This property is legally described as follows, to wit: STINSON'S ADDITION TO THE CITY OF SAINT PAUL IN THE STATE OF MINNESOTA LOT 24 BLK 14 WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Department of Safety and Inspections on or before April 2, 2007, the following are the now known interested or responsible parties for the Subject Property: Windcomber Inveshnents LLC, 404 8`" Ave N, Sartell, MN 56377; MERS, PO Box 2026, Flint, MI 48501; Wilford & Geske, 7650 Currell Blvd, Suite 300, Woodbury, MN 55125; Payne Phalen District 5 Planning Council. WHEREAS, Department of Safety and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to Abate Nuisance Building(s)" dated October 15, 2007; and WHEREAS, this order informed the then l�own interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by November 14, 2007; and WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHEREAS, this nuisance condition has not been corrected and Depariment of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties haue been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the rime, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, January 29, 2008 and February 12, 2008 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Subject Property safe and not �8 -lln -� 42 43 44 45 46 47 48 49 50 51 52 S3 54 55 56 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 87 detrimental to the public peace, health, safety and welfaze and remove its blighting influence on the community by rehabilitating this structure in accordance with a11 applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitarion or demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, February 20, 2008 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 733 $RADLEY STREET. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollazs ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been corrected. 6. That Deparhnent of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. 7. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buildings. 8. If the above corrective action is not completed witlun this period of time Department of Safery and Inspections is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Properiy pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. 3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixhxres of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 105 4. According to ow files, it has been a vacant building since July 26, 2006. The current property owner is Windcomber Investments LLC, per AMANDA and Ramsey county property records. The City of St. Paul has boarded this building to secure it from trespass. There have been seven (7) SUMMARY ABATEMENT NOTICES since 2006. There have been nine (9) WORK ORDERS issued for: - Removal of refuse Removal of tall grass and weeds Removal of snow and ice On September 20, 2007, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on October 15, 2007 with a compliance date of November 14, 2007. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building regisnation fees axe delinquent in the amount of $375.Q0. Screens must be tight-fitting and securely fastened to the frames. 3. The eaves and soffits are in a state of disrepair or deterioration. Repair all defects, holes, breaks, loose or rotting boards, to a professional state of maintenance. Permit may be required. 4. The foundation is deteriorated, defective or in a state of disrepair. Repair all foundation defects in a professional manner to a weather-tight, water-tight and rodent-proof condition. Permit may be required. The exterior walls of the house andlar gazage are defective. Repair all holes, Ureaks, loose ar rotting siding, to a professional state of maintenance. 6. There are missing or defective guardrails. Provide all stairways, porches, decks or steps which are more than 30" high with guardrails and intermediate rails with openings in the guardrail no more than four (4) inches apart and in accordance with the State Building Code. The stairs have missing or defective handrails. Provide all interior and exterior stairways and steps of more that three (3) risers with handrails which are grippable and installed 34° to 38" above the nose of the stair treads. 8. The exterior walls and/or trim of the house and/or guage has defective, peeled, flaked, scaled or chalking paint or has unpainted wood surfaces. ELECTRICAL - GENERAL. - BULLTIN 01-1 / BULLETIN 80-1 (Property Maintenance Code)-Provide for all electrical to be brought up to code per the attached Bulletin's as it pertains. All electrical work shall be done by a licensed elecriician and may require a permit. 2. ELECTRICAL - GENERAL - NEC 408.4 Circuit Directory or Circuit Identification.-Provide for all panels to have an up to date circuit directory. 3. ELECTRICAL - GENERAL - MSFC 605.4 - Discontinue use of all multi-plug adapters.-Remove all adapters in the porcelain light fixtures (exterior) and in the receptacle in Unit 4. 8. ELECTRICAL - GENERAI. - NEC 210-3 - Provide for the electrical branch circuit to be rated in accordance with the masimum perxnitted overcurrent device.-Provide for a licensed electrician to verify all breakers / fuses for approved wire size. Repair or replace as needed per current electrical code. 9. Ordering the owner to remove or repair the building(s) at 733 Bradlep Street within fifteen (15) days from adoption of resolution. The property owner of record, Windcomber Investments, did not appear. Jason and Josh Burbul appeared and stated that they owned property adjacent to this building. Mr. Magner stated the building was a two-story, four unit (four-plex} flwelling on a lot of 4,792 square feet and had been vacant since July 26, 2006. A code compliance inspecrion had not been done as of 7anuary 28, 2008, the vacant building registration fees were delinquent in the amount of �375, and the $5,000 performance bond had not been posted. On September 20, 2007, an inspection of the building was done and a list of deficiencies which canstitute a nuisance condition was developed. An order to abate a nuisance buiiding was posted on October 15, 2001 with a compliance date of November 14, 2007. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Ta�cation estimated the market value of Che land to be appmximately $48,&00 and the building to be $271,200. Real estate taxes were current. Code Enforcement estimates the cost to repair the building to be approximately $60,d00 to $70,000. The cost for demolition was estimated to be approximately $17,900 to $22,900. There had also been seven summary abatements issued to this property since 2006, nine of which went to work order: to secure the buiiding and the City had to board the building to secure it from trespass, remove improperly stored refuse, remove taIl grass and weeds and remove snow and ice. Code Enforcement recommends the building ba repaired or removed within 15 days. Mr. Magaer presented photographs o£ the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this was a 1415 mulri- fainily building that was referred to as "the flats." The original owner was an Anderson and the original permits were for an Anderson. There was some historic detailing; however, there had been significant aiterations to the building and there were integrity issues with the stairs and steps, and the decks. From the photos, it appeared that the wood siding was intact and had not been covered, there were original doors, and there was an originai cornice on the building. This buiiding had not been surveyed nor desiguated. She stated that there were only a few buildings that had been identified in the 1483 survey that were within approximately two blocks from ttus property. She stated that the HPC was cautious on making recommendations to haue buiidings surveyed that were multi-family. She also stated that they had not received any letter from SHIPO concerning this property. Ms. Moermond asked how they becama aware this was a vacant building. Mr. Magner stated the inspector for the azea found tivs building to be open to entry; broken windows; tall grass and weeds; and debris all over. Mr. Magner stated that he had been at the property on a boarding and there were issues with people going into the building to steal the copper piping and taking other items out of the buiiding. Tason Burbul stated that they were curious about the process and owned two properties on Minnehaha that were adjacent to this property. He stated that he wouid like to see this property repaired as he believed it likely could be rehabbed. He stated that he and Josh did rehabilitation work and had looked into purchasing this property; however, the bank was asking $140,000 which he believed was excessive. January 29, 2008 Legislative Hearing Minutes �� .�(� �' Page 9 Mr. Magner siated that tYris property had on-going probiems for at least the past 10 yeazs. The previous owner had also owned the property that the Burbuls currently owned and there was a history of behavioral issues that fell under the nuisance category of the Le�siative Code. The Ciry had spent a tremendous amount of money in this area and basically had to park a squad car on this corner. He stated that Code Enforcement was not opposed to seeing the building rehabilitated; however, it would need to be repaired at a higher level to guarantee long-term occupancy so it would not continue to be a negative property in the neighborhood. Ms. Moermond stated that she would recommand granting the time to rehabilitate the property on the condirion that the following be provided: 1) the vacant buiiding fees must be paid; 2) the vacant bailding registrarion form would need to be filled out; 3) the code compliance inspection would need to be done; 4) the $5,000 performance bond must be posted; 5} provide financiai documentation demonstrating the capacity to make the repairs; 6) a wark plan with timelines must be completed; 7} a signed purchase agreement; 8) a management plan for the building; and 9) the property must be maintained. Ms. Moermond recommended laying trus matter over to the February 12 Legislative Hearing. February 12, 2008 Legislative Hearing Minutes ����(Dy" Page 5 14. Ordering the owner to remove or repair the building{s} at 733 Bradiey Street within fifteen (15} days from adoption of resolution. {Continued from the 7anuary 29 Legisiative Hearing) Jason and Joshua Burbui appeared. Jason stated that they were stiil negotiafing to purchase the property and he anricipated that they couid have a sigaed purchase agreement within the next rivo or three days. Mr. Magner stated that he believed the Burbuls were in the business of doing professional rehabilitarion and were awaze that fhey would need to bring the property up to Code in order to obtain a certificate of occupancy on the property. What was requested at the previous hearing was that they would need to present the following: 1) a signed purchase agreement; 2} a work plan; 3} financial documentation; and 4) a management plan. They would also need to post the performance bond, pay the vacant building fees, and fill out the vacant building registration form. Mr. Magner stated that since the Burbuls owned two properties that were adjacent to Yhis building, he believed it was likely in the City's best interest to have neighboring property owners manage this property because they will be able to closely monitor all three buildings. Jason stated that he believed they could have a deai put together on the purchase of the property by February 20. They were stiil negotiating the sales price of the building and were approximately $I5,000 apart. The main issue would be to get the paperwork then from the bank and the bank was moving very siow. He had a sworn construction statement for the property and it was their intention to put $160,000 into rehabbing the building. Ms. Moermond asked who they were negotiating with. Jason responded that he was a licensed realtor and the property was listed on the market by George Farkas, ReMax and the mortgage company, ECWS, owned the property. Mr. Magner stated that from his perspective, the Burbuls had successfully rehabilitated two adjacent properties and they were making a commitment to put $40,000 into each of the four units. If they were anticipating to purchase the building for $10,000 a unit, or even $50,000 for the building, he believed they could make this inm a viable structure. Jason stated fhat he anticipated that they would have a signed purchase agreement, the bond posted, and the vacant building fees paid by the City Council Pubiic Hearing on February 20. He stated that they were currently scheduled to close on the building on February 22; however, they likely push the closing date out to February 29. Once they closed on the property, they would puii permits and begin the rehab to the property. He believed that they could have the rehab completed within two t� three mouths. Ms. Moermond stated that she would xecommend continuing the City Cauncil Public Hearing to Mazch 5 in order for the Burbuls to put together a wark pian and other documentation if they had � signed puTChase agreement on the property. She stated thaC if they could not reach an agreement, she will recommend to the City Councii on February 20 that the buiiding be removed. She requested that they let her know their decision by the close of business on Tuesday, February 19.
