Dear Madam:
This is in the matter of the appeal of Alfred J. Tetzlaff to relax the off -
street parking lot side yard set back requirements between two proposed
apartment building sites, on property located at the northwest corner of
Clarence and Conway Streets and the property adjoining to the west. Parcel 1
is described as the east one -half of Lot 22 and all of Lots 23 and 24, Block 16,
E. R. Bryabt's Sub. Parcel 2 is described as the west one- half.of Lot 22, and
all of Lots 21 and 20, Block 16, E. R. Bryabt's Sub. The entire site was re-
zoned from "A" to "C" residence on August 8, 1959 for the proposed development.
Parcel 1 has a frontage of 94.09 feet along Conway Street and 124 feet along
Clarence Street, resulting in a total area of approximately 11,667 square
feet. Parcel 2 has a frontage of approximately 100 feet along Conway Street,
extending to a depth of 123.7 feet, resulting in an area of approximately 12,370
square feet.- Parcel 1 is being developed with an 11 unit apartment building
with off- street'parking Accessory thereto. Parcel 2 is vacant and the appli-
cant proposes to develop it with an 11 unit apartment building with off - street
parking accessory thereto. The applicant is requesting a relaxation of the
off- street parking lot side yard set back requirements between the two apart-
went building sites which will enable him to develop the off- street parking
across the rear of the properties, thereby providing more adequate yard areas
for the tenants.
Field investigation discloses that the request is reasonable in that it will
permit a more desirable development and will not adversely affect other pro-
perties in the area. North and across an alley are single - family residences
fronting on E. Third Street; east and across Clarence Street is vacant land;
south and across Conway Street is a shopping center; west and adjoining is
vacant land.
The Board of Zoning considered this matter at their regular meeting on
April 6, 1961 and recommend approval of the appeal to relax the off - street
parking lot side yard set back requirements for the above described pro-
perty subject to a bumper height fence being constructed between the two
parking lots.

construct two eleven unit apartment buildings on said property.
Mr. Tetzlaff has obtained a permit for the construction of
the building on Parcel No. 1 and is presently applying on a permit
for Parcel No. Z. In order to obtain a more orderly arrangement
of -the off - street parking for both parcels it would be advisable to re-
lax the parking lot side yard set -back requirements of eight feet to
zero feet along the West property line of Parcel 1 and along the East-
erly property line of Parcel Z. Mr. Tetzlaff will construct a bumper
high fence to separate the two parcels. This appeal is made from
Section 64.03 paragraph I of the City Ordinances:, which requires the
eight -foot set - backs.
