08-21Council File # ��' a� Green Sheet # O�� CITY OF � � Presented RESOLUTION PAUL, MINNESOTA 1 WHEREAS, Depariment of Safety and Inspections has requested the City Council to 2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking 3 and removal of a two story, wood frame, single family dwelling with a detached, one stall, wood 4 frame garage located on property hereinafter referred to as the "Subject Properry" and commonly 5 known as 977 EDGERTON STREET. This property is legally described as follows, to wit: FAIRVIEW ADDITION LOT 4 BLK 16 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Department of Safety and Inspections on or before March 31, 2007, the following axe the now known interested or responsible parties for the Subject Property: National City Bank Of Midwest, I50 Allegheny Center, Pittsburgh, PA 15212; Usset and Weingarden, 4500 Park Glen Rd, #120, Minneapolis, MN 55416; Customer Driven Realty, 5005 Hooper Lake Rd, Deephaven, MN 55331; Payne-Phalen District 5 Planning Council. WHEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated August 29, 2007; and WHEREAS, this order informed the then known interested ar responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by September 28, 2007; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing OfYicer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, December 11, 2007 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Subject Property safe and not detrimental to the �g-�� 1 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 public peace, health, safety and welfare and remove its blighting influence on the community by demolishing and removing the structure in accordance with all applicable codes and ordinances. The demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, January 2, 2008 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 977 EDGERTON STREET. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. 6. That the deficiencies causing this nuisance condition have not been corrected. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buildings. 8. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. ORDER The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its ����� 84 85 86 87 88 89 90 91 92 93 94 95 96 97 98 99 100 101 102 blighting influence on the community by demolishing and removing the structure in accordance with all applicable codes and ordinances. The demolition and removal of the structure must be completed within fifteen (15) days after the date of the Council Hearing. If the above corrective action is not completed within this period of time Department of Safety and Inspections is hereby authorized to take whatever steps aze necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all persona] property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 4 It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. Verify a separate 20 ampere laundry circuit and a separate 20 ampere kitchen appliance circuit. 5. Install "S" type fuse adapters and proper size "S" fuses/sited circuit breakers. 6. NOTES **See attachment for permit requirements. Most of the roof covering could not be properly inspected form grade. Recommend this be done before rehabilitarion is attempted. There was considerable storagelclutter within properiy at the time of the inspection. All to meet appropriate Codes when complete. All items noted as recommended do not have to be completed for code compliance but should be completed at a later date. The City Clerk will then schedule dates for Public Hearings before the City Council at which tune testimony will be heard from interested parties. Aftez this hearing the City Council wili adopt a resolution stating what action if any, it deems appropriate. Ordering the owner to remove or repair Yhe building(s) at 977 Edgerton StreeY within fifteen (15) days from adoption of resolurion. Mr. Magner stated the building was a two story, wood frazne, single-famiIy dwelIing with a detached one-stalI garage on a lot of 4,792 square feet and had been vacant since Apri19, 2004. A code compliance inspection had been done on September 14, 2006. The vacant buiiding registration fees were delinquent in the amount of $375 and fhe $5,000 performance bond had not been posted. On August 23, 2007, an inspecrion of the building was done and a list of deficiencies which consritute a nuisance condition was developed. An order to abate a nuisance building was posted on August 29, 2007 with a compliance date of September 28, 2007. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Tu�ation estimated the mazket value of the land to be approximately $43,700 and the building to be $125,700. Real estate tases for were current. Code Enforcement estimates the cost to repair the building to be approximately $40,000 to $50,000. The cost for demolition was estimated to be approximately $10,100 to $14,100. There had also been seven summary abatements issued to this property, three of which went to work order: to secure the building and the City had to board the building to secure it from trespass and remove improperly stored refuse. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented phofographs of the property. The property owner of record, National City Bank of Midwest, did not appear. Lynn Hooper, Customer Driven Realty, REO for the property, appeared. He stated that he was representing the bank, HLAL Home Loan Associatian who had acquired the asset from National City Bank as it was his understandzng that National City had gone into receivership. Ms. Moermond asked him how long he had been working with this property. Mr. Hooper responded that the property was listed for sale on Apri126, 2007. Ms. Moermond asked Mr. Hooper if he and his client wanted to sell the property "as is" rather than do the rehab themselves. NIr. Hooper responded that he had received two bids on the property per the Bank's request. He said that with tY�e nuxnber of foreclosures, banks had suffered severe financial iosses as a resuit. The Bank was going to lose a fair amount of money on this property especiaily in light of the bids that were received. He was attempting to find a single-family buyer for the property who could possibly obtain an FHA loan and would do the rehab. Ms. Moermond asked the amount on the bids that were received. Mr. Hooper responded that he did not have them with him; however, he believed one was $55,000. He was attempting to find good buyers for neighborhoods as opposed to finding a buyer with no money doum because they generally end up back on the market. He asked for time to continue marketing the property for sale so that someone could purchase Yhe property and do the required rehabilitation work. Ms. Moermond stated that the nuisance condition needed to be abated. She asked how much was � owing on the mortgage. Mr. Magner stated that the outstanding mortgage was $148,000 and there was a second mortgage in the amount of $37,000. Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner stated that the Code Enforcement inspector referred this property to the Vacant Buildings Program as the electricity and gas had been shut off; there were broken windows; there was tall grass and weeds; ���� December 11, 2007 Legislative Hearing Minutes the building was open to access and appeared to be abandoned. Page 12 Ms. Moermond asked about the snmmary abatements that had been issued since the vacant building file had been opened and when they had occuned. Mr. Ma�er responded that the three work orders were issued when the fi1e was first opened. The last time a work order had been sent was Apri1, 2007. Mr. Hooper stated that the redemption period ended Apri14, 2007 so the Bank did not take responsibility for maintaining the property until after that date. Mr. Magner stated that the work order was sent on Apri191ikely prior to Mr. Hooper being assigned to the property. He said that there had been some summary abatements issued since April; however, it appeared that the property was being maintained as none had gone to wark order. Ms. Moermond stated that the vacant building fees were due and owing. Mr. Magner responded that the vacant buiiding fees were owing in the amount of $375. He suggested Mr. Hooper have his client pay the vacant building fees and submit a vacant building registration form. Mr. Hooper stated that he was not aware of this and he would make sure this was taken care of. Mr. Magner stated that this property was in the Tnvest 5aint Paul area and was across the street from the "Make it Right-Make it Work" targeted azea and was considered in the bnffer zone. The neighbors have requested that the City make an effort to abate the nuisance properties for any properties located in these targeted areas. 4Vhen they met with the neighbors and did a walk through in the neighborhood, this property was specifically pointed out as another building that needed to be addressed. Ms. Moermond stated that she didn't believe the City would be willing to grant additionai time to find a buyer for the property who would do the rehabilitation. She stated that the nuisance condition needed to be abated which meant either the Bank would have to do the rehabilitation or the City would demolish the building. She believed the estimated cost of the repairs was fairly moderate and she believed it may be in the Bank's best interest to make the repaus and market it for sale. Mr. Hooper stated that he also did not believe that this house was in that bad a shape and should be rehabilitated. Mr. Magner stated that it essentially was a mathematical issue as to the value of the property once the building was rehabbed and how much they could sell the property for after the rehabilitation was done. The Bank would need to decide whether it was worth the risk to put the $50,000 into rehabbing the building with the hopes of selling the property for whatever price they could get for it. This was a case where clearly, the equity had been stripped on the property. Ms. Moermond stated in order for her Yo grant additional time, she would require the foliowing be compieted by the end of business on Friday, December 28: 1) the vacant buiiding fees must be paid and the registrarion completed; 2) the $5,000 performance bond must be posted; 3) a work plan with timelines and estimated cost of repairs must be received; and 4} financial documentation showing $40,000 to $50,000 is dedicated to complete the cost of the repairs to the building.
