WHEREAS, Twin Cities Habitat for Humanity, in File No. 08-128-559, has submitted for City Council approval
the attached preliminary and final plat for subdivision of property, between Herbert and Germain Court, as
Herbert Landing Townhomes, to create 1 residential lot and 1 outlot; and
7 WHEREAS, the appropriate City departments have reviewed the piat and found, subject to the recommended
8 conditions, that it meets the requirements of Chapter 69 of the Zoning Code; and

WHEREAS, notice of a public hearing before the City Council was duly published in the officiai newspaper ot
the City and notices were mailed to each owner of affected property including all property situated within 350
feet of the subject property; and
WHEREAS, the City Council held a public hearing on the proposed plat on November 5, 2008, where aIl
interested parties were given the opportunity to be heard, and the Council considered all the facts and
recommendations concerning the plat;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached preliminary
and final plat for Herbert Landing Townhomes, between Herbert and Germain Court, subject to the following
conditions:
1. A parkland cash dedication in the amount of $5,107.33 is paid prior to the city clerk signing the
final plat.
2. The applicant shall file a copy of the Council Resolution approving the Final Plat with the
Ramsey County Recorder's Office.

• E. ZONING CODE CITATION: §69.301 states that piatting is required when a subdivision (1) creates
five or more lots or parceis each of which is 2%z acres or less in size, or (2) requires paved streets,
alleys and other pubiic improvements, or (3) is previously unplatted land. §69.304 lists conditions for
lot splits and adjustments of common boundaries. §69.406 provides criteria for review of subdivision
applications. These criteria are covered below under "Required Findings." §69.511 regulates
parkiand dedicatian.
F. HISTOFtY/DISCUSSION: The City Council approved rezoning this property from li lndustrial to R4
One-Family Residential on May 28, 2008 (C.F. 08-462). The Planning Commission approved an
application for a six-unit cluster development for a portion of this property on March 21, 2008 in Z.F.
# 08-032-354. A site plan for the ciuster project was approved by City of Saint Paul staff on
September 22, 2008 (File # 08-116-538).
G. DISTRICT COUNCIL RECOMMENDATION: District 2 has not commented specifically on this plat,
but is on record supporting the housing project.
H. REQUIRED FINDINGS: § 69.406 of the Zoning Code requires that all of the following findings shall
be made prior to approval of a subdivision:
1. All the applicable provisions of the Legislative Code are complied with. City staff have
reviewed the proposed plat and have determined that all applicable provisions of city codes are
met. Staff notes that Outlot A cannot be developed without improving platted Herbert Street.
2. The proposed subdivision wifl not be detrimental to the present and potentiat su�rounding land
uses. The proposed plat is consistent with the surrounding land uses, and will not be
detrimental to present and future use of surrounding land.
3. The area surrounding the subdivision can be planned and developed in coordination and
compatibility with the proposed subdivision. The area surrounding the proposed plat is afready
• fargely developed and compatible with the proposed piat.
4. The subdivision is in conformance with the comp�ehensive plan. The subdivision is in
conformance with the Land Use Chapter of the Comprehensive Plan, which supports a range
of housing types in the city (Objective 5.3). tt is also consistent with the Housing Chapter,
which recommends working with partners to enable the construction of affordable housing

(Policy 6.2), as well as with the District 2 Plan. It is also in conformance with redevelopment
plans for the area.
5. The subdivision preserves and incorporates the site's important exisfing natural features
whenever possible. The sife has been used as a dump site and has no remaining natural
features. The developer has worked with the Minnesota Pollution Control Agency to clean up
the site.
6. A!/ land intended for building sites can be used safe(y without endangering residents by peril
from floods, erosion, continuously high water table, severe soil conditions or other menace. All
building site problems have bee� addressed in the site plan review process.
7. The subdivision can be economically served with public facilities and services. The subdivisiorr
can be economically served with public facilities and services from surrounding streets.
PARKLAND DEDICATION: §69.511 requires dedication of two (2) percent of the total land area
of the plat for public use, for parks, playgrounds, trails, open space, or conservation purposes. At
the discretion of the City Council, a cash dedication in lieu of land may be paid prior to the city
clerk's signing of the final plat.
For this subdivision, staff recommends a cash dedication in the amount of $5,107.33 in )ieu of
dedication of land.
STAFF RECOMMENDATION: Based on required findings 1 through 7, staff recommends approval
of the preliminary and final piat for Herbert Landing Townhomes subject to the following conditions:
1. A parkland cash dedication in the amount of $5,107.33_is paid prior to the city clerk signing the
final plat.
2. The applicant shall file a copy of the Counci! Resolution approving the plat with the Ramsey •
County Recorder's Office.

2. Our records indicate that the East'/o corner of Section 27 is marked by a granite monument
with a brass cap. Please verify,that the monument type shown af this location is correct.

Department of Safety and inspections (DSI) �contact is Mary Montgomery, 651-266-9088):
A site plan for the townhome development has been approved with conditions by DSI staff (File

On August 6, 2008, you submitted an appiication for a Combined Piat for Herbert Landing
Townhomes to create 1 residential lot and 1 outiot at 1611 Case Ave, befween Herbert and
� Germain Court. City staff have reviewed the preliminary plat and have identified fhe followi�g
issues:
Department of Pubfic Works (contact is Colieen Paavola, 651-266-61Q4):
1. Monument symbois shouid be shown at each end of the North line of Lot 1.
2. Our records indicate that the East'/< corner of Section 27 is marked by a granite monument
with a brass cap. Please verify that the monument type shown at fhis location is correct.
PED zoning (contact is Paui Dubruiel, 651-26fi-6583j: No issues.
Department of Safety and inspections (DS{} (contact is Mary Montgomery, 651-266-9088):
A site plan for the townhome development has been approved with conditions by DSI staff (File
# 08-116538).
Fire Prevention Division (contact is Angie Leitner, 651-266-6287): No issues. Note that
Outlot A cannot be developed without improving Herbert Street or providing an access
easement.
Saint Paul Regional Water Services (contact is Dave Marruffo, 651-266-6813); No issues.
Division of Parks and Recreation (contact is Jody Martinez, 651-266-6424):
§69.511 requires the dedication of land for parks or cash in lieu of land at the time of piatting.
Parks and Recreation will recommend that the City Counci( require dedication of cash in lieu of
lend in the amount of $5,107.33.
� Based on these comments, stafF approves the preliminary plat subject to changes being made
to the suroey to address the concerns of fhe Department of Public Works.
