08-14Couucil File # /J� /� Green Sheet # 3047771 RESOLUTION MINNESOTA /9 CAPITAL IMPROVEMENT PLAN BONDS ("2008 PUBLIC SAF`ET'Y BONDS") IN AN AMOUNT NOT TO EXCEED $I1,000,000 ("WESTERN POLICE STATION PROJECT") ;(2) ADOPTING A SPECIAL PURPOSE CAPITAL IMPROVEMENT PLAN; AND (3) INTENT TO REIMBURSE FOR FIRE #1 AND #10 AND ADMINISTRATION PROJECT 7 WHEREAS, the City of Saint Paul, Minnesota (the "City"), annually adopts a Capital Ixnprovement 8 Budget and Program in accordance with a local law, being Laws of Minnesota for 1974, Chapter 351, as 9 amended (the "Local Law"); and 10 WHEREAS, the Local Law permits the issuance of general obligation bonds without an election, 11 but said bonds are required to mature within ten years; and 12 WHEREAS, the City for certain capital improvements would prefer to finance them with bonds 13 whose maturities exceed ten years and better match the useful life of the capital improvements; and 14 WHEREAS, since 2003 a general law, Minnesota Statutes, Section 475.521 (the "General Law"), 15 permits the issuance of general obligation bonds without an election in accordance with a capital 16 improvement plan adopted under such law, and such bonds are required to mature within thirty years; and 17 WHEREAS, the City's Capital Improvement Budget and Program comprehensively addresses 18 capital improvements and factors relating thereto over a five year period, but does not necessarily address 19 for each improvement all of the eight factars required by the General Law to be considered; and 20 WHEREAS, as an aspect of its Capital Improvement Budget and Program the City will address in a 21 portion thereof entitled "Minnesota Statutes 475.521 Special Purpose Plan" (the "Special Purpose Plan") 22 all the factors required by the General Law to be considered for capital improvements which are financed 23 by bonds issued pursuant to the General Law; and 24 WHEREAS, the Council of the City proposes to issue its general obligation capital improvement 25 plan bonds (the "Bonds") and adopt its Special Purpose Plan as a capital improvement plan under the 26 General Law (the "Plan"); and 27 WHEREAS, the City has caused notice of the public hearing on the intention to issue the Bonds 28 and on the proposed adoption of the Special Purpose Plan to be published pursuant to and in accordance 29 with the General Law; and 30 WHEREAS, a public hearing on the intention to issue the Bonds and on the proposed Special 31 Purpose Plan has been held on this date, following published notice of the hearing as required by law; and RESOLUTION AUTHORIZING (1) PRELIMINARY APPROVAL FOR THE ISSUANCE OF GENERAI, OBLIGATION 32 WHEREAS, in approving the Special Purpose Plan, the City Council considered for each project, 33 including the Western District Police Station and Fire #1 and #10 and Administration projects, and for the 34 overall Special Purpose Plan the following eight factors: 35 36 37 38 39 40 41 42 43 44 45 46 47 48 1. The condition of the City's existing infrastructure, including the proj ected need for repair and replacement; 2. The likely demand for the improvement; 3. The estimated cost of the improvement; 4. The available public resources; 5. The level of overlapping debt in the City; 6. The relative benefits and costs of alternative uses of the funds; 7. Operating costs of the proposed improvements; and 8. Alternatives for providing services more efficiently through shared facilities with other local government units: WHEREAS, the City is proceeding with acquisition and predevelopment costs for Fire #1 and #10 and Administration Project, which is located at W. The City is considering public hearing on January 2, 2008 on any comments from the public on the plan (See Exhibit A). In preparing this capital improvement plan, the following criteria below have been considered; the proj ects haue followed the C1B annual review process and have been named as Capital Improvement Projects and further details on the two the pro}ects and process is described in Exhibit B and C. The capital improvement plan and annual amendments are approved by the City Council after a public hearing.
