Gentlemen: • We represent the owners of the property adjoining the vacated alley and vacated Rose Street running West from • Westminster Street. A building is under construction on a portion of said land which building is partially on said sacated alley. AnothEr building is proposed wh ich will be • partially on vacated Rose Street. In the vacation proceedings an easement was re- served to the City of St. Paul on said vacated property for public utility rights pursuant to Ordinance No. 3394, and amendments thereof. ' The attorneys for the loan company financing said co�istruction contend that in as much as the buil�ing is partially on lthe alley and the proposed building will be partially in vacated Rose Street, the easements constitute a cloud on the �itle, and refuse to allow the mortgage company to pay out any mortgage money for the constructinn said build- ings. We feel they are right in their opinion. Without the mortgage money the buildings cannot be completed, and ou� clients stand to lose considerablelmoney. We understand there is no utility equipment on or in said vacated street and alley. In view of the foregoing we respect- . fully request that you relinquish by resolution, or any other � proper method, the easement in said vacated street and alley.
