Department of Safety and Inspections has requested the City Counci] to hold public hearings to consider the advisability and necessity of ordering the repair or wreeking and removal of a two story, wood frame dupiex located on property hereinafter referred to as the "Subjcct Property" and commonly known as 736 EDMUND AVENUE. WHEREAS, Department of SafeCy and Inspections has served in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code an order identifled as an "Order Yo Abate Nuisance Building(s)" dated July 31, 2008; and WHEREAS, this orc�er informed the then known interested or responsible parties that the structure located on the Subjeet Property is a nuisance building(s) pursuant to Chapter 45; and WI IBRF_AS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by September 1, 2008; and WIIf�REAS, the enft�rcement officer has posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WHliREAS, this nuisance condition has not been corrected and Department of Safety and Inspections requested that the City Clerk schedule public hearings before the Legislative Hcaring Officer of the City Counci] and the Saint Paul City Council; and W'I�FREAS, the interested and responsible parties have been served notice in accardance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WH6REAS, a hearing was held before the I,egislative Hearing Officer of the Saint Paul City Council on Thursday, November 13, 2008 to hear tesrimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the �-ra�v 43 44 45 46 47 48 49 50 51 52 53 interested or responsible parties to make the Subject Property safe and not detrimentai to the public peace, health, safety and welfare and remove its blig�ting influence on the community by rehabilitating this structure in accordance with all applicable codes and ordinances, or in the altemative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the date of the Council Hearing; and WIIEREAS, a hearing was held before the Saint Paul City Council on Wednesday, December 3, 2008 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore 54 BE IT RESOLVED, that based upon the testimony and evidence presented at the above 55 referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and 56 Order conceming the Subject Property at 736 EDMUND AVENUE. 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 85 86 87 2. That the Subject Property comprises a nuisance condition as defined in Saint Paul Lea slative Code, Chapter 45. That the costs of demolition and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to conect the deficiencies or to demolish and remove the building(s). That the deficiencies causing this nuisance condition have not been corrected. That Deparhnent of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, VacantlNuisance Buildings. 8. The rehabilitation or demolition and removal of the structure must be completed within F'�� one hundred-ei2htv (1801 days after the date of the Council Hearing. 2. Tf the above corrective action is not completed within this period of time Deparhnent of Safety and Inspections is hereby authorized to take whatever steps aze necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code. In the event the building is to be demolished and removed by the City of Saint Paul, all personal property or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. Tf all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such property as provided by law. 107 4. According to our files, it has been a vacant building since January 3, 2008. The current property owner is US Bank NA, per AMANDA and Ramsey county property records. The city has had to board this building to secure it from trespass. There have been three (3) SUMMARY ABATEMENT NOTICES since 2008. There have been four (4) WORK ORDERS issued for: - Boarding - Removal of improperly stored refuse and miscellaneous debris - Removal of tall grass and weeds On July 8, 2Q�8, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on July 31, 2008 with a compliance date of September 1, 2008. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. (Paid by assessment 8-21-08) Taxation has placed an estimated market value of $42,100 on the land and $159,700 on the building. Provide one (1) light for each 200 square feet in unfinished basemem. One light must be switched from the top of the stairs. 6. Install hard-wired, battery backup smoke detectors as specified in Bulletin 80-1 and other smoke detectors as required by the IRC. 10. Install exterior lights at front entry doors. 11. Remove and/or rewire a11 illegal, unproper or hazardous wiring in basement. 12. All electrical work must be done by a licensed electrical contractor under an electrical permit. Any open walls or walls that are opened as part of this project must be wired to the standards of the 2008 NEC. 13. Repair broken conduit and remove illegal romex wiring in rear stairway. 14. Check furnace heat exchangers for leaks; provide documentation from a licensed contractor that the heating units are safe. 2. Install chimney liner. 3. Install furnaces flue venting to code. 4. V ent clothes dryer to code. 5. Ciean all supply and return ducts for warm air heating system. 6. Repair and/or replace heating registers as necessary. 7. Provide heat in every habitable room and bathrooms. 8. Undercut doors one inch to rooms without ducted return air. 9. A gas mechanical permit is required for the above wark. Ordering the owner to remove or repair the building(s) at 736 Edmund Avenue within fifteen (15) days from adoption of resolution. The properry owner of record, US Bank NA, did not appeaz. Mark Kneer appeared on behalf of Danmark Properties and stated that they had purchased the property on September 26, 2008. Mr. Magner stated the building was a two-story, wood frame, duplex on a lot of 4,356 square feet and had been vacant since 4,356. A code compliance inspection had been done on November 1Q 2008, the vacant building registration fees in the amount of $1,�00 were paid by assessment on August 21, 2008, and the $5,000 performance bond had not been posted. On July 8, 2008, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on July 31, 2008 with a compliance date of September 1, 2008. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $42,100 and the building to be $159,700. Rea1 estate taxes were current. Code Enforcement estimates the cost to repair the building to be approximately $65,000 to $75,000. The cost for demolition was estimated to be approximately $15,972 to $20,972. There had also been tbree summary abatements issued to this property since 2008, four of which went to work order: to secure the building and the City had to board the building to secure it from trespass, remove improperly stored refuse and miscellaneous debris, boarding, and cut tall grass and weeds. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1890 and was originally a store and flats building. She noted that an early owner was listed as "Hanun" which name had historical siglificance; however, this property had not been surveyed and was located outside the potential Frogtown historic district. She noted that there had been a loss of integrity and encouraged that the brick vaneer be painted a"masons}�' color when the building was rehabbed. She asked whether the owner planned to keep the property as a residence. Mr. Kneer responded that they planned to keep the building as a rental duplex property. Ms. Moermond stated that the following must be received by Friday, November 21:1) vacant building registration form must be received; 2) provide a copy of the purchase agreement or closing documents; 3) post the $5,000 performance bond; 4) provide a wark plan; 5) financial documentation; and 6) the property must be maintained.
