Dear Madam:
This is in the matter of the petition of Alfred N. Scheid to rezone from "A"
residence to "C" residence property located on the south side of Clear Avenue
between the service drive of Highway 35E and Westminster Street. The property
is described as the north one -half of Lot 20 and the north one -half of the east
one -half of Lot 19, J. W. Bass Garden Lots. The property has been zoned "A"
residence since the adoption of the ordinance in 1922.
`On -March 7,'1961, the Commissioner of Finance reported the petition sufficient
witti the owners of 14 of a possible 21 (66 2/3%) tracts of land within the ,
required 100 foot radius having signed the petition. A small portion of the
tract is presently developed with a very old single- family residence, a barn
and a garage, all of which are in poor repair. The remaining part of the tract
is vacant. If rezoned, the applicant proposes to develop the site with six 17-
unit apartment buildings. This property has a frontage along Westminster Street
and along the service drive of Highway 35E of approximately 390 feet, and a front-
age along unimproved Clear Avenue which adjoins this property on the north of
approximately 465 feet, resulting in an area of approximately 181,350 square feet.
Directly north across unimproved Clear Avenue are vacant lots fronting on said
street; farther to the north are two single - family residences fronting on Cottage
Avenue, and two single - family residences fronting on Westminster Street; east and
across Westminster Street are two single - family residences fronting on said street,
a large portion of this land is being used for gardening purposes; south and ad-
joining is vacant property fronting on Highway 35E and also five single - family
residences and one two - family residence all of which have been built between 1948
and 1957 and fronting on Westminster Street; west and adjoining is the Highway 35E
right -of -way.
It should be, pointed out that there appears to be a question as to whether part
of Lot 19 as described in this petition may be, or is in the process of being
acquired for highway right-of-way purposes. Clarification on this point was not
available at the time of the Board of Zoning hearing.
The Board of Zoning having considered this matter at their regular meeting of
March 16, 1961, recommends the granting of the petition to rezone the above
described property from "A" residence to "C" residence subject to the exclusion
of any part of Lot 19,as described in the petition,which may be acquired for
highway purposes.
