Hemple and Vivian M. Hemple, his wife, who occupy a home at 107 North Hamlin Avenue and whose home is to be moved to the rear of their lot to allow for con- the new bridge`to be 20916 NO. 1 WHEREAS, the City Engineer has heretofore requested the City Architect to proceed with the wrecking or removal of certain structures on North Hamline Avenue; and WHEREAS, Carl A. Hemple and Vivian M. Hemple, his wife, who occupy a home at 107 North Hamline Avenue and whose home is to be moved to the rear of their lot to allow for con- struction of the new bridge to be located in that vicinity, have requested.the City to permit them to move into a home at 115 North Hamline Avenue which is one of the homes which will soon be demolished, it being their desire to occupy such structure until their home has been moved to the rear of their lot and they are permitted to reoccupy it; and WHEREAS, they have requested permission to occupy the structure at 115 North Hamline Avenue until the 31st day of May, 1961, and such occupancy is agreeable to the Department of Public Works; now, therefore, be it RESOLVED, That permission is granted to Carl A. Hemple and Vivian M. Hemple to occupy the structure at 115 North Hamline Avenue until the 31st day of May, 1961, unless vacated sooner by them, the occupancy by,the Hemples at 115 North Hamline Avenue to be subject to each and all of the following conditions: 1. No rent is to be received or accepted by the City for such occupancy; 2. The structure at 115 North Hamline Avenue shall be vacated by the Hemples on or before the 31st day of May, 1961; 3. Carl A. Hemple and Vivian M. Hemple agree to file with the City of Saint Paul a comprehensive public liability insurance policy protecting the City from any claims resulting from bodily in ury occasioned by the use of said structure, in the amount of 10,000 per person and $20,000 per accident, such policy of insurance to be subject to approval by the Corporation Counsel, and upon such approval to be thereafter filed with the office of the Comptroller of the City of Saint Paul; 5. The terms and conditions of this resolution must be accepted by Carl A. Hemple and Vivian M. Hemple, by letter, within five days after passage of this resolution, such letter of acceptance of the terms and conditions herein to be filed with the City Clerk.
