WHEREAS. Department of Safety and Inspections has requested the City Counci] to
hold public hearings to consider the advisability and necessity of ordering the repair or wreeking
and removal of a two story, wood frame dupiex located on property hereinafter referred to as the
"Subjcct Property" and commonly known as 736 EDMUND AVENUE. This property is legally
described as follows, to wit:

WI iERFAS, based upon the records in the Ramsey County Recorder's Office and
iniormation obtained by Department of Safety and Inspections on or before May 12, 2008, the
following are the now known interested or responsible parCies for the Subject Property: US Bank

WHEREAS, Department of SafeCy and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identifled as an "Order Yo
Abate Nuisance Building(s)" dated July 31, 2008; and
WHEREAS, this orc�er informed the then known interested or responsible parties that the
structure located on the Subjeet Property is a nuisance building(s) pursuant to Chapter 45; and
WI IBRF_AS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by September 1, 2008; and
WIIf�REAS, the enft�rcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHliREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hcaring Officer of the City Counci] and the Saint Paul City Council; and
W'I�FREAS, the interested and responsible parties have been served notice in accardance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WH6REAS, a hearing was held before the I,egislative Hearing Officer of the Saint Paul
City Council on Thursday, November 13, 2008 to hear tesrimony and evidence, and after
receiving testimony and evidence, made the recommendation to approve the request to order the

interested or responsible parties to make the Subject Property safe and not detrimentai to the
public peace, health, safety and welfare and remove its blig�ting influence on the community by
rehabilitating this structure in accordance with all applicable codes and ordinances, or in the
altemative by demolishing and removing the structure in accordance with all applicable codes
and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen
(15) days after the date of the Council Hearing; and
WIIEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
December 3, 2008 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
54 BE IT RESOLVED, that based upon the testimony and evidence presented at the above
55 referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
56 Order conceming the Subject Property at 736 EDMUND AVENUE.

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Lea slative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to conect the deficiencies or to demolish and remove the
building(s).
That the deficiencies causing this nuisance condition have not been corrected.
That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, VacantlNuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The above referenced interested or responsible parties shall make the Subj ect Property

blighting influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ardinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the structure must be completed within
F'�� one hundred-ei2htv (1801 days after the date of the Council Hearing.
2. Tf the above corrective action is not completed within this period of time Deparhnent of
Safety and Inspections is hereby authorized to take whatever steps aze necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. Tf all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
107 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested

The building is a two-story, wood frame, duplex dwelling on a lot of 4,356 square feet.
According to our files, it has been a vacant building since January 3, 2008.
The current property owner is US Bank NA, per AMANDA and Ramsey county property
records.
The city has had to board this building to secure it from trespass.
There have been three (3) SUMMARY ABATEMENT NOTICES since 2008.
There have been four (4) WORK ORDERS issued for:
- Boarding
- Removal of improperly stored refuse and miscellaneous debris
- Removal of tall grass and weeds
On July 8, 2Q�8, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on July 31, 2008 with a compliance date of
September 1, 2008. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid. (Paid by assessment 8-21-08)
Taxation has placed an estimated market value of $42,100 on the land and $159,700 on the
building.
As of November 10, 2008, a Code Compliance inspection has been completed.
As of November 10, 2008, the $5,000.00 performance bond has not been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $65,000 to $75,000. The
estimated cost to Demolish is $15,972 to $20,972.
DSI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution authorizes
the Division of Code Enforcement to demolish and assess the costs to the property.

Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a Fve thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any pertnits are
issued, except for a demolition permit.

This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a two story, wood frame duplex.
1. There is damaged or missing screen and/or storm windows.
2. There is chipped/peeling paint.
3. There is spalling concrete siding.
4. The windows aze boarded/damaged.
5. There aze deteriorated interior window sashes.
6. There is deteriorated window and door trim.
7. The exterior light fixture is broken or missing pieces.
8. There is damaged and hazardous plinth block for exterior post for the 2" floor
porch.
General
The Certificate of Occupancy is revoked.
ORDER:
Repair the structure to a habitable condition.
This structure is a registered vacant building that must have a Code Compliance
Certificate before the shucture may be occupied. Obtain a Code Compliance
Certificate from the Deparnnent of 5afety and Inspections. You may contact Jim
Seeger at D.S.I., 651-266-9016, for a code compliance inspection, permits, and
issuance of Code Compliance Certificate. Under Chapter 33.03 of the Saint Paul
Legislafive Code, failure to obtain a Code Compliance Certificate before
occupying the structure may result in issuance of criminal summonses.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by September 1, 2008 the Department of Safety
and Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this ac6on, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial acfion, a Code Compliance Inspection Report must be obtained from the

(651)266-9090. This inspection will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placazd shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The deparhnent is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Couneil that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

BUILDING
1. Provide additional support for rear stairway to second floor in approved manner.
2. Provide additional support for basement stairway.
3. Plumb all support posts and securely fasten at top and anchor at bottom.
4. Support all beam ends in an approved manner.
5. The eastside second floor parch floor is unsafe. Reconsiruct in an approved manner. Install
support post securely fastened at top and anchored to frost footing at bottom
6. Provide additional support for roof of rear stair enclosure in an approved manner.
7. Replace rear retaining walls.
8. Repair or replace damaged doors, sills and storm doors. Weather seal and air seal all exterior
doors and windows.
9. Insure basement cellaz floor is even, is cleanable, and all holes are filled.
10. Install handrails and guardrails at all stairways, including basement stairways, per
attachment.
11. Install plinth blocks under posts in basement,

13. Maintain one-hour fire-separation between dwelling units and between units and common

14. Relocate 2 floor electrical panel to 2 floor unit or to common azea or protect panel with 1-
hour fire- rated enclosure.
15. Insta1120-minute fire-rated doors, with self-closing device, between common azeas and
individual units.
16. Install tempered or safety glass in window over stair landing to Code.
17. Provide thumb type dead bolts far all entry doors. Remove any surface bolts.
18. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty etc. as
necessuy.

19. Provide complete storms and screens, in good repair, fox all door and window openings,
20. Repair walls, ceilings and floors throughout, as necessary.
21. Provide fire block construction as necessary.
22. Re-level structure as much as is practical.
23. Where wall and ceiling covering is removed install full-thickness or code-specified
insulation.
24. Prepaze and paint interior and exterior as necessary. Observe necessary abatement procedure

27. Provide smoke detectors per the Minnesota Building Code and carbon monoxide detectors
per State law.
28. Provide weather-sealed, air-sealed, and vermin-sealed exterior.
29. Provide proper drainage around house to direct water away from foundation.
ELECTRICAL
1. Provide a complete circuit directory at service panels.
2. Verify/install a separate 20 ampere laundry circuit and a separate 20 ampere kitchen
appliance circuit.
3. Verify that circuit breaker amperage matches wire siae.
4. Properly strap cables and conduits in basemenUservice conduit on the exterior of the house.
5. Provide one (1) light for each 200 square feet in unfinished basemem. One light must be
switched from the top of the stairs.
6. Repair or replace all broken, missing ar loose light fixtures, switches and outlets, covers and
plates.
7. Check a113-wire outlets for proper polarity and verify ground.
8. Remove any 3-wire ungrounded outlets and replace with 2-wire or ground 3-wire to code.
9. Install hard-wired, battery backup smoke detectors as specified in Bulletin 80-1 and other

All pluxnbing work requires permit(s) and must be done by a plumbing contractor licensed in
Saint Paul.
1. The water heater gas venting and water piping is incorrect.
2. The water heater is not fired on in service.
3. The water meter is removed and not in service.
4. Provide 1" from water meter to first major take-off.
5. Repair or replace all corroded, broken or leaking water piping.
6. Provide water piping to all fixtures and appliances.

3. Install furnaces flue venting to code.
4. V ent clothes dryer to code.
5. Ciean all supply and return ducts for warm air heating system.
6. Repair and/or replace heating registers as necessary.
7. Provide heat in every habitable room and bathrooms.
8. Undercut doors one inch to rooms without ducted return air.
9. A gas mechanical permit is required for the above wark.

This property is designated by the Vacant Buildings Department as a Category #3 which requires
a$5,000 Performance Bond or Deposit at the time the permit is issued.
Provide plans and specifications for any portion of the building that is to be rebuilt.
Most of the roof covering could not be inspected from grade. Recommend this be done before
rehabilitation is attempted.
This is a registered vacant building. In order to reoccupy the building, all de�ciencies
listed on the code compliance report must be corrected in accordance with the Minimum

7. Ordering the owner to remove or repair the building(s) at 736 Edmund Avenue within
fifteen (15) days from adoption of resolution.
The properry owner of record, US Bank NA, did not appeaz. Mark Kneer appeared on behalf of
Danmark Properties and stated that they had purchased the property on September 26, 2008.
Mr. Magner stated the building was a two-story, wood frame, duplex on a lot of 4,356 square feet
and had been vacant since 4,356. A code compliance inspection had been done on November 1Q
2008, the vacant building registration fees in the amount of $1,�00 were paid by assessment on
August 21, 2008, and the $5,000 performance bond had not been posted. On July 8, 2008, an
inspection of the building was done and a list of deficiencies which constitute a nuisance condition
was developed. An order to abate a nuisance building was posted on July 31, 2008 with a
compliance date of September 1, 2008. To date, the property remained in a condition which
comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the
market value of the land to be approximately $42,100 and the building to be $159,700. Rea1 estate
taxes were current. Code Enforcement estimates the cost to repair the building to be approximately
$65,000 to $75,000. The cost for demolition was estimated to be approximately $15,972 to
$20,972. There had also been tbree summary abatements issued to this property since 2008, four of
which went to work order: to secure the building and the City had to board the building to secure it
from trespass, remove improperly stored refuse and miscellaneous debris, boarding, and cut tall
grass and weeds. Code Enforcement recommends the building be repaired or removed within 15
days. Mr. Magner presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1890 and was originally a store and flats building. She noted that an early owner was listed as
"Hanun" which name had historical siglificance; however, this property had not been surveyed and
was located outside the potential Frogtown historic district. She noted that there had been a loss of
integrity and encouraged that the brick vaneer be painted a"masons}�' color when the building was
rehabbed. She asked whether the owner planned to keep the property as a residence.
Mr. Kneer responded that they planned to keep the building as a rental duplex property.
Ms. Moermond stated that the following must be received by Friday, November 21:1) vacant
building registration form must be received; 2) provide a copy of the purchase agreement or closing
documents; 3) post the $5,000 performance bond; 4) provide a wark plan; 5) financial
documentation; and 6) the property must be maintained.
