O'Connell City Clerk Building Dear Madam: This is in the matter of 1) the appeal of Mr. Ben Gleeman to relax the 13 foot off - street parking lot set back requirement from Nebraska Avenue to zero (0) feet, and 2) the application for a 34 car customer off-street parking lot accessory to the proposed liquor store to be located at the northwest corner of White Bear and E. Nebraska Avenues. The property is described as Lots 26, 27, 28, 29 and 30, Block 2, J. A. Humphrey's Sub.A. Ori August 25, 1956, the City Council rezoned the above described property from an "A" residence to a commercial district for the purpose of con- structing a furniture and appliance market. The site is presently vacant; however, until recently it has been used as a nursery sales lot. The pro- perty has a frontage of 200 feet along E. Nebraska Avenue and 124 feet on White Bear Avenue, resulting in an area of 24,800 square feet. South and directly across Nebraska Avenue is a vacant lot, adjoining this tract on the south is a single - family residence which fronts on White Bear Avenue; east across White Bear Avenue are three single- family residences fronting on White Bear Avenue; north across an unimproved public alley is a filling station; west and adjoining are six single - family residences, five of which have been built in recent years; southwesterly across Nebraska Avenue are single - family residences. _Chapter 60.23, Section 5, paragraph "c" of the Zoning Code states that no part of an off- street parking facility located on an open lot shall extend closer to a street than one -half of the required building line setback. The building line set back from Nebraska Avenue presently is 25 feet which would therefore require a 13 foot set back for the parking lot. Field investigation discloses that in order to protect the single - family residences to the west, the building line set back should not be relaxed to a greater extent than six feet. By parking the cars at an angle on the Nebraska Avenue side of the parking lot, there would be ample room for parking and still main- tain a set back of six feet. The Traffic Engineer has approved the plans which meet the standards for this type of facility. The Board of Zoning considered this matter at their regular meeting on March 16, 1961, and recommend: 1) the relaxation of the required 13 foot set back to a six foot set back from Nebraska Avenue and angle - parking on the Nebraska Avenue side, and 2) the granting of the permit for an off - street parking lot for 34 cars in accordance with plans approved March 16, 1961. Presently there is no building on the property, and in. order that there maybe adequate, convenient off street parking on the south side of the proposed structure between it and East Nebraska Avenue, it is respectfully requested that, under the provisions of Section. 64.03(i) of the St. Paul Legislative Code, the undersigned. be permitted to establish said parking lot without set back. The property north to Larpenteur on, the west side of White Bear Avenue is. now wholly commercial. The property on. the southwest corner of Nebraska and White Bear Avenue is vacant.
