Project I 35E-4 (7) 116, and • " � iNHEREAS the State in 1957 and 1958 constructed an earth embankment fill f for Ramp "B" to serve as the off traffic ramp-from the south bound roadway to � Maryland Avenue, and � WHEREAS said embankment fill for Ramp "B" crossed and covered a City owned � and operated 90 inch "Maryland-Westminster" combination sewer lateral which is isupported by concrete cradles on piling specially designed to carry the planned � height of embankment of Ramp "B" and was installed by the City in 1955, and • � NIHEREAS during the construction of the ramp, the embankment height was � increased by placing an earth overload to obtain settlement of the ramp fill to � insure a firm foundation for the roadway, and WHEREAS the weight of the State's embankment materials has caused said � sewer to settle 5 to 6 feet and pull apart at the joints to the degree tliat � repairs must be made to restore the sewer to the same condition it was prior to � the time the State placed the fill for Ramp "B", and to protect the sewer from further damage; also to protect property drained by the sewer and to protect �Trunk Highway No.- 35E from damage, and , • � � VVI�REAS the City has prepared plans aad specifications for the repair of p said portion of said City owned combination sewer, and as the City is not �` adequately staffed or equipped to repair said sewer with its own forces it is the desire of the parties to this agreement that said sewer repair be performed , by the City- under contract awarded by the City, and that the State shall � reimburse the City for costs incurred by the City in connection therewi.th as � hereinafter provided, and � WHEREAS, Title 23, United States Code, Section 123 (a� providess f COUNCILMEN Adopted by the Council 19— �;' � Yeas Nays - �. Federal funds shall not be used to reimburse the State under this section when the payment to �,, � the utility violates the law of the State or violates a legal contract between the utility and the State. Such reimbursement shall be made only after evidence satisfactory to the Secretary shall have been presented to him substantiating the fact that the State has paid such cost from its own funds with respect to Federal-aid highway projects for which Federal funds are obligated subsequent to ' April 16, 1958, for work, including relocation of utility facilities," and WF�REAS Minnesota Laws 1959, Chapter 500, Article II, Section 4b, subsection � 2 providess "Whenever the Commissioner of Highways shall determine that the relocation of any utility facility is necessitated by the construction of a project on the routes of federally-aided State Trunk highways, including urban extensions thereof, � which routes are included within the National System of Interstate Highways, the i� owner or operator of such utility facility shall relocate the same in accordance � with order of the Commissioner.
