WHEREAS, Eugene Ferguson, employee of the Department of
Public Works, was injured during the course of -his employment
in a third -party accident, on April 10, 1961, when a runaway
truck owned by Wilson Truck System collided with the truck he
was driving,, and on account of said injury the City expended
the amount of $42.00 for replacement of his eyeglasses and $83.00
in medical expense on behalf of said employee; and
WHEREAS,' the office of the Corporation Counsel is in
receipt of a draft of Continental - National Group insurance,
payable to the City of St. Paul in the amount of $125.00 in
offer of settlement of the City's claim for medical expense
incurred on behalf of said employee and 'a draft in the amount of
$186.60 in payment of Registered Bill No. 1 -8834 issued for
damage to the City's truck involved in said accident, now,
therefore, be it
RESOLVED, That the proper City officers are herbby
authorized to accept, in full, final and complete settlement
of its subrogation claim for medical expense incurred on behalf
of said employee Eugene Ferguson, said settlement offered on
behalf of the Wilson Truck System, third party involved in said
accident of April 10, 1961, in the sum of $125.00, and to accept
said draft in the amount of $186.60 in payment of said Registered
Bill No. 1- 8834,- and to sign any necessary releases required by
the insurer of the third party involved in said accident; be it
FURTHER RESOLVED, That
to the Workmen's Compensation
$186.60 be accepted in payment
