This property is legally described as follows, to wit: AUDITOR'S SUBDNISION OF LOT 6, BIDWELL'S ADDITION TO WEST ST. PAUL EX PAKT IN ST; LOT 31 TOGETHER WITH ALL OF LOT 32 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Department of Safety and Inspections on or before Apri12, 2007, the following are the now known interested or responsible parties for the Subject Property: MERS, c/o Keller Williams, 3100 Lake Street W, Suite 300, Minneapolis, MN 55416; Wilford & Geske, 7650 Currell Blvd, Suite 300, Woodbury, MN 55125; West Side Citizens Organization. WHEREAS, Deparhnent of Safety and Tnspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated October 25, 2007; and WHEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsibie parties that they must repair or demolish the structure located on the Subject Property by November 26, 2007; and WI3EREA5, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolirion; and WHEREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accardance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, January 29, 2008 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to arder the interested 0$-/�9 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 or responsible parties to make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighring influence on the community by demolishing and removing the structure in accordance with all applicable codes and ordinances. The demolition of the structure to be completed within fdteen (1� days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, February 20, 2008 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 815 ROBERT STREET SOUTH. 1. 2. 3. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislarive Code, Chapter 45. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then laiown responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. � 7 That the deficiencies causing this nuisance condition have not been corrected. That Department of Safety and Inspections has posted a piacard on the Subject Properiy which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, VacantlNuisance Buildings. The demolition and removal of the siructure must be completed within fifteen (15) days after the date of the Council Hearing. If the above corrective acrion is not completed within this period of time Department of Safety and Inspecrions is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Properry pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. 3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 4. It is fiirther ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul I,egislative Code. The property owner of record, MERS c/o Keller Williams, did not appear. Heidi Soll appeazed and stated that she lived next door to this property and wanted to see the building demolished. Mr. Magner stated the building was a one and one-half story, wood frame, single-family dwelling with a detached one-stall garage on a lot of 5,663 square feet and had been vacant since Febrnary 28, 2007. A code compliance inspection had been done on May 11, 2007. The vacant building registration fees were delinquent in the amount of $250 and the $5,000 performance bond had not been posted. On October 4, 2007, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on October 25, 2007 with a compliance date of November 26, 2007. To date, the property remained in a condition which comprised a nuisance as defined by the Legisiative Code. Ramsey County TaYation estimated the market value of the land to be approximately $46,000 and the building to be $119,800. Real estate taxes were current. Code Enforcement estimates the cost to repair the building to be approximately $50,000 to $60,000. The cost for demolition was estimated to be approximately $8,650 to $11,650. There had also been seven si.iuunary abatements issued to this property since 2007, four of which went to work arder: to secure the building and the City had to board the building to secure it from trespass, and remove snow and ice. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the properiy. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this was a 1930 brick, revival style building; it had not been surveyed; it was not locally designated. She noted that it was located on a corner lot which generally anchored the block. She also stated that this was a short block and did not have any strong style of any particular type of house. She believed there were better choices that would complement the other architectural styles of this neighborhood. Ms. Moermond asked how they became awaze this was a vacant building. Mr. Magner stated this was a referral from the Police Department on an emergency boarding. The property was found to be vacant and open to access. Ms. Moermond inquired about the sununazy abatements that had been issued and had gone to work order. Mr. Magner stated that according to the file, it appeared that one of the orders to mow the lawn had been done by someone else; the remainder went to work order. Ms. Soll presented written letters for the record which are attached and made a part of this record. She stated that she and her boyfriend had gone through the house when it went for auction with the idea of purchasing the property to rehab it, possibly then sell it or rent it out. After going through the house, she believed the City's estimate for the cost of the repairs was too low as she believed the garage needed to be replaced as a vehicle would barely fit in the stail. In her opinion, the amount of investment that would be required to make the repairs was too great for what the property could be sold for. She stated that when she inquired about the property when it went to auction, she had a difficult time getting any inforxnation. The house was supposed to be open for viewing on two separate weekends, and the first weekend, the house was left open the entire weekend with no one in it. Later that evening, she noticed that the jar was left ajar and she called the Police to report it. The Police came out and had the door bolted shut. The following weekend, the house was not open to go in for an inspection. Not providing this would be deceptive and wrong — it is shocking to me that the bank, Countrywide Home Loans who requested the inspection has not made it available to your business and the public. This in itself seems deceptive and discrediting of that company and their business .practices. In adairion to the list of code compliances, Counh•ywide has not paid their vacaut building fees and anyone that wants to rehab this category 3 vacant building will be required to post a$SOOQ bond to the City of St Paul, provide a timeline of repairs and show how the project will be fmanced. The home was also locked down this last weekend and myself and at least two other parties were unable to view the properiy, as stated on the website.
