WHEREAS, on September 2, 1961, a program designated -
. "Drum Beauty" was presented at the Saint Paul Municipal Stadium "
by the Stillwater Jaycees; and ,
,
WHEREAS, said program was conducted on the basis of "
an understanding between the Stillwater Jaycees and the Depart-
ment of Libraries, Auditori�un, Museums and �tadia that the City
of Saint Paul would be paid as and for rental• ;of the Municipal
Stadi�nn, five per cent of the gross receipts collected in con-
, nection with said p�ogram; and ,
WHEREAS, apon conclusion of the aforesaid program
a Registered Bill of the City of Saint Faul, No. 8-170, in
the amount of $274.85 was submitted to the said Stillwater
� Jaycees and their check No. 111 was paid to the City of Saint
�aul and credited by the Commissioner of Finance to Stadium
Fund No. 1024; and , .
WHEREAS, subsequently the check was returned by the.�._ -
bank as payment thereon had .been stopped; and - - - -

• WHEREAS, the explanation f or �he af oresaid stopped
payment on the said check arose by virtue of circtunstances
whereby because of inclement weather and inability to proceed
with the af oresaid program, because of the wet f ield at the
Stadium, the judges of the program cancelled the same; and
WHEREAS, the Stillwater Jaycees. having agreed to
refund admissions to those persons in attendance at the
program, anticipated that there might be a shortage of f unds �
in their account if the City of Saint Paul presented the check
f or paymeAt, and in coasequence thereof directed the bank to
stop payment if said check w ere presented; and .
WHEREA�, it is proposed by the Stillwater`��Jaycees ` t
that the City of Saint Paul accept the sum of $200.00 in settle- ��-
ment of its claim f or Stadium rental and charges against �
such organization, now, therefore, be it

RFSOLVED, That pursuant to the provisions of Ordinance
IJo. 11022, which ordinarace f ixes the schedule of charges f or
use of the Saint Paul Municipal Stadium, and upon the recom-
men�ation of the Commissioner of Libraries, Audi�erium, Museums
and 'Stadia, tha� the Council of the City of Saint Paul hereby
authorizes, approves., ratif ies and accepts the sum of $200.00
in full payment and satisfaction, from the Stillwater Jaycees,
f or its rental on September 2, 1961 of the Saint Faul Municipal �
Stadium in connection with its program entitled "Drum Beauty.'" ;
be it
FURTHER RESOLVED, That upon receipt of payment of
$200.00 from the Stillwater Jaycees, the same shall be accepted
by .the proper City office�s as payment in full of Registered �
Bill No. 8-170, and the balance of said bill is hereby cancelled;
be it ��
FURTHER 13ESOLVED;"-Tha t an amount of $274.85 be refunded
to the Commissioner of Finance out of Stadium Fund No. 1024,
since the Commissioner of Finance was charged by the bank that
amount in connection with the check npon which paymerit was
stopped as hereinbefore recited. . .
