Whereas, HF 498/SF 446, known as the "Shoot Fust", "Stand your Ground" and "Castle Doctrine" bill is working
iYs way through the Minnesota Legislature; and
WHEREAS, this bill would overhaul Minnesota law on the justifiable taking of life eliminating the requirement to
retreat and attempt to escape as a defensive action, and instead would allow for use of all force and means, including
deadly force, that the individual believes is required to defend his or her house, yazd or vehicle; and
WHEREAS, this bill states that anyone who enters a property by force or by stealth is presumed to do so with the
intent of committing an unlawful act involving a[ife-threatening [evel offorce; and
WHEREAS, in Florida, where the "Shoot FirsY' law has already taken effect, the Florida Prosecuting Attorneys
Association says the law is unnecessary and complicates murder prosecutions of people who are too quick to fire a
weapon, and in fact is even being used by an alleged gang member to defend himself against charges in the death of
a nine-year-old, who was caught in the crossfire of a street conflict. In three other Florida cases, individuals were
shot in incidents growing out of disputes between neighbors; and
WHEREAS, the Minnesota Police and Peace Police O�cers' Association opposes the bill; and
WI IEREAS, Minnesotans already have the right to defend themselves, and supporters of the "Shoot FirsY' bill have
not yet produced an actual case in Minnesota where anyone has gotten into trouble for defending themselves, thus
making it difficult to justify the necessity of this change to State law; and
WHEREAS, Ramsey County Prosecutor Susan Gaertner has stated that "Shoot FirsY' is a solution in search of a
problem. NOW, THEREFORE BE IT
RESOLVED, that the City of Saint Paul opposes HF 498/SF 446, the "Shoot FirsY' bill, and urges the Minnesota
Legislature to vote against any such changes to our existing State law.
