WHEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated August 28, 2007; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Properiy is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by September 27, 2007; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of Che City Council and the Saint Paul Ciry Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, December ll, 2007 to heaz testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighting influence on the community by demolishing and removing the structure in accordance with all applicable codes and ordinances. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. 3. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). That the deficiencies causing this nuisance condition have not been corrected. That Department of Safety and Inspections has posted a placazd on the Subject Property which declares iY to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buildings. 8. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. ORDER The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall make the Subject Property safe and not dettimental to the public peace, health, safety and welfare and remove its v�-�-D 83 84 85 86 87 88 89 90 91 92 93 94 95 96 97 98 99 100 blighting influence on the community by demolishing and removing the structure in accordance with all applicable codes and ordinances. The demolition and removal of the structure must be completed within five (5) days after the date of the Council Hearing. 2. If the above corrective action is not completed within this period of time Department of Safety and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. 3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance wiCh Chapter 45 of the Saint Paul Legislative Code. According to our files, it has been a vacant building since October 5, 2006. The current property owner is MTGLQ Investors LP c/o Ocwen Federal Bank FSB, per AMANDA and Ramsey county property records. The city has had to board this building to secure it from trespass. There have been seven (7) SUMMARY ABATEMENT NOTICES since 2006. The stairs have missing or defective handrails. Provide all interior and exterior stairways and steps of more that three (3) risers with handrails which are grippable and installed 34" to 38" above the nose of the stair treads. 9. There are missing or defecrive guardrails. Provide all stairways, porches, decks or steps which ase more than 30" high with guardrails and intermediate rails with openings in the guardrail no mare than four (4) inches apart and in accordance with the State Building Code. Building 21. Where wall and ceiling covering is removed, attic, replace doors and windows, (insula6on, glass, weather sh etc.) shall meet new energy code standards. 22. Any framing members that do not meet code (where wall and ceiling covering is removed, members that are over-spanned, over-spaced, not being carried properly, door and window openings that are not headered, etc.) are to be reconstructed as per code. 23. Habitable rooms with new usage, replaced windows shall have glass area equal to 8% of floor area, or a minimum of 8 sq. ft., one-half of which shall operate and all bedroom windows sha11 meet emergency egress requirements (20" wide minimum, 24" high minimum but not less than 5.7 sq. ft. overall). 24. NOTES *�See attachment for permit requirements. Most of the roof covering could not be properly inspected from grade. Recommend this be done before rehabilitation is attempted. There was considerable storage/clutter within property at the time of the inspection. All to meet appropriate codes when complete. All items noted as recommended do not have to be completed for code compliance but should be completed at a later date. Ordering the owner to remove or repair the building(s) at 950 Desoto Street within fifteen (IS) days from adoption ofresolution. Mr. Magner stated the building was a two-story, wood frame, duplex with a wood shed on a lat of 6,534 squaze feet and had been vacant since October 5, 2006. A code compliance inspection had been done on April 4, 2047. The vacant building registrarion fees were delinquent in the amount of $3'IS and the $5,000 performance bond had not been posted. On August 23, 2007, an inspection of the buiiding was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on August 28, 2007 with a compliance date of September 27, 2007. To date, the property remained in a condirion which comprised a nuisance as defined by the Legislative Code. Ramsey County Tasation estimated the market value of the land to be approximately $53,400 and the btrilding to be $171,800. Real estate tases were current. Code Enforcement estimates the cost to repair the building to be approximately $40,000 to $SQ,000. The cost far demolition was estimated to be approximately $12,145 tn $16,145. There had also been seven summary abatements issued to this property, six ofwhich went to work order: to secure the building and the Ciry had to board the building to secure it from trespass, remove improperly stored refuse, cut tall grass and weeds, and remove snow and ice. Mr. Magner presented photographs of the property. Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner stated that this had been a probiem property in the neighborhood which had been referred to the Vacant Building Program by a Code Enforcement inspector as the building was in foreclosure and there were many exterior violarions. They had to board the entire building as there were repeated break- ins to the building. Ms. Moermond stated that the code compliance inspection report was done for Craig Murphy and she wanted to know how he was involved wieh this property. Mr. Magner stated that Mr. Murphy is an REO with Epic Realty and he believed he likely no longer was assigned to this property. The property owner of record, MTGLQ Investors LP c/o Ocwen Federal Bank FSB, did not appear. Dean Moen and Jennifer Gants Moen appeared and stated that they lived at 944 Desoto which was next door to this property. Mr. Moen stated that this house was a flop house; drug house; peaple broke into it and stole copper piping, which was the same situation with the property across the street at 951 Desoto. Since the building had been boarded up October, 2006, it has been more peaceful; however, the basement had been broken into several times. He frequently walked around the property to monitor any illegal activity and law enforcement had become more active in patrolling the neighborhood. He believed that the neighborhood was not the bast neighborhood; however, he believed the property owners needed to stand up and let the City know wfiat was going on in their neighborhood to make it a better place to live. Ms. Moen stated that they had lived there since 1998 and she was aware that 950 had been flipped about three to four times since they maved in and had always been rental properry. She said that they had to move their bedroom to the back of the house as the traffic from selling drugs was 24l7 and they couid not stand the noise. She wanted to see the building demolished and perhaps a new single-family Habitat house couid be built on the land. She stated that she would rather look at an December 1 l, 2007 Legislative Hearing Minutes �� � Page 10 empty lot than to continue to have a property that was a complete eyesore. She said it previously had been nnpossible to work out in the yazd and since the building had been boarded, she was now able to work outside in her garden again. Mr. Moen stated that he was considering purchasing the empty lot and putting a gazage on it since they did not have a garage. He said that he planned to attend the City Council Public Hearing to see the outcome of the Council's decision. Ms. Moermond asked Mr. Magner if the gas had been shut off prior to the copper piping being stoien. Mr. Manger stated that he was not sure and would have to check. Mr. Moen stated khat when he had taking the garbage out one morning, there was a dark green Forcl Explorer pulling copper piping out from a corner by the house thae had been removed during the night and covered with a blanket. He attempted to get the license nuxnber and called the Police. Mr. Magner stated that the Police did catch the individual in the dark green Bxplorer. Mr. Magner stated thaC it would be Code Enforcement's recommendarion Co reduce the time to remove the buildina from 15 days to 10 days. Ms. Moermond recommended the building be removed within five days with no option for repair. She encouraged the Moens to attend the Council Publzc Hearing as she believed the Council needed to know what the neighbors were dealing with on the numerous vacant buildings in the City.
