THE'COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60
to 64, inclusive, of the Saint Paul Legislative Code,
pertaining to Use Districts, Height Districts, and Rezoning
of certain properties in the City of Saint Paul, as amended,
be and the same is hereby further amended so as to rezone
the following described-property from "All Residence District
to "C" Residence District, to -wit:
Lot 35, Block 10, Hayden Heights Addition
Section 2. This ordinance is hereby declared
to be an emergency ordinance rendered necessary for the
preservation of the public peace, health and safety,

Dear Madam:
This is in the matter of the petition of Andrew Berg to ,rezone from "A" to "C"
Residence property located on the east side of White Bear Avenue between Sherwood
and Cottage Avenues. The property is described as Lot 35, Block 10, Hayden
Heights Addition.
On August 109 1961, the Commissioner of Finance reported the petition sufficient
with the owners of 13 of a possible 17 tracks (76.5 %) of land within the pre-
scribed 100-foot radius of the property sought to be reclassified having signed
the petition. The site is presently vacant and if rezoned, the petitioner
proposes to deve1W it with a four (4) unit apartment building. This property
has a frontage of 38.14,feet along White Bear Avenue and extends to a depth of
130 feet, resulting in an area of 4,958 square feet. The property to the north,
which is zoned commercial, is developed with multi residential and commercial
uses; to the south, east and west are single family residences4
Field Investigation discloses that the - proposed use'will provide a proper trans-
ition between the commercial uses to the north and the single - family residence
to the south. It appears that the proposed development would be compatible with
the other uses.
In consideration of the above factors, the Board of Zoning recommends the granting
of said petition to reclassify the above described property from "A" Residence
district to a "CI' Residence district for the purpose of developing same with a
four (4) unit apartment building.
