WHEREAS, under Council Files No. 199520, 199823 and
200230, the City Council of the City of Saint Paul condemned
the property known as 1389 Hawley Street, legally described as
Lot 26, Block 5, Hager's Subdivision of Lots 1 to
7 and 14 to 18 of Walcott's Addition to Cottage
Homes; _1":-
and
WHEREAS, under Council File No. 203803, the City
Council on September 5, 1961 awarded a contract to Guy
Patsy & Sons, Inc., which contract called for the removal
of a building situated on the aforementioned property; and
WHEREAS, the said Guy Patsy & Sons, Inc., in bidding
upon said building removal and in preparing to perform the
work contemplated by the removal contact, incurred certain
expenses as set forth-. in their Notice of Claim against the
City of- Saint Paul, presented to the City Council on the 13th
day of October, 1961;and
WHEREAS, by reason of the removal of the building
located upon the aforementioned property prior to the time
that Guy Patsy & Sons, Inc. was able to enter upon and remove
said structure, said removal being effected by a pgrtynor
parties unknown, and said removal workMg a complete frustra-
tion of the removal contract heretofore awarded to Guy Patsy
& Sons, Inc.,
Now, Therefore, be it
RESOLVED, That proper City officers are hereby authorized
and directed to pay Guy Patsy & Sons, Inc. the sum of Sixty
Dollars ($60.00) in full settlement and satisfaction of all

claims and demands of said Guy patsy 8 Sons, Inc. arising
out of or occasioned by the award of the contract for the
wrecking and removal of the structure located at 1389 Hawley
Street, upon said Guy Patsy 8 Sons, Inc. furnishing the City
of Saint Paul an executed release in favor of said City,
in a form to be approved by the Corporation Counsel of the City
of Saint Paul; and be it
FURTHER RESOLVED, That the amount so paid shall be made
a lien upon said property in the same manner and with the same
effect as if the removal of said building had been fully performed
by said Guy Patsy 8 Sons, Inc., save onl in the amount of
said lien, which shall be Sixty Dollars $60.00).
