Army Engineer District of Saint Paul, Minnesota, its officers, agents, employees and contractors, the full and unrestricted right, license and privilege to enter upon, occupy, use and affect all lands, easements and rights -of- way owned and/or to which the City is legally entitled to possession as shown on the said•Exhibits A, B and C. including the right, license and privilege to spoil excavated materials on the areas referred to herein in connection with the construction and subsequent maintenance of the aforesaid Flood Control Project; be it FURTHER RESOLVED, That the Council also grants to the United States of America, acting through the District Engineer, U. S. Army Engineer District of Saint Paul, Minnesota, its officers, agents, employees and contractors the right, license and privilege to enter upon, occupy, use and affect lands described in the borrow pit agreements enteralinto between the City of Saint Paul and owners of the borrow pit areas as shown in the attached diagrams marked Exhibits D and E and made a part hereof by reference, such rights hereby granted with respect to the aforesaid borrow pit areas to be limited by the terms of the lease agreements between the City and the owners of such borrow pit areas, copies of such agreements having heretofore been furnished to the District Engineer, U:.S. Army Engineer District of Saint Paul, Minnesota. No. 199800, gave certain assurances as vided therein to the Secretary of the Army, through the District Engineer, U. S. Army Engineer District of Saint Paul, Minnesota; and - n. by pro- WHEREAS, the City of Saint Paul has acquired tte necessary land, easements, rights of way and spoil areas in connection with Stage 1 of the Flood Control Project along the Mississippi River in Saint Paul, Minnesota, from the westerly end of said proposed Flood Control Project to �Ayandotte Street in the City of Saint Paul, legal descriptions of the area acquired by the City being set out in resolutions of the Council, C. F. No. 200880, approved February 21, 1961 as amended by C. F. No. 201556, approved April 13, 1961; C. F. No, 200703, approved February 7, 1961, as amended by C.F. No. 201429, approved March 30, 1961; and C.F. No. 200594, approved January 31, 1961, as amended by C. F. No. 2009689 approved February 24, 1961, said areas being shown on the maps.which have been marked as Exhibits A, B and C attached hereto and made a part hereof by reference, now, therefore, be it RESOLVED, That the Council- of the City of Saint Paul hereby represents to the Secretary of the Army and the District Engineer, U. S. Army Engineer District of Saint Paul, Minnesota, that the City has acquired all necessary lands, easements and rights -of -way and /or is legally entitled to the possession thereof, in fulfillment of the assurances made pursuant to C. F. No. 199800, said lands being described in resolutions of the Council of the City of Saint Paul, C. F. No. 200880, approved February 21, 1961 as amended by C.-F. No. 201556, approved April 13, 1961; C. F. No. 200703, approved February 7, 1961, as amended by C. F. No. 2014299 approved March 30, 1961; and C. F. No. 2005949 approved January 31, 1961, as amended by C. F.
