t WIIEREAS, Park Square Theatre d/6/a Park Square Theatre, located at 20 7'�' Place West in Saint
2 Pau1, has applied for an On-Sa1e Liquor — Theatet license; and
4 WHEREAS, § 409.06(n) of the Saint Paul Legislative Code prohibits issuance of a liquor license
5 within 300 feet of a church; and
7 WHEREAS, Park Square Theatte dib{a Park Square Theatre requests waiver of the provisions of §
s 409.0\69(n) prohibiting issuance of a liquar license within 300 feet of a Church; and
l0 WHEREAS, a Church is located within 300 feet of 20 7�' Place West and that church has signed a
11 waiver of the 300 feet prohibition which is attached to this resolution; and

13 WHEREAS, § 409.06 allows waiver of the 300 feet prohibition based on consent of the Church and

WHEREAS, at least 5 members of the Councii vote that the application is in order and there are no
grounds for denial of the licenses and that the failure to grant the waiver would cause exceptional and
unusual hardship to the license applicant; now therefore, be it,
RESOLVED, that the 300 foot restriction of § 409.06 of the Saint Paul Legislative Code is hereby
waived and an On Sale Liquar —Theater license is issued to Park Square Theater d/b/a Park Square
Theahe, located at 20 7�' place West in Saint Paul.

Any ficenses in force and eCiect on November 1 Q 1962, the location oi which license is in conflict with the
provisions hereof, may be renewed, transferred or otherwise dealt witli in accordance with Iaw, it being the
inten[ of this paragraph that it be applied prospecfively for proposed locarions of hcenses, and further it being
