Presented by
BE IT RESOLVED that, upon the petition of NEDU, LLC (for Frogtown Development) as
documented in Public Works Technical Services, Vacation File Number 14-2008, the public
right-of-way hereinafter described, as follows and as depicted on attached map Eshibit A, is
hereby vacated and discontinued as public property, and subject to herein stated objections, the
easements within said public right-of-way are hereby released:
That part of the alley in Block 2 Subdivision of Block 13 Stinson's Division,
east of Dale Street and West of a line between the easterly lot lines of Lots 9

This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981,
of the Saint Paul Legislative Code as amended, and to the following conditions:
1. That the petitioners, theu successors and assigns shall pay $1200.00 as an administrative
fee for this vacation which is due and payable within 60 days of the effective date of this
resolution.
2. That the petitioners, their successors and assigns, meet the following requirements of the
City of Saint Paul to the satisfaction of the City's Department of Public Works:
a. That the petitioners, their successors and assigns ("Petitioner") shall supply, on
their own properiy appro�cimately as shown on E�ibit A, a sufficient amount of
new right-of-way to allow truck huniug movements to proposed north/south
alley, which must then be dedicated to the City prior to the recording of this
document;
b. That the new alley be constructed to Public Works' satisfaction under a permit
granted by Pubiic Works Street Engineering;
c. That the petitioner shall not be allowed to close off the exisfing alley until they
have constructed the new alley ouUet or provided an alternate alley outlet to the
satisfaction of the Department of Public Works;

The petifioner is required to obtain site pIan approval from the City for the
development and reuse of the vacated alley;
And that the petifioner shall be responsible for all expenses to eliminate the

appeazance of a public thoronghfaze at both ends of the vacated alley, which
shall include, but not be limited to the construction of new curb, gutter,
sidewalk, boulevard, storm sewer facilities and sign changes, ali to the
satisfaction of the Department of Public Works.
3. That an easement shall be retained on behalf of Comcast, a Pennsylvania Corporation, for
e�sting facIlities. The petitioner or its successor shall provide new easements if required,
and the petitioner or its successor shall assume all costs of relocating facilities to the new
easements.
4. That an easement shall be retained on behalf of Northern States Power Company d/b/a
Xcel Energy — Electric Division for existing facilities. The petitioner or its successor shall
provide new easements if required, and the petitioner or its successor shall assume all
costs of relocating facilities to the new easements.
5. That an easement shall be retained on behalf of Qwest Communications, a Delawaze
corporarion, for existing facilifies. The petitioner or its successor shall provide new
easements if required, and the petitioner or its successor shall assume all costs of
relocating facilities to the new easements.
6. That the petitioner, their successors and assigns agree to indemnify, defend and save
hax•mless the City of Saint Paul, its officers and employees from all suits, actions or claims
of any chazacter brought as a result of injuries or damages received or sustained by any
person, persons or properiy on account of this vacation, or the petitioners' use of this
property, including but not limited to, a claim brought because of any act of omission,
neglect, or misconduct of said petitioners or because of any claims ar liability arising from
any violation of any law or regulation made in accordance with the law, whether by the
petitioners or any of their agents or employees.

third and fourth floors. A large portion of the new building wiil be built upon the ex6sting alley resulting
in the alley being inaccessibfe.

The purpose of this vacation is to allow the developer to utilize the site for grocery, residential units and
parking. The developer will dedicate, as a condition of this vacation, a new north-south alley (to our
specifications) in the area approximately as shown on the map,

Conditions/Reasons:
A sufficient amount of new R.O.W. to allow truck turning movements to proposed
north-south alley needs to be dedicated.
The new alley will need to be constructed to Pubiic Works satisFaction under a permit
issued by Public Works Street Engineering.
The petitioner will not be allowed to close off the existing alley until they have
constructed the new alley outlet or provided an alternate alley outlet tA the satisfaction
of the Department of Public Works.
The petitioner is required to get site plan approval from the City for the
development and reuse of the vacated alley.
The petitioner shall be responsible for aII expenses to eliminate the appearance of a
public thoroughfare at both ends of the vacated alley, which shall include, but not be
limited to the construction of new curb, gutter, sidewalk, boulevard, storm sewer facilities
and sign changes, aIl to the satisfaction of the Department of Public Works.
