WHERE'�,.5, The City o� St. Paul has approved the plans a.nd speci�ications for the
improvement of that part of Trunli Highway No. 392 renumbered as Trunk Highway No. 94
within the corporate limits of the City o� St. Paul from 0.25 Miles West of Ruth
Street to the East Corporate Limits; and
WHEREAS, In orctier to obtain Federal A3d in the construction of said Trunk Highwa.y
No. 392 renumbered as Trunk Bi�way No. 94 the Bureau of Public Roads requires the
assurance tha.t the City of St. Paul will not suffer ar�y eneroachment of any nature
or ktnd whatsoever on the right o� way of said Trank Highw�ay No. 392 renumbered as
Trunk Highway I�o. 9�+ within the �orporate limits o� the sa3d City of St. Pau1;
NOW, THEN, SE IT RESOLVED, 2'hat said C3ty o� St. Paul does hereby agree and
covenant that it will never permit or suffer, within its corporate limits, ar�y en-
croachment of any kind whatsoever, including curb gas p�ps and gas stations, bill-
boards or other structures of any kind whatsoever, upon the right o� way o� Trt�nk
Highway 1Vo. 392 renum'bered as Trunk Highwa,y No. 9�+, and to the above end sa3d City
of St. Paul hereby a.�ees that it will never issue any licenee, permit, or gra.nt or �
give any leave or�liberty or any other consent o� wha�ever form for the construction
or maintenance of ar.�y encroaehment whatsoever, including curb gas pwnps and gas
stations, billboards or other structurea of a.ny kind whatsoever, upon said righ�G of way;
and that said City of St. Paul will coaperate insofax as possible to eliminate existing
