O'Connell City Clerk Building Dear Madam: This is in the matter of'the Northwestern State Bank for 1) an appeal to relax the required eigbt -foot side yard set back requirement of Section 60.23, para- graph 5, sub - paragraph "a" of the Zoning Code, and 2) an application for a permit for a ten car customer off-street parking lot on property located on the north side of Minnehaba Avenue between Mendota and Arcade Streets. The property is des- cribed as Lot 25, Block 3, Hill's Addition. The parking lot would be in conjunction with the applicant's bank located on Minnebaba Avenue to the east. The zoning is light industry and has been since the adoption of the Zoning Ordinance in 1922. The site is presently developed with a single - family residence and garage which the applicant intends to remove fbr the proposed parking facility. This property has'a frontage along Minnebaba Avenue of 40 feet and extends to a depth of 127 feet, resulting in an area of 5,080 square feet. East and west adjoining are single- family residences which front on Minnebaba Avenue; north and across a public alley is the Minnesota Mining Company parking lot; south and across Minnebaba Avenue are commercial uses fronting on both Maryland Avenue and E. Seventh Street. This entire block is classified in the light industry district and is partially developed residegtial and partially commercial. Section 60.23 of the Zoning Code requires an 8 foot side yard set back for screen planting where the adjoining properties are developed with residential uses. Be- cause the lot is only 40 feat wide, it would not be practical to develop or utilize this property for off - street parking purposes with the required 8 foot side yard requirements. The owner of the property immediately adjoining on the east has, by letter dated April 12, 1961, consented to the relaxation of the 8 foot planting buffer. Field investigation discloses that the waiving of the 8 foot side yard requirements as normally required would be proper as the proposed land use plan indicates the highest and best use of this land to be for light industry purposes. The Traffic Engineer has approved the parking lot plan which meets the required standards for this type of facility. Based on the present zoning, the existing land use, and the Future Land Use Plan, the Board of Zoning recommends 1) the granting of the appeal to waive the required 8 foot side yard set back requirement and 2) the granting of the permit for a 10 car customer off - street parking lot on the above described property in accordance with plans approved May 4, 1951. We would like to provide additional parking for patrons of our bank. The lot presently is occupied by a duplex which we expect to tear down. The reason we are making this appeal is that the lot is only 40 feet wide and is adjacent to residential property on both the West and East, and the City ordinance requires an 8 -foot buffer space for a parking lot adjacent to residential property. The parking situation generally in this part of the City is very bad. We believe the additional eleven spaces provided in our lot will do a lot to relieve the situation. We are appealing under building ordinance No. 64. 03, paragraph t, and are asking you to relax the 8 -foot buffer space on both sides. You will also find enclosed letter of approval from the property owner on the East side of the lot, being Mrs. Margaret Andres.
