(c) Livingston Trunk. This is to be an open cut sewer in Livingston Avenue from Stevens Street to Annapolis Street, i varying in diameter from 30 inches to 48 inches. • (d) Oakdale Trunk. This is to be an open cut sewer E r in Oakdale Avenue from Stevens Street to Annapolis Street, varying in diameter from 33 inches to 48 inches. i All of the above sewer facilities described under M letters (a), (b), (c), and (d) above, for convenience of f i reference, hereinafter shall be referred to as Phase I of the Project. (e) Dodd Road Trunk. This is to be an open cut sewer t in Bidwell Street from Curtice Street to Dodd Road, and in r Dodd Road from Bidwell Street to Stryker Street, and in F k Stryker Street from Baker Street to Stevens Street, and in r Stevens Street from Stryker Street to Hall Avenue. For convenience of reference the construction contemplated by t this Paragraph (e) herinafter shall be referred to as 4 Phase II of the Project. P t F If 4 k F F l • N 3 ST. PAUL will own the system but WEST ST. PAUL may use it jointly with ST. PAUL. 4 ST. PAUL will begin Phase I of the Project immediately after this agreement takes effect and will complete the work without interruption or delay. Phase II will be completed by December 31, 1967. Any delay resulting from a cause not under the control of ST. PAUL will not amount to a breach of this agreement. 5 In accordance with plans approved by ST. PAUL, WEST • ST. PAUL will build and maintain the interceptors marked in green on attached "Exhibit A" at its own cost and expense, completing them on or before December 31, 1964. ST. PAUL may also have until December 31, 1964 to complete the Oakdale and Livingston extensions within ST. PAUL. 6 ' After ST. PAUL has completed Phase II JgEST ST. PAUL may build a storm sewer system draining the approximately 436 acre area marked in yellow on attached "Exhibit A" and connect it with the ST. PAUL storm water system described above as Phase II without further payment. If WEST ST. PAUL builds further storm sewers in the area marked in red on attached "Exhibit A" which connect with the ST. PAUL system, WEST ST. PAUL will pay ST. PAUL will maintain the system at its own expense. 9 Under the terms of Ordinance No. 8829 of ST. PAUL as amended, WEST ST. PAUL may extend sanitary sewers which will connect with the ST. PAUL system. Areas in which sewage will not flow by gravity into sewers connecting with the ST. PAUL system must have connexions with the Robert Street sewer. WEST ST.
