of Water Service. Immediately restare water service. Failure to provide water service
will result in these premises being declazed Unfit for Human Habitation and ordered vacated
for lack of this basic facility.
7. The foundarion is deteriorated, defective or in a state of disrepair. Repair all foundation
defects in a professional manner to a weather-tight, water-tight and rodent-proof condition.
Pertnit may be required.
8. The exterior wa11s of the house and/or gazage are defecfive. Repair all holes, breaks, loose or
rotting siding, to a professional state of maintenance.
9. The exterior walls and/or trim of the house and/or garage has defective, peeled, flaked, scaled
or chalking paint or has unpainted wood surfaces. Scrape and repaint to effect a sound
condition in a professional manner.

10. There is rot damage to exterior wall boazd, trim and other wooden members. Replace rot-
damaged members. Paint as necessary.
11. There is evidence of a rodent infestafion (Squirrels). Immediately exterminate and eliminate
all rodents from the entire building. Remove rodent harborages in the yard areas. Tuckpoint
the foundarion if necessary to rodent-proof the building to prevent re-infestarion. Immediately
remove any dead rodents from the premises.
12. T'he windows and/or storm windows are in a state of disrepair. Replace all missing or broken
window glass. Make all necessary repairs to frames, sashes, hardware and associated trisn in a
professional manner. Permit may be required.
13. The structure is a registered vacant building and must have a Code Compliance Certificate
before the structure may be occupied. Immediately vacate the structure or obtain a Code
Compliance Certificate from L.I.E.P. You may contact Jim Seeger at L.I.E.P. for code
compliance inspec6on, permits, and issuance of Code Compliance Certificate. Under Chapter
33.03 of the Saint Paul Legislative Code, failure to obtain a Code Compliance Certificate or to
vacate the shucture may result in issuance of criminal smmnonses.
14. The shucture is a registered vacant building and must have a Certificate of Occupancy
before the structure may be occupied. Immediately vacate the structure or obtain a
Certificate of Occupancy from the Fire Depaxtment, Fire Prevention. You may contact Pat
Fish for team inspection and issuance of Certificate of Occnpancy.
15. There have been repairs to the house without permits or approvals.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and
the resulting nuisance condirion is not corrected by September 28, 2007 the Deparhnent
of Safety and Inspections, Division of Code Enforcement, will begin a substanrial
abatement process to demolish and remove the building(s). The costs of this action,
including administrative costs and demolition costs will be assessed against the property
tases as a special assessment in accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce
Building, (651)266-9090. This inspection will identify specific defects, necessary repairs
and legal requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent owners.

If you sell, transfer, or convey in any manner, the ownership or responsibility for this
property, you must within seven (7) days, notify the Enforcement Officer with the names
and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which
declares it to be a"nuisance condirion", subject to demolition and removal by the City.
This placazd sha11 not be removed without the written authority of the Department of
Safety and Inspections, Division of Code Enforcement. The department is further
required to file a copy of this "Order to Abate" with the City Clerk's Office.
If corrective acrion is not taken within the time specified in this order, the Enforcement
Officer will notify the City Council that abatement action is necessary. The City Clerk
wili then schedule dates for Public Hearings before the City Council at which tune
testimony will be heard from interested parties. After this hearing the City Council will
adopt a resolution staring what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may eithe; order the City to take
the abatement action or fix a time within which this nuisance must be abated in
accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if conective action is not taken within the specified fime, the City sha11 abate
this nuisance. The costs of this action, including administrative costs will be assessed
against the property as a special assessment in accordance with law.

Insure basement cellar floor is level, is cleanable, and all holes are filled. (fill low
areas)
Provide thumb type dead bolts for all entry doors. Remove any surface bolts.
Rzpair or replace any deteriorated window sash, broken glass, sash holders, re-putty
etc. as necessary.
Provide complete storms and screens, and repair all door and window openings.
Prepare and paint interior and exterior as necessary (take the necessary precautions if
lead base paint is present).
Habitable rooms with new usage, replaced windows shall have glass area equal to 8%
of floor area, or a minimum of 8 sq. ft., one-half of which shall operate and all
bedroom windows sha11 meet emergency egress requirements (20" wide minimum,
24" high minimum but not less than 5.7 sq. ft. overall).
Provide general clean-up of premise.
Provide smoke detectors as per the Minnesota State Building Code.
Repair soffit, fascia trim, etc. as necessary.

10. Ordering the owner to remove or repair the building(s) at 763 Fuller Street within fifteen
(15) days from adoprion of resolution.
Mr. Magner stated the building was a rivo-story, wood frame, single-family dwelling with a
detached two-stall garage on a lot of 4,356 squaze feet and had been vacant since November 20,
2006. A code compliance inspection had been done on September 14, 2007. The vacant building
registration fees were current; however, the $5,000 performance bond had not been posted. On
August 21, 2007, an inspection of the building was done and a list of deficiencies which constitute a
nuisance condition was developed. An order to abate a nuisance building was posted on August 29,
2007 with a compliance date of September 28, 2007. To date, the property remained in a condition
which comprised a nuisance as defined by the Legislative Code. Ramsey County Taacation
estimated the mazket value of the land to be approxnnately $45,100 and the building to be
$106,900. Real estate taxes were current. Code Enforcement estimates the cost to repair the
building to be approximately $50,000 to $60,000. The cost for demolition was estimated to be
approximately $13,575 to $17,575. There had also been 10 sununary abatements issued to this
property since 2006, all of which went to work order: to secure the building and the City had to
board the building to secure it from trespass, remove improperly stored refuse, cut tall grass and
weeds, and remove snow and ice. Code Enforcement recommends the building be repaired or
removed within 15 days. Mr. Magner presented photographs of the property.
Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner stated that
Code Enforcement received a complaint that the building was open to access and there was a lot of
exterior damage to the building. There was also a long history of dumping at this property. . He
noted that the time period on the sununary abatement orders was consistent since the vacant
building file had been opened and a new order had been issued in November.
The property owners of record, Mishelle and Bob Pilz, did not appear. No other parties of interest
appeared.
Ms. Moermond recommended the building be removed within fifteen (15) days with no option for
repair.

(15) days from adoption ofresolution. (Legislarive Hearing held on December 11 and
Councii Public Hearing held on January 2)
Mr. Magner stated that a Legislarive Hearing was held on December 11, 2007, no one appeazed, and
the Legislative Hearing Officer's recommendation was to remove the building within 15 days. The
matter was heard before the City Council on January 2, 2008 and the matter was laid over. NIr.
Magner stated that he had spoken with the new realtor handling this property and informed him to
provide a work plan and a financial plan indicating that the mortgage company was going to
provide the financing to rehabilitate the property or from any potential buyer who planned to
rehabilitate the property.
Larry Zielke, Shapiro, Nordmeyer and Zielke, appeared on behalf of his client, HomEq Servicing,
along with Tim Folkenson who was the new realtor assigned to the property. Mr. Folkenson
presented documents for review. Mr. Zielke stated that his firm had just recenfly been retained by
HomEq Servicing, the mortgage servicer, and they also retained Mr. Folkenson in their attempt to
saue the property. Mr. Zielke stated that he personally had paid the $5,000 performance bond
which had been posted on January 4, 2008. Mr. Zielke reviewed the documents presented by Mr.
Folkenson which included the following: 1) a letter from HomEq Servicing indicating their
retention of Tim Folkenson to market the property; and 2) a bid for rehabilitation of the property. It
was Mr. Folkenson's opinion that this house should not be demolished and was worth saving. He
was hopeful that the City Council would view their acrions as being serious in proceeding with the
rehabilitation.
Ms. Moermond stated that the Council was extremely frustrated by the fact that Mr. Zielke's law
firm had received notification on the Order to Abate back in August yet they had not been retained
and had not taken responsibility until later.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building had not
been inventoried and there were only two houses on Fuller that had been inventoried. She did not
believe this building was eligible for historic designation; however, from the photos, it appeazed the
porch was original and she believed this Queen Anne style-building could contribute back to the
neighborhood.
Ms. Moermond stated that in reviewing the documentation that was presented, there was reference
to E�ibit E conceming the financing. She asked Mr. Folkenson whether he had this
docuxnentation.
Mr. Folkenson responded that he had not yet received the financial documentation. He explained
that he received a call late on Thursday and had been working through the weekend with HomEq on
developing the bid. He stated that he exclusively worked on foreclosure properties in St. Paul and
Minneapolis and had also done a lot of rehab work himself. When he walked into the property, he
had not expected it to be in such good condition: it was a two and one-half story Queen Anne; the
wood work was original; the ceilings were nine feet; the entire third story was recently remodeled
into three bedrooms, the hardwood floors on the second story had been re-done; there were new
windows that had been put in incorrectly which would need to be re-done; all of the copper was
there; all of the mechanicals were there, the appliances were gone and the kitchen would need to be
remodeled. He stated that they were going to do a good job on the rehabilitation of the property.

Ms. Moermond asked Mr. Folkenson whether he was the general contractor for this project. Mr.
Folkenson responded that he was not but that he was "the whip cracker." He guaranteed that
everything would be done well and correctly and that the last thing the neighborhood needed was
another cruddy rental property. HomEq had made the commihnent to make the repairs based on the
fact that the land was worth approximately $45,000 and when the building was rehabbed, it would
be worth approximately $140,000. HomEq estimated that they would be recovering approxunately
$50,000 in equity from the sale of the rehabilitated property.
Mr. Magner presented some background information concerning the history of the property. It first
became a vacant building in 2004. The property was owned by a person who had a tendency to
purchase properties, transfer ritle to another family member, get a mortgage, and then sell it back to
himself taking out another mortgage. Ms. Moermond asked who this person was. Mr. Magner
responded that it was Babatunde Okania. Mr. Okanla lost the property after it had two or three
mortgages, raising the value quite high, and it then went into foreclosure. This property was then
brought before the Legislative Hearing Officer on a recommendation to demolish the building or
grant 180 days to rehab. Bob Pilz, HomeVestors, purchased the property, began rehabilitation, and
before the property had the certificate of code compliance, he iliegally occupied the property with a
large family. The City made the mistake of not forcing a vacate; however, there were
approximately 10 to 11 children in the family and the building inspectors were asked to give some
slack on some of the basic maintenance issues which still needed to be addressed. The health/safety
issues were addressed and the family subsequently moved out. In January, 2006, the building was
signed off on the code compliance and in March, 2006, a vacant building file was again opened as
the property was vacant and wa's going into foreclosure. The property now needs to completely be
rehabilitated so that it can be sold, hopefully as an owner-occupied property, or the building needed
to be demolished.
Ms. Moermond asked for a time period on the 10 summary abatement/work orders. Mr. Magner
responded that at that time, he was the inspector on this property and there was weekly dumping in
the alley and that this alley was notorious for people dumping up and down the alley. The suxmnary
abatements go back to November, 2006 when they opened the file and they continued through
November, 2007. It was his understanding that there were no current violations; however, the
property had not recently been inspected.
Ms. Moermond stated that it was her understanding that this occurred while there was a previous
realtor who was not managing the property very well. She indicated to Mr. Folkenson that he
needed to monitor the property to make sure the walks were shoveled and if anything was dumped
on the property, it was cleaned up.
Mr. Folkenson responded that he had a landscaping business in addition to being a realtor and he
monitored his properties on a weekly hasis. He said he could not understand why other agents did
not do this.
Ms. Moermond stated that she would need to see a letter from HomEq indicating that they would
commit $50,000 to $60,000 to the rehabilitation for this property.
Mr. Magner stated that he also needed the registered vacant building registration form to be filled
out by Mr. Folkenson. [Note: Mr. Folkenson was given the form at the meeting which he filled out
and gave to Mr. Magner.] Mr. Magner stated that he would like the letter from HomEq Services

indicating that they had reviewed the bid received from Delaney and that they were prepazed to
commit the $50,000 funds necessary for the rehabilitarion.
Mr. Zielke asked to correct the record conceming his law firm. He had reviewed the file and it
indicated that they had been trying to communicate with their client back to August, 2006. His firm
did take these matters seriously and perhaps they should have made better attempts to inform their
client that this matter was in need of immediate attention.
Ms. Moermond stated that this was not presented to the City Council in that an associate from NIr.
Zielke's firm indicated that their firm had only been retained by the client a few days before the
public hearing. Nothing was mentioned that his firm had been attempting to communicate with
their client going back to August.
Mr. Zielke stated that he was very impressed with Mr. Folkenson and believed he would do a very
good job in handling this property.
Ms. Moermond stated that she will recommend granting 180 days to rehabilitate the building on the
condition that HomEq provides a letter indicating that they will set aside the funds to do the
rehabilitation to the property.
The hearing adjourned at 1230 p.m.
