WI3EREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public heazings; and
WI�EIZ}3AS, a I�earing was heid before the Legislative Hearing Officer of the Saint Paul
Cit} Council on Thursday, Navember 13, 2008 to hear testimony and evidence, and after
receiving testimony and evidenee, made the reconimendation to approve the request to arder the

interested or responsible parties to make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
rehabilitating this structure in accordance with all applicable codes and ordinances, or in the
alternative by demolishing and removing the structure in accordance with all applicable codes
and ordinances. The rehabilitation or demolirion of the shucture to be completed within fifteen
(15) days after the date of the Council Aearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
December 3, 20Q8 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 232 EDMUND AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00}.
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Al�ate Nuisance Building(s) was sent to the fhen known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, VacantlNuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 haue been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

and removing the structure in accordance with all applicable codes and ordinances. The

fifteen (15) days after the date of the Council Hearing.
If the above corrective action is not completed within this period of time Departrnent of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fi11 the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the Ciry of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of tlus time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul sha11 remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accardance with Chapter a5 of the Saint Paul Legislative Code.

The building is a two-story, wood frame, single-family dweliing with a detached garage, on a lot
of 3,485 square feet.
According to our files, it has been a vacant building since October 22, 2007.
The current property owner is Miguel Angel Almaraz Torres, per AMANDA and Ramsey county
property records.
The city has had to board this building to secure it from trespass.
There have been sixteen (16) SUMMARY ABATEMENT NOTICES since 20d7.
There have been sixteen (16) WORK ORDERS issued for:
- Removal of snow and ice
- Removal of improperly stored refuse and miscellaneous debris
- Removal of tall grass and weeds
On July 16, 2008, an inspection of the building was aonducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An QRDER TO
ABATE A NUISANCE BUILDING was posted on August 1, 2008 with a compliance date of
September 1, 2008. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are delinquent in the amount of $1,000.
Taxation has placed an estimated market value of $25,700 on the land and $92,300 on the
building.
As of November 10, 2008, a Code Compliance inspect3on has not been completed.
As of November 10, 2008, the $5,000.00 performance bond has not been posted.
Real Estate taxes for the yeax 2008 are delinquent in the amount of $1,826A1 plus penalty and
interest.
Code Enforcement Officers estimate ihe cost to repair this structure is $50,000 to $60,000. The
estimated cost to Demolish is $10,600 to $14,600.
DSI, Division of Code Enforcement Resolution submitted for consideration orders the property

The VacantlNuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby deciares the premises located at:

and legally described as foliows, to wit:

to comprise a nuisance condition in violation of the Saint Paul Legisiative Code, Chapter
45.02, and subject to demolirion under authority of Chapter 45.11.
On July 162008, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of de6ciencies is not necessarilp all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Bailding InsQection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condirion. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.
This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.

This is a two story, wood frame, single family dwelling and its detached single caz
garage.
1. The eaves and soffits are in a state of disrepair or deteriorarion. Repair all
defects, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Pernut may be required.
2. The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openabie windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
The windows andlor storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardware and associated trim in a professional manner. Permit may be
required.
4. The exteriar wa11s of the house and/or garage are defective. Repair a11 holes,
breaks, loose or rotring siding, to a professional state of maintenance,
5. The exteriar walls and(or trim of the house and/or garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condirion in a professional manner.
6. STORM DOOR(S): The storm door(s) are in disrepair/missing; repair or
replace the door(s).
7. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace
the roof covering to a sound, tight and water impervious condition. Permit
may be required.
8. The foundation is deteriorated, defective or in a state of disrepair. Repair all
foundation defects in a professional manner to a weather-fight, water-right and
rodent-proof condition. Permit may be required.

generated on September 26, 20Q7 that need to be remedied. Details of the report

Insure basement cellar floor is level, is cleanable, and all holes are filled.
Install hand and guardrails on all stairways and steps as per attachment.
Install plinth blocks under posts in basement.
Tuck Point interior/exterior foundation.
Install floor covering in the bathroom and kitchen that is impervious to water.
Provide thumb type dead bolts for all entry doors. Remove any surface bolts.
Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty
etc. as necessary.
Provide complete storms and screens, and repair all door and window openings.
Repair walls and ceilings throughout, as necessary.
Provide hand and guardrails on all stairways and steps as per attachment.
Prepare and paint interior and exterior as necessary (take the necessary precaurions if
lead base paint is present).
Any framing members that do not meet code (where wall and ceiling covering is
removed, members that are over-spanned, over-spaced, not being carried properly,
door and window openings that are not headered, etc.) are to be reconstructed as per
code.
Habitable rooms with new usage, replaced windows shall have glass area equal to
8% of floor area, or a minimum of 8 sq. ft., one-half of which shall operate and all
bedroom windows shall meet emergency egress requirements (20" wide minimum,
24" high minimum but not less than 5.7 sq. ft. overall).
Provide general clean-up ofpremise.
Provide smoke detectors as per the Minnesota State Building Code.
Repair soffit, fascia h etc. as necessary.
Provide proper drainage around house to direct water away from foundation.
Install downspouts and a complete gutter system.
Provide general rehabilitation of garage.
Replace front porch steps and skirting to code.
Repair porch foundation and framing as needed.
Install returns on handrails.
Install handrail on basement stairs to code.
Supply protection for basement windows and install curb to keep water out.
Repair basement windows or replace.
Totally rebuild rear deck to code or remove.
Install new service door on garage.
Properly flash bottom row of siding on gazage slab and remove dirt from against
garage walls.

demolish and remove the building(s). The costs of this acrion, including administrative costs

As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #�200, Commerce Building,
(651)266-9090. This inspection will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declazes it
to be a"nuisance condition", subject to demolirion and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is fiu•ther required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement acrion the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if correcrive action
is not taken within the specified rime, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

6. Ordering the owner to remove or repair the building(s) at 232 Edmund Avenue within
fifteen (15) days from adoption of resolution.
The property owner of record, Miguel Angel Almaraz Torres, did not appear. No other parties of
interest appeared.
Mr. Magner stated the building was a two-story, wood frame, single-family dwelling with a
detached gazage on a lot of 3,485 square feet and had been vacant since October 22, 2007. A code
compliance inspection had not been done, the vacant building registration fees were delinquent in
the amount of $1,000, and the $5,000 performance bond had not been posted. On July 16, 2008, an
inspection of the building was done and a list of deficiencies which constitute a nuisance condition
was developed. An order to abate a nuisance building was posted on August 1, 2008 with a
compliance date of September 1, 2008. To date, the property remained in a condition which
comprised a nuisance as defined by the L,egislative Code. Ramsey County Taxation estimated the
market value of the land to be approximately $25,700 and the building to be $92,300. Real estate
taxes for 2��8 were delinquent in the amount of $1,826.01, plus penalty and interest. Code
Enforcement estimates the cost to repair the building to be approximately $50,000 to $60,000. The
cost for demolition was estimated to be approximately $10,600 to $14,600. There had also been 16
suinmary abatements issued to this property since 2007, 16 of which went to work order: to secure
the building and the City had to board the building to secure it from trespass, remove improperly
stared refuse and miscellaneous debris, cut tall grass and weeds, and remove snow and ice. Code
Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner
presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was an
1886 workers' cottage-style building. There was a loss of integrity to the exterior of the building as
the siding had been covered; however, it appeared that there were some original windows. This
property was located within the potential Frogtown historic district, it had not been surveyed;
however, she did not recommend forwarding this property to the HPC for a recommendation.
Given the historic location of the property, she would encourage rehab.
Ms. Moermond stated that since she believed this property may be located in the Invest St. Paul
area, she would defer to the Councilmember before making a recommendation.
