RESOLVED, in the matter of the vaeation of that certain
section of public street,� viz: Clarenee Street between Wilson
Avenue and Conway Street, under the pr�.or resolution of this -
Council, Council File No. 1815�-1, approved February 19, 1957,
and the provisions of the same for the filing by the petitioner,
Tobin-Sm3.th, Inc. , of a written Instrument with the City Clerk,
binding said petitioner unto the City of Saint Paul, to submit
to the City Architect, within three years from and after the
effective date of said prior resolution, proper plans and
specifications prepared by a professional registered architect,
for the construction and erection of a Conventional Shopping
Center covering a land area of at least 60,000 square feet,
exclusive of automobile parking area, at a cost of at l�ast
$250,000.00 and incorporating, in addition to provisions for
the requiai�e buildings, facilities and appurtenances, additional
provisions for the development and establishment of an automobile
parking area for use in con�unction therewith, in and upon and to
constitute developments and improvements of substantially all of
Lot 1, Block 6, East View Addition No. 3, and Lot 1, Block 8, East
�Tiew Addition No. �, and the aforesaid vacated section of said
Clarence Street, and to construct, erect and complete said
developments and improvements according to said plans and s�cifications,
in and upon said real estate, within the period of five years next
succeedin$ the effective date of said prior resolution; that it has �
been made to appear and this Council finds that subsequent to the
.effective date of said prior resolution, said petitioner furnished
the requisite plans and specifications therefor, approved by said
City Architect, and �:n;ra�iCO�d^ail's3e therewith, completed the construction
and erect3.on of a Conventional Shopping Center covering an area of
' 35�000 square feet, exclusive of automobile parkin� area, on the
north 300 feet of said Lot 1, Block 6, East View Addition No. 3
and Lot 1, Block 8, East View Addition No. �+, (since replatted
and now being embraced by Lot 1, Bloek 9, East_View Addition No. 5)
and has made application therefor and sought the amendment of said
prior resolution and said Instrument filed by i�, as aforesaid, with
the City Clerk, to the end that the sa.me shall apportion the
requirements and obligations, respeetively, imposed on and asswned '
by said petitioner for the construction, erection and completion
of a Conventional Shopping Center, by alloeating to the housing

square feet, exclusive of automob3le parking area, and including
requisite buildings, facilities and appurtenances of the same, to
said north 300 feet of� said Lot 1, Block 9, East View Addition No. 5,
and allocating to the housing of �a conventional Shopping Center
covering a land area of 25,000 square fee�, exclusive of automobile
parking area, and includ3n� requisite buildings, facilities and
appnrtenances of the same •to sa3:d�•Lot 1, Block 9, East View Addition
No. 5, except the north 300 feet_ of the same, to be constructed and
erected by and at the expense of said petitioner, its s�.ccessors or
assigns, in accordance with plans and specifications therefor prepared
by a registered professional axchitect and approved by said City
Architect, such .to be done not later than November 1, 196�+; and that
such amendments pertainin� to sa�.d prior resolution �nd said wr3.tten �
, Instrument would be in ,futherance of the public interests in the �
premiaes and consistent with equity and �ustice; and
RESOLVED FURTHER, That the aforesaid pr3.or�resolution, Council File
No. 1815�F1, approved February 19, 1957, he�reby is axnended so that
the aforesaid apportionment and allocations pertaining to said Conventional
. Shopping Center developments and ,.i.tnprovements shall be provided for
--: thereunder and that the aforesaid.:written�,instrument filed by said �
petitioner with said 'City' Clerk-'�shall`be aceor'-dingly amended by a ric�erV
tYiereto executed and filed by said peti�tioner and said�City, in form
approved by the Corporation Counsel; and
RESOLVED FURTHER, That this resolution shall be dependent for its
operative effect upon the filing of the written acceptance of the sa.me
by said petitioner and the written assent to the same by said petitioner's
surety on its surety performance bond fur•nished •to said City, as obligee�;- .
pursuant to said prior resolution,_ with said City Clerk, within the
period of 30 days next after the effeetive, date of this resolution; and
RESOLVED FURTHER, That �the"proper' City• off�icers hereby are authorized
to execute and deliver to said petitioner, Tobin-Smith, Tnc. , a partial
release of its obligations pertaining to said Conven�ional Shopping Center -
developments and improvements in respect� of .the north 300 feet of said
� Lot l, Block 9, Ea.st View Addition�-No.� 5, , in�form approved by the
