This property is legally described as follows, to wit: LEWIS' ADDITION TO ST, PAUL LOT 22 BLK 5 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Department of Safety and Inspections on or before March 31, 2007, the following are the now known interested or responsible parties for the Subject Property: Michael Gregory I LLC, 1228 S. 54`" Street, Milwaukee, WI 53214; Michael Gregory 1, LLC 730 Jenks Ave, St. Paul, MN 55108; Colleen Gilbertson, 1228 S. 54` Street W, Milwaukee, WI 53214; Silver Hill Financial, LLC, Bayview Loan Servicing, LLC, 4425 Ponce De Leon Blvd, 5��' Floor, Coral Gables, FL 33146; Distrct 6 Planning Council. WHEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated August 29, 2007; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by September 28, 2007; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, December 11, 2007 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Subject Property safe and not detrimental to the ��i� 42 43 44 45 46 47 48 49 50 51 52 �3 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 public peace, health, safety and welfare and remove its blighting influence on the community by demolishing and removing the structure in accordance with all applicable codes and ordinances. The demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, January 2, 2008 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public heazings, the Saint Paul City Council hereby adopts the following Findings and Qrder conceming the Subject Property at 59 ATWATER STREET. l. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). 3. That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been corrected. 6. That Department of Safety and Inspections has posted a placard on the Sub}ect Property which declares it to be a nuisance condition subject to demolition. 7. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buildings. 8. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. �'� ' The Saint Paul City Council hereby makes the following order: The above referenced interested or responsible parties shall malce the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its Dg 85 86 87 88 89 90 2. 91 92 93 94 95 96 3. 97 98 99 100 101 102 4. 103 blighting influence on the community by demolishing and removing the structure in accordance with all applicable codes and ordinances. The demolition and removal of the structure must be completed within forly-five (45) days after the date of the Council Hearing. If the above corrective action is not completed within this period of time Department of Safety and Inspections is hereby authorized to take whatever steps aze necessary to demolish and remove this structure, fill the site and charge the costs incuned against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. It is further ordered, Yhat a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code. According to our files, it has been a vacant building since May 11, 2007. The current property owner is Michael Gregory I, LLC, per AMANDA and Ramsey county property records. The city has had to boazd this building to secure it from trespass. There have been eight (8) SUMMARY ABATEMENT NOTICES in 2007. There have been four (4) WORK ORDERS issued far: - Removal of improperly stared refuse - Removal of tall grass and weeds - Removal of fallen tree and debris On August 15, 2007, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NLTISANCE BLTILDING was posted on August 29, 2007 with a compliance date of September 28, 2007. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. Taxation has placed an estimated market value of $90,000 on the land and $153,400 on the building. As of December 10, 2007, a Code Compliance inspection has not been completed. ELECTRICAL - GENERAL - NEC 400-8 Remove the flexible cords where installed in raceways.-Provide approved methods for the installation of the light fixture in Unit 59-2 Pantry. 30. ELECTRICAL - GENERAL - NEC 336-6 - Provide approved methods of protection for non-metallic cable (Romex).-Rewire per current electrical code or remove the romex in the basement hallwall and Unit 59-B batluoom. 31. Secure all loose wire mold runs on the walls per electrical code as needed. 32. Mr. Magner stated the building was a two-story, wood frame, six-unit dwelling on a lot of 4,792 square feet and had been vacant since May 1 l, 2007. A code compliance inspection had been done on Apri126, 2007. The vacant building registration fees were current; however, the $5,000 performance bond had not been posted. On August 15, 2007, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on August 29, 2007 with a compliance date of September 28, 2007. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $90,000 and the building to be $153,400. Real estate taaces were current. Code Enforcement estimates the cost to repair the building to be in excess of $100,000. The cost for demolition was estimated to be approximately $19,350 to $24,350. There had also been eight summary abatements issued to this property, four of which went to work order: to secure the building and the City had to board the building to secure it from trespass, remove improperly stored refuse, cut tall grass and weeds, and remove a failen tree including debris. Mr. Magner noted that Colleen Green, the property owner had appeared at Legislative Hearings appealing tas assessments; however, she failed to attend this hearing on the demolition of the building. He indicated that he had talked Renee Andriati, Marine Brandt, the agent handling the foreclosure, and explained the Legisiative Hearing process to her regarding the property. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. The property owner of record, Michael Gregory I, LLC, did not appear. No other parties of interest appeared. The building at 59 Atwater Street is a Victorian brick double house; this type of building is rare in the North End neighborhood. The building was built in 1891 by a mason for his own residence. Despite its current condition, the building appears substantial and retains several significant architectural features including the original pressed metal above the porch and double doors with transom windows. The building at 59 Atwater Street is located in an Invest Saint Paul priority area. The stated purpose of the Invest Saint Paul initiative is to focus private and public resources on neighborhoods suffering from disinvestment. Historic Saint Paul believes that the building at 59 Atwater Street could be transformed into an asset that serves to attract additional investment into the North End. Buildings such as these are integral in defining the unique character of our neighborhoods. Historic Saint Paul respectfully requests that the City Council consider staving off the demolition of 59 Atwater Street until options for rehabilitation have been evaluated. Historic Saint Paul would be glad to assist in the process of identifying alternatives to demolition.
