1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecldng
3 and removal of a two story, wood frame, duplex with a detached, two stall, wood frame garage
4 located on property hereinafter referred to as the "Subject Property" and commonly known as
5 400 EDMUND AVENUE. This properiy is legaliy described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspecrions on or before Apri12, 2007, the
following are the now lrnown interested or responsible parties for the Subject Property:

WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an°Order to
Abate Nuisance Building(s)" dated October 15, 2007; and
WfIEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by November 14, 2007; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constihxte a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Lea slafive
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the pubiic hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, January 29, 2008 and February 12, 2008 to hear testimony and
evidence, and after receiving testimony and evidence, made the recommendation to approve the

request to order the interested or responsible parties to make the Subject Properiy safe and not
detrimental to the public peace, health, safety and welfaze and remove its blighting influence on
the community by demolishing and removing the struchxre in accordance with all applicable
codes and ordinances. The demolition of the structure to be completed within five (5) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
February 20, 2008 and the testimony and evidence including the acrion taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the tesrimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 400 EDMUND AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then lrnown
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by demolishing and removing the structure in
accordance with ail applicable codes and ordinances. The demolition and removal of the
structure must be completed within five (5) days after the date of the Council Hearing.
2. If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any ldnd which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
102 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
103 parties in accordance with Chapter 45 of the Saint Paul Legislarive Code.

The Department of Safety and Inspections has declared this building(s) to constitute a"nuisance"
as defined by Legislative Code, Chapter 45. The Department of Safety and Inspections has
issued an order to the then known responsible parties to eliminate this nuisance condition by
correcting the deficiencies or by razing and removing this building(s).
The property was re-inspected on November 19, 2007. There was no compliance and the
nuisance condition remains unabated, the community continues to suffer the blighting influence
of this property. It is the recommendation of the Deparlment of Safety and Inspections that the
City Council pass a resolution ordering the responsible parties to either repair, or demolish and
remove this building in a timely manner, and failing that, authorize the Department of Safety and
Inspections to proceed to demolition and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taxes.

The building is a two-story, wood frame, duplex with a detached two-stall garage on a lot of
3,920 square feet.
According to our files, it has been a vacant building since February 21, 2007.
The current property owner is Deutsche Bank National Trust Co, c/o Wells Fargo, per
AMANDA and Ramsey county property records.
The City of St. Pau] has boarded Yhis building to secure iY from trespass.
There have been five (5) SUMMARY ABATEMENT NOTICES since 2007.
There have been five (5) WORK ORDERS issued for:
- Removal of refuse
Removal of snow and ice
Removal of tall grass and weads
On August 17, 2007, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on October 15, 2007 with a compliance date of
November 14, 2007. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are delinquent in the amonnT of $625.00.
Taxation has placed an estimated market value of $41,800 on the land and $136,600 on the

As of January 28, 2008, a Code Compliance inspection has not been completed.

Inspections, Division of Code Enforcement, hereby declares the premises located at:

Chapter 45.02, and snbject to demolirion under authority of Chapter 45.11.
On August 17, 2007, a Building Deficiency Inspection Report was compiled and the
foliowing conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time. As
first remedial action, a Code Compliance Inspection must be obtained from the
Building Inspecrion and Design Section, S Fourth Street East, Suite 200, Commerce
Buiiding (651)266-9090. That inspecrion will identify spec�c defects, necessary
repairs and legal requirements to correct this nuisance condition. You may also be
required to post a five thousand dollar ($5,000.04} performance bond with the
Buitding Iaspection and Design Office before any permits are issued, except for a
demoiition permit.

This building{s) is subject to the reshictions of Saint Paul Ordinance Chapter 33.03 and
shall nof again be used for occupancy until such tune as a Certificate of Compliance or a
Certificate of Occupancy has been issued.
This is a two-story, wood frame, duplex with a detached, two-stall, wood frame garage.
Note: The dwelling was open to entry.
Interzor
The bathroom floor covering is deteriorated or inadequate. Provide
floor covering which is impervious to water and easiIy cleanabie
throughout the bathxoom and seal around the edges and fixtures.
2. FURNACE: Have a licensed hearing contractoz servica and clean the
fumace or boiler and make any necessary repairs. Perform a C/O test on
the heating plant. Then, send the attached form back to the Inspectar.
Repair of gas fired appliances requires a permit.
3. G.F.C.I.: The bathroom is lacking an electricai G.F.C.I. outlet. Permit
May Be Required.
4. The stairs have missing or defective handrails. Provide all interior and
exterior stairways and steps of more that three (3) risers with handrails
which are grippable and installed 34" to 38" above the nose of the stair

5. The interiar ceilings are defective. Repair all ceiling defects and finish
ni a professional manner.
6. The interior walls are defective. Repair all wall defacts and finish in a
professional manner.
7. There is evidence of a rodent infestation. Immediately exterminate and
eliminate all rodents from the entire building. Remove rodent
harborages in the yazd areas. Tuckpoint the foundation if necessary to
rodent-proof the building to prevent re-infestation. Tmmediately remove
any dead rodents from the premises.
8. SAlVITATION: Immediateiy remove unproperly stored or accumulated
refuse including; garbage, rubbish, junk, vehicle parts, wood, metaI,
recycling materials, household items, building materials, rubble, tires,
etc., from yazd. The Saint Paul Legislative Code requires all exterior
property areas to be maintained in a clean and sanitary condition.
Usable materials must be stored in an approved manner, so as not to
constitute a nuisance.

9. Smoke Detector: Lack of properly installed and operable smoke
detector. Provide functioning smoke detectors in accordance with the
attached requirement, within 24 hours.
10. The windows and/or stozm windows aze in a state of disrepair. Replace
all missing or broken window gIass. Make aIl necessary repairs eo
frames, sashes, hazdwaze and associated trim in a professional manner.
Permit may be required.
11. Lacking window locks. Provide operabie window locks for all windows
except third floor and above.
Exterior
12. Tke chimney is defective, deteriorated or in a state of disrepair. Replace
a11 missing or defective bricks, tuckpaint as needed to restore the
chitnney to a professional state of maintenance and repair. Permit may
be required.
13. The eaves and soffits are in a sYate of disrepair or deterioration. Repair
all defects, holes, breaks, loose or rotting boards, to a professional state
of maintenance. Permit may be required.
14. The exterior wa11s and/or trim of the gazage has defecrive, peeled,
flaked, scaled or chalking paint or has unpainted wood surfaces. Scrape
and repaint to effect a sound condition in a professional manner.
15. The exterior walls and/or trim of the house has defective, peeled, flaked,
scaled or chalking paint or has unpainted wood surfaces. Scrape and
repaint to effect a sound condition in a professional manner.
16. The foundation is deteriorated, defective or in a state of disrepair.
Repair all foundation defects in a professional manner eo a
weather-tight, water-tight and rodent-proof condirion. Permit may ba
required.
17. There are missing or defective gtzardrails. Provide all stanways,
porches, decks or steps which aze more than 30" high with guardrails
and intermediate rails with openings in the guazdrail no more than four
{4) inches apart and in accordance with the State Bnilding Code.
18. The exterior walls of the garage are defective. Repair all holes, breaks,
loose or rotting siding, to a professional state o£ mainYenance.
19. The exterior walls of the house are defective. Repair all holes, breaks,
loose or rotting siding, to a professional state of maintenance.

20. The window andlor door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable
windows and doors. Screens must be tight-fitting and securely fastened
to the frames.
As owner, agent or responsible party, you aze hereby notified that if these deficiencies and
the resulting nuisance condition is not corrected by November I4, 2007 the Department
of Safety and Inspections, Division of Code Enforcement, will begin a substantial
abatement process to demolish and remove the building(s). The costs of this action,
including administrative costs and demolition costs will be assessed against the property
t�es as a special assessment in accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce
Building, (651)266-9090. This inspection will identify specific defects, necessary repairs
and legal reqairements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent
renters and any subsequent oumers. If you sell, transfer, or convey in any manner, the
ownership or responsibility for this property, you must within seven (7) days, notify the
Enforcement Officer with the names and addresses of any new owners or responsible
parties.
The Enforcement Officer is required by law to post a placard on this property which
declares it to be a"nuisance condition", subject to demolirion and removal by the City.
This placard shall not be removed without the written authority of the Department of
Safety and Inspections, Division of Code Enforcement. The depariment is fixrther
required to file a copy of this "Order to Abate° with the City Clerk's Office.
If conective action is not taken wifhin the time specified in this order, the Enforcement
Officer will notify the City CounciI that abatement action is necessary. The City Clerk
will then schedule dates for Public Hearings before the City Council at which time
testimony will be heard from interested parties. After this hearing the City Council will
adopt a resolution stating what action if any, it deems appropriate.
If the resolution ca11s for abatement acfion the Council may either order the City to take
the abatement action or fix a time within wYuch this nuisance must be abafed in
accordance with ttte provisions of Chapter 33 of the Saint Paul Legislative Code and
provide that if corrective action is not taken within the specified tune, the City shall abate
this nuisance. The costs of this action, inctuding administrative costs will be assessed
against the property as a special assessment in accordance with law.

8. Ordezing the owner to remove or repair the building(s) at 400 Edmund Avenue within
fifteen (15) days from adopfion of resolution.
The property owner of record, Deutsche Bank Nationa] Trust Co, c/o Wells Fazgo, did nof appeaz.
No other parties of interest appeazed.
Mr. Magner stated the building was a two-story, wood frame, duplex with a detached two-stall
garage on a lot of 3,920 square feet and had been vacant since Febmary 21, 2007. A code
compliance inspection had not been done, the vacant building registration fees were delinquent in
the amount of $625, and the $5,000 perforrnance bond had not been posted. On August 17, 2007,
an inspection of the building was done and a list of deficzencies which constihzte a nuisance
condirion was developed. An order to abate a nuisance building was posted on October 15, 2007
with a compliance date of November 14, 2007. To date, the property remained in a condition which
comprised a nuisance as defined by the Legislarive Code. Ramsey County Tazcation estimated the
market value ofthe land to be approximafely $41,800 and the building to be $136,600. Real estate
taxes were currenf. Code Enforcement estimates the cost to repair the building to be approximately
$60,000 to $80,000. The cost for demolirion was estimated to be approximately $11,380 to
$15,380. There had also been five snrnmary abatements issued to this property since 2007, five of
which went to work order: to secure the buitding and the City had to board the building to secure it
from trespass, remove impraperly stored refuse, remove tall grass and weeds, and remove snow and
ice. Code Enforcement recommends the building be repaired or removed within 15 days. Mr.
Magner presented photographs of the property.
Ma Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was bnilt in
1890 and the original owner George Schickler who was also listed as the builder. This property was
across the street from the 7ackson Magnet School which had been inventoried. In reviewing the
map, it appeared that this was a contiguous block and had a unified appearance facing the school
property. The addition for this area was named after George Schickler which may be of some
significance as he may have been the developer in this area. The building did have some integrity
issues as the exterior had been covered, the porch had been modified and there was no unique
architectural characteristics. There was a real estate contact study that had been done which she had
not reviewed.
Ms. Moermond stated she believed that there was a fair amount of new construction in thzs area.
Mr. Magner stated that he believed there were possibly one ar two new strucriues that had been
built on this block. On the next block, there was a lot of redevelopment that had occurred over the
past ten years.
Ms. Moermond recommended laying this matter over to the February 12 Legislative Hearing.

Mr. Magner stated that he had received a call from the mortgage company wanting to know why the
City had removed the buiiding. He stated that he did some research and called them back to let
them laiow that if the building had been removed, the City did not do the work. Mr. Magner stated
that he went by the property that morning and the building had not been demolished. He believed
the realtor may have been by the property and saw a backhoe there to da the sewer disconnect. It
was his understanding that Semple Excavaring was hired by Mantifil Services who was hired by the
mortgage company to demolish the building. He was told that the buiiding wouid be removed on
Februaiy 20 or February 21.
Ms. Moermond recommended the building be removed within five (5) days with no oprion for
repair since the mortgage company had already hired a contractor and the demolition process had
already begun.
