BE IT RESOLVED that, upon the petition of Told Development and Meridian Management, as
documented in Public Works Technical Services, Vacation File Number 11-2007, the public
right-of-way hereinafter described, as follows and on attached map Exhibit A, is hereby
vacated and discontinued as public property:
All that part of the alley situated in Block 1, Howard Greene Second

AddiHon, Ramsey County, Minnesota lying westerly of a line beginning at
the southeast corner of Lot 5, in said Block 1(assuming the south line of said
Lot 5 bears South 89 degrees 48 minutes 13 seconds East); thence South 16
degrees 22 minutes 35 seconds West 20.82 feet to a point on the northerly
line of Lot 14 said Block 1 and there said line terminates;
and be it fiirther
RESOLVED that, subject to the herein stated exceptions and with the accompanying Certificates
of Intended Non-Use, filed voluntarily on behalf of District Energy/District Cooling St. Paul,
a private, non-profit Minnesota corporation; Saint Paul Regional Water Services, a
municipal corporation; Northern States Power Company dba Xcel Energ,y (Gas), a
Minnesota corporation; Public Works—City of Saint Paul, a municipality; made a part
hereof by this reference and filed in the office of the City Clerk of Saint Paul, the City, for itself
and on behalf of these corporations and departments, waives the right to the utility easements in
the vacated area, described above.
This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981,
of the Saint Paul Legislative Code as amended, and to the following conditions:
1. That the petitioners, their successors and assigns sha11 pay $1200.00 as an administrative
fee for this vacation which is due and payable within 60 days of the effective date of this
resolution.
2. That the petitioners, their successars and assigns shall retain the alley access for existing
property owners in Block 1, Howazd Greene Second Addifion until all current property
owners and/or rentezs have relocated.
3. That the petitioners, their successors and assigns shall be responsible for reconstructing
the west end of the vacated alley abutting Lexington Pazkway to eliminate the appearance
of public right-of-way. This shall include, but not be limited to, reconstruction and/ar

Paul Department of Public Warks under a permit issued by Public Works Sidewalk
Section.
4. That a written Agreement must be reached between the petitioner/owners/developers and
the City of Saint Paul Public Works Department requiring snow removal by a private
contractor on Juno Avenue east of Le�ngton Pazkway.
That an easement shall be retaiued on behalf of Comcast, a Pennsylvania Corporation, for
exisfing facilities. The petitioner or its successor shall provide new easements if required,
and the petitioner or its successor shall assume a11 costs of relocating facilities to the new
easements.
6. That an easement shall be retained on behalf of Northern States Power Company d/b/a
Xcel (Electric), a Minnesota corporation, for existing facilities. The petitioner or its
successor shall provide new easements if required and the petitioner or its successor shall
assume all costs of relocating facilities to the new easements.
7. That an easement shall be retained on behalf of Qwest Communications, a Delawaze
corporation, for existing facilities. The petitioner or its successor sha11 provide new
easements if required and the petitioner or its successor sha11 assume all costs of
relocating facilities to the new easements.
8. That the petifioner, their successors and assigns agree to indemnify, defend and save
harmless the City of Saint Paul, its officers and employees from all suits, actions or claims
of any character brought as a result of injuries or damages received or sustained by any
person, persons or properry on account of this vacation, or the petitioners' use of this
property, including but not limited to, a clann brought because of any act of omission,
neglect, or misconduct of said petitioners or because of any claims or liability arising from
any violation of any law or regulation made in accordance with the law, whether by the
petitioners or any of their agents or employees.
9. That the patitioners, their successors and assigns sha11, within 60 days of the effective date
of this resolution, file with Public Works, City Real Estate, an acceptance in writing of the
condifions of this resolution and shall, within the period specified in the terms and
conditions of this resolution, comply in all respects with these terms and conditions.

The alley curtently provides access to 3 or 4 garages for single Yamily houses. DSI dces not have an issue with vacating tlie alley if
the houses and ga2ges go away.
I know the developer is proposing to demo the houses. But I don't think we want to vacate the alley until the houses/garages go
away.
So DSI does not object to the vacation if a condition can be included that the garages (and houses?) that currenUy rely on alley
must be removed. I am not sure exactly how you word that condiGon.
Let me know if any of this does not make sense.
